Case history

On April 10, a larger bench of the high court had reserved judgment on a petition by Pakistan Tehreek-e-Insaf (PTI) leader Usman Dar. The larger bench, comprising Justice Athar Minallah, Justice Aamer Farooq and Justice Mohsin Akhtar Kayani, had directed the parties to submit written arguments.

So how should the proceedings work if there are no proofs?
that is the reason many terrorists were apprehended and later released by our courts due to lake of evidences... system have many loops and holes and people use them for their benefits as and when required

All ISPR said was to look into the allegations. How is that interference?

This "Fauji Sazish" smells so similar to the "Yahoodi Sazish" I hear about from mullahs. Same exact mentality.

Copying and pasting random English quotes that have no relevance to the discussion proves what exactly?
barking at wrong tree

Did Shokat Siddqui also take oath on PCO in Musharraf's era or he was born on the bench in high court suddenly out of a boar after Musharraf?

@BHarwana @Zibago

If he took oath on PCO himself, how dare he is asking SC to form a commission consisting judges who didn't take oath on PCO?

He also wants shugal i mean civil society to be present during the hearings. He wants a tamasha not a proper hearing.

@PakSword it is not where they are from. Every one is trying to grab power and say in Pakistan.

Gan*u judge..

A judge who:
  • was a candidate of MMA in 2002 election.. conducted by General Musharraf..
  • took oath on PCO in 2007
  • was sent home unceremoniously when his nomination following a judicial process were not approved by the highest authority.. and then reappointed for a short term only (six months)..
  • is a cousin of Nawaz's advisor, Irfan Siddiqui

Now wants that investigation on his unfounded claims should be done by a non-PCO judge.. what a farce.

@BHarwana @Zibago

He is a bigoted rang baaz who sells the Islami jamhori manjan i am just surprised champions of liberalism are siding with a guy who wants to create a list of minorities and later on force parliament to create strict laws against them

That is a serious problem in Pakistan. But we don't have any solutions, at least not yet.

They have gun.

Hang him by his balls if he can't prove his allegations. Set an example for these Khotakhors.
There is a method to this madness, just put this development in context of some previous developments, Army was on the hit list from past many years now expect judiciary to become the top priority, specially when Justice Shakuat choose the time to raise his allegations just before the elections in District Bar Rawalpindi and made specific remarks about Nawaz Sharif.

If you remember Shabaiz Sharif's interview (at 9:00 min and at 16:20 min) in which he suggested about the NATIONAL GOVERNMENT and a new SOCIAL CONTRACT (new constitution), but the questions which he never answered are

1- How a new constitution will be made without the formation of CONSTITUENT ASSEMBLY?
2- And how in the presence of an EFFECTIVE CONSTITUTION a constituent assembly will be formed ?

The effectiveness of constitution is based on effectiveness of Constitutional organs of the State namely
1- Parliament
2- Judiciary (Keep in mind this constitution provides certain protections to Judiciary)
3- Executive

Pakistan is about to have elections which Mr. Sharif and to an extent PPP trying to make disputed so whatever governments comes in power in result of the election will be disputed by them (at least by PML-N and allied parties) so the next Parliament and Executive will not only have political challenges but will also have disputed foundation which mean two out of three organs will become controversial and will not remain effective to deal with arising challenges.

In this case the importance of Judiciary will increase and should be in position to deal with the crisis the same way it deal with the crises in the year 2015, but just imagine what If JUDICIARY itself becomes controversial ....?? obviously in this case it will not be in a position to deal with the crises, so effectively Pakistan will have a CONSTITUTIONAL CRISIS as no institution of Pakistan will be in position to deal with the situation because of numerous controversies related to them.

Now the question is why a CONSTITUTIONAL CRISES is required an by whom.?

If we assume what PML-N and Shakuat Siddiqui are saying is true than it means Army have effective control over the system and they can easily install the government of their choice, so the next POLITICAL SETUP will be nothing but the extension of ARMY CONTROL over the state of Pakistan.

In this case Army does not require a CONSTITUTIONAL CRISIS which may put their control over Judiciary and over the next government in danger, so in this case PML-N and PPP should have some relief by the Judiciary and Army so that all the players and pawns of new and previous step-up should remain in the game. Is it happening ....???

If the allegation are not true than why a controversy which in future may raise a constitutional crisis is deliberately raised ....??

For this we have to identify the beneficiaries of the potential crisis and for this we need to know the stakes of which players of current political setup are diminishing.

1- Nawaz Sharif and his Family
2- Asif Ali Zardari and his family who are next in line

For Nawaz & Co
We know that Nawaz is disqualified for life under the CONSTITUTIONAL Article 62(1-f), and after his disqualification PML-N tried to gather enough support in parliament to amend the constitution with retroactive effects but failed, his party is not going to have majority seats this time neither will be in the position to dictate the parliament so effectively will have no meaningful stakes in upcoming Parliament

So if due to some crisis large enough which may fail the constitutional arrangements will also benefit NS and his family as he will come in position to negotiate a better future for himself and for his family in the absence of Constitution and the institutions formed under the constitutions.

And the situation for Asif Ali Zardari is more dangerous as he and his family (his sister) not only poses assets beyond mean same as Sharif family but also have criminal cases so both of them are natural allies and can escape from eventual end only if constitution is completely abandoned, as that situation will make courts powerless which is now acting as the most powerful organ of the STATE on bases of powers and protection under the constitution.

This Justice always a controversial person from day one, don't know who made him justice. He celebrate the death of Governor Salman Taseer . But, now he is targeting everyone right and left. It seems he is in deep problem.
