Islamabad police drop ‘torture’ charge, register water-down FIR against judge’s wife

ISLAMABAD: The capital police have booked the wife of a civil judge involved in alleged torture on a 13-year-old maid with criminal intimidation and wrongful confinement, without mentioning physical torture on her in the FIR.

Police officers told Dawn that in a similar case of torture on a maid in 2016, the police had registered a case under section 342, 506 and 337 of the PPC.

The officers said the latest case was registered under section 506 (punishment for criminal intimidation) and 342 (punishment for wrongful confinement) despite the fact that the complainant had categorically stated that the judge’s wife tortured his daughter daily and she had a number of injuries on her body.

Besides the complaint of Manga Khan, father of the maid, the police have also a medico-legal certificate which mentioned 15 injuries on the body of the girl, including marks of strangulation, but the suspect was not charged with the sections relevant to strangulation, torture and injuring.

According to the girl’s medico-legal certificate (MLC), she had “laceration on head from vertex, on forehead, right side above eyebrow, swollen upper lips, laceration under upper lip on right side, broken left incisor and left canine, laceration on check, nose bleed, laceration on left side of vertex, multiple bruises on lower leg, fracture on right forearm, swollen left and right eyelids, bruise on right skull, laceration on back, multiple bruises on back and attempt on strangulation.”

Earlier, the Sargodha police provided the MLC of the girl and the complaint from her father to the capital police for registration of a case before Monday afternoon. However, the police were reluctant to register the case, the officers said, adding the Sargodha police also talked to the relevant officers of the capital police from the IGP to the SHO and the case was registered early on Tuesday.

Although the police registered a case, but investigation is yet to be started and so far no legal action has been initiated, the officers said. It is yet to be decided if the case will be investigated at the police station level or handed over to the investigation wing as it falls in the category of juvenile and child abuse.

The case was registered at the Humak police station in response to the complaint from the girl’s father, a labourer by profession. According to the FIR, he sent his daughter to the house of the judge at Zartaj Housing Society through an acquaint against Rs10,000 per month salary.

On July 23, he along with his wife and brother-in-law came to the judge’s house to meet his daughter and found her injured and weeping in a room, it added.

They found infected injuries on his head besides wounds all around the face, both arms and legs, the FIR said, adding her tooth was also found broken and swilling on both lips and eyes.

“Her ribs were also found broken, and injuries were found on her back. Marks of strangulation were also found around her neck.”

When asked, she told her family that the judge’s wife used to torture and beat her with baton and spoon daily and did not provide her dinner.

The girl was detained in a room since her arrival at the house. Later, the family took her to the Sargodha DHQ hospital where the girl’s condition deteriorated and was then referred to Lahore.

Despite repeated attempts, police officials concerned could not be contacted for comments.

Is ka saath saath bachi ka parents ki be sara aam chitrol honi chaie. Randi ka bacha, lulli control hoti nahi or bacha pa bacha paida ker ka logon ka ghar kaam per phank deta hain harami.

Judge, wife involved in maid’s ‘torture’ go into hiding, claim police

ISLAMABAD: Police on Wednesday claimed that the judge and his wife involved in alleged torture of a 13-year-old maid had gone into hiding, thus hindering the investigations.

According to police officers, the police teams raided the judge’s residences in Islamabad and Lahore, but found both the houses locked.

According to them, the police high-ups had not yet decided whether the case should be investigated at the police station level or by the special investigation unit, as required under the Anti-Rape (Investigation and Trial) Act 2021.

They said the investigation was facing a delay as the concerned superintendent of police (SP) had not yet shared details of the case and documents available with the zonal police with the investigation wing.

The complaint of Manga Khan, father of the maid, and a medico-legal certificate (MLC) which mentioned 15 injuries on the body of the girl, including marks of strangulation, had been provided to the Capital police by the Sargodha police, but the suspect was not charged with the sections relevant to strangulation, torture and injuring.

It was after several requests by the Sargodha police that the capital police registered a watered-down FIR.

The case was registered at the Humak police station in response to the complaint from the girl’s father, a labourer by profession.

According to the FIR, he sent his daughter to the house of the judge at Zartaj Housing Society through an acquaint against Rs10,000 per month salary.

A police officer told Dawn that not only hiring an underage person for the household jobs was an offence, but concealing facts was also a crime as the girl was allegedly detained and tortured at the house of the judge but he did nothing to rescue or save her from his wife.

Meanwhile, the police through its official Twitter handle claimed that efforts were in progress to arrest the “female accused.”

“The case will be investigated on merit, besides all legal requirements will be met as law is equal for all,” the police claimed.

The concerned officer and the spokesman for the police were not found available for comments despite repeated attempts.

I call upon the Federal Shariah Court and the military court to take up the case. There is clearly foul play due to judge being involved.

These cases are the biggest cause as to why terrorism spreads in communities as justice and freedom is held mistress by a few entitled individuals of the system. No bill, act or constitutional amendment can help deter terrorism if it's a byproduct of the same system.

If I advocate that the whole family should be put through a cheese grater for killing a minor in that household, would that be advocating terrorism? Will courts of Pakistan declare me a radical extremist?

Judge's wife accused of torturing minor maid granted interim bail​

Defendant maintains innocence while teenage girl battles for life

A district and sessions court granted interim bail on Wednesday to the wife of a civil judge, accused of brutally torturing a teenage maid employed in her service.

The case was heard before Additional District and Sessions Judge Dr Abida Sajid.

The accused was granted interim bail till August 7 against a surety bond of Rs100,000.

The court directed the accused to cooperate with the investigation and appear before Additional District and Sessions Judge Farrukh Farid for the next hearing.

In her application for bail, the accused termed the defendant’s case false and contended that the narrative painted in the FIR was fabricated.

She maintained that the teenage maid, Rizwana, was hired with the consent of her parents and no physical violence was committed against her.

Moreover, the accused claimed that Rizwana was older than 17 years of age.

The accused maintained innocence and insisted that she was being maligned as part of a slander campaign being carried out against her husband, who is a civil judge of good reputation.

She said she had never raised a hand on Rizwana but always treated her with the gentleness she shows her own three kids aged between nine to 12 years.

Pleading for bail, she assured the court that she will cooperate with the investigation and will provide evidence of her innocence.

Domestic violence

Rizwana, a minor housemaid, employed by a civil judge was brought to the District Headquarters Hospital in Sargodha in critical condition reportedly with wounds on her face, head and body that were said to have been caused by a “blunt weapon”. The girl also bore burn marks on her body.

She was later shifted to the intensive care unit (ICU) at the Lahore General Hospital, with doctors fearing for the teen’s life.

According to hospital sources, she was brought in on July 24.

The Principal of Ameeruddin Medical College/Lahore General Hospital, Prof Al-Fareed Zafar, called an emergency meeting of the Special Medical Board and the members conducted a thorough medical examination of Rizwana.

The doctors believe the wounds were old, due to which the infection in blood had increased, and the complications affected some organs of the body.

The medical board members told the media that the girl had an infection in her lungs which was affecting her breathing.

She had an infection in one lung and blood clots in the other.

Doctors said that the saturation was decreasing due to infection and clots.

Rizwana has been diagnosed with sepsis.

Prof Al-Fareed Zafar said that the girl had been brought to the LGH in a very critical condition where doctors were trying hard day and night to save her life, and in this regard, a special medical board was also formed. The treatment was being monitored.

The principal said Caretaker Health Minister Dr Javed Akram, a renowned physician, was also providing guidance regarding treatment of the girl.
