Right...they want to sell a cancer drug for $96,000 which we sell for $177 ... Making money over peoples lives and the US govt. is fully backing it (no surprise there)..

Well..US can go to a corner and cry , the decision has already been made by the Supreme court...

usa ruled by corporates and families like rockefeller,koch etc.

But now every country is integrated to the global economy and financial system and the west can cut you off or anyone that does business with you. Russia is far too weak to go against the west economically and Russian firms will suffer. They aren't the USSR.

So answer to you question, whether is India breaking any law here? As per America, yes they are violating laws which is not good for Indo-American relationship for long term. As per India, no they are not breaching any laws, they are just fulfilling need to its citizens...

India is a signatory of WTO by virtue of which it is abide by worldwide intellectual property standards under the TRIPS agreement. As part of this agreement, India made changes to its patent law; the biggest of which was that prior to these changes, patents on products were not allowed, while afterwards they were, albeit with restrictions. These changes came into effect in 2005, so Novartis' patent application waited in a "mailbox" with others until then, under procedures that India instituted to manage the transition. India also passed certain amendments to its patent law in 2005, just before the laws came into effect

India is breaking no treaty, no international law. The very fact that the US is opting for unilateral action rather than drag India to the WTO (as they are doing on solar panels) is proof that there is no case. When Novartis asked the Swiss government to take India to the WTO, the swiss government in effect told Novartis to take a hike, They knew that they would not have much chance in any action brought in the WTO.

Indian actions on compulsory licensing are explicitly permitted in the WTO agreements, the US and other countries would wish for the non-use of such sections but they certainly are not illegal. Media propaganda is just that.

@drunken-monke Compulsory licensing is within the law, so are generic drugs, and ever-greening practiced by MNC pharma companies is blatantly illegal & unethical, I think India will win if these cases go to international court.

Compulsory licensing is within the law (of India) for life saving drugs required in a pandemic.. Not all..

Not just India, it is permitted in international law & explicitly allowed under the TRIPS agreement article 31. In any case, such licensing predates TRIPS and is clearly mentioned even in the Paris convention of 1883.

the recent dent in the U.S/India ties is a quiet confusing one to be honest, the "reason" is what is puzzling in this case as it doesn't make much sense to honest , however one analysis is that of India's reluctance or hesitation regarding its role in the pivot to Asia policy ( the China factor), or sort of a lack of will or a hesitation to any firm commitment particularly from India's side might be the reason for the U.S discomfort from a geo-strategic point of view, this is the only reason which makes sense

I think you are reading more to this than necessary. Specifically on this case and others of similar nature(on trade), the US position is largely driven by its trade interests. There will always be political inputs but I dont see that as a driving factor here.

India is extremely dependent on foreign oil. Without energy you collapse.

India has zero financial clout. India is a net debtor country. India runs massive current account deficits. India has very small forex reserves. India has to borrow from the the international market. Indian market is small. Indian economy is declining. India has no technology. India has no UNSC veto power. India has no manufacturing. India is utterly insignificant not just in the global economy but just in the world generally.

The west relies for nothing on India and India is reliant on western technology, western markets, western FDI, western financial system, western funding, western aid, western approval to join WTO, IMF, World Bank, UN, etc.

By challenging the US, they will be less reluctant to ever give India a permanent seat at the UNSC let alone veto power. They will say they will but actually won't do it.

India is extremely reliant on the world for everything from weapons, to manufactured goods to technology, to financing, EVERYTHING!

All India is just an overpopulated country with mass poverty and malnutrition.

As I said numerous times, it depends how far US wants to take this and how severely they want to crush you. If you threaten them, they will go for Iran-style sanctions targeting the market access and financial system. Then sanction any company doing business with India by banning them from the US financial system and access to US market and using of the dollar in trade.

They can dismantle the spine of the Indian civilisation if they wanted to. They can bring you to your knees and make you grovel.

And about US FYI it works on the orders of massive size MNCs, and at present India is a major trade point for them, so unless they want to ruin their market they won't let US take such stern actions as you are saying. And about living on the mercy of whites, I believe it's you people cause your WHOLE economy is sustaining because those yuk quality manufactured crap of yours is allowed in US market, the moment they close the doors your economy won't even take years to devastate. Whereas about Indian economy it is totally self reliant and is least dependent on exports. Read economics scum bag...
