http://http://zeenews.india.com/news/nation/sikh-group-delivers-us-court-summons-to-sonia-gandhi_875710.html

New York: A Sikh rights group says it has delivered a US federal court's summons to Congress party president Sonia Gandhi, who is in New York for medical treatment, through hospital staff and her security detail.US based Sikhs for Justice (SFJ), which has filed a class action suit against Gandhi for shielding party officials allegedly involved in inciting attacks on Sikhs in November 1984, said the summons were delivered on Monday at Sloan-Kettering cancer centre in New York.

SFJ attorney Gurpatwant S Pannun said Ester Ruiz, night shift nursing supervisor at the Sloan-Kettering was handed a copy of the summons, complaint and Judge Brian M Cogan's order directing her to give the documents to Gandhi.

A copy of the summons was also handed to Alvin Millner, the security manager at the hospital for delivery of the same to Gandhi.Under federal rules, Gandhi gets 21 days to respond to the summons barring which a default judgment will be entered against her, Pannun said.
Earlier Monday, SFJ had obtained an ex parte order from a US federal court for delivery of summons to Gandhi through hospital staff or security personnel assigned to her on the ground that the process servers could not reach her due to her heavy security detail.

According to Pannun, the group in an emergency motion had argued that as Gandhi is a foreigner and a high profile political figure who is the subject of heavy security, the personal service of summons as required by law is impracticable.

The suit under Alien Tort Claims Act (ATCA) and Torture Victim Protection Act (TVPA) accuses Gandhi of shielding and protecting Sajjan Kumar, Jagdish Tytler and other Congress party leaders from being prosecuted for their alleged role in the 1984 violence.

The 27-page complaint against Gandhi alleges that between November 1 and 4, 1984 about 30,000 members of the Sikh community "were intentionally tortured, raped and murdered by groups that were incited, organized, controlled and armed" by the ruling Congress party.

Magic Figures on Agricultural Growth Evaporate on Examination

The last two decades have seen agricultural distress of humungous proportions all across India. And in that context when Pheku and co made a claim that Gujarat was showing record growth rates in agricultural growth – double digit growth – as the Pheku PR machine claimed – then the nation took notice and applauded. Surely, if in an overall environment of agricultural distress he had managed even half of the 10% growth he claimed then it would be worth applauding.

But, as always with Pheku, its all jadu mantar figures.

Here is how he did it. First take a really bad year or two and then build your comparison against those years. It just so happened that Gujarat experienced significant drought (and crop failures) in 1999 and 2000. And then between 2001 and 2005 it got four good monsoons. So simple. Compare 1999-2000 with the next five years and you can claim record growth. Not because the agricultural output of 2001-05 was remarkably different from say 1995 or 1996 but because it was remarkably different from 1999-2000.

The truth is even simpler: between 1988 and 1998 Gujarat’s agricultural output grew at an annual average rate of 10%. In 1999-2000 it dipped by 30%. Further, Pheku’s double digit claims uses one more trick. It calculates growth rates using current prices thus not factoring in inflation (Times of India, Nov 10, 2010). Once you take all the data into account you get a 4% growth rate between 2001 and 2009 as against Pheku’s claim of 9.6% (which he quickly rounded off to 10% so that he could claim double digits!!). At 4%, Gujarat was about 33% below its Eleventh Five Year Plan target on agricultural output. Stellar performance indeed. No wonder I am tempted to call him CM Jhootendrabhai Pheku!

Modi staging 'fake encounter with facts' on economic growth

Fake encounters and terrorism got mixed up with GDP growth Monday as the Congress and BJP traded barbs over how the economy had fared under NDA and UPA.

The spat followed Sunday's criticism by the BJP's prime ministerial candidate, Narendra Modi, that growth had fallen to 4.8 per cent under the UPA from 8.4 per cent under the NDA.

Finance Minister P Chidambaram sought to puncture Modi's claim, pointing out that average annual growth during UPA 1 and 2 has been better than that under the NDA.

"The average for the six year period was 6.0 per cent and the average for the last five years was 5.9 per cent," Chidambaram said in a statement, referring to the NDA's rule from 1998 to 2004. "If there was a golden period of growth, it was the five year period under UPA 1."

He said the average growth rate during UPA 1 was 8.4 per cent and it was 7.3 per cent for the first four years of UPA 2. "I wonder why Shri Narendra Modi should stage a fake encounter with facts," Chidambaram added.

The BJP hit back with former finance minister Yashwant Sinha faulting Chidambaram for invoking average growth rates.

"Chidambaram is doing terrorism with facts. He is only comparing on averages. This is only jugglery of figures," Sinha responded.

"They are comparing nine years average with five years average of NDA. Can Chidambaram explain why the growth rate today is 4.8 per cent?" the BJP leader retorted, adding that when the BJP-led coalition left office, it was 8.6 per cent.

Chandrababu Naidu set to walk in as Narendra Modi's first ally on road to NDA-2 :victory: :yay:

naidu.jpg

NEW DELHI: BJP is likely to enter into a pre-election alliance with Telugu Desam Party, negating claims of a section of its leaders and rivals that the main Opposition would find it difficult to attract allies after naming Gujarat Chief Minister Narendra Modi as its prime ministerial candidate.

Negotiations have almost concluded with the N Chandrababu Naidu-led party and an electoral pact will be announced soon, a BJP leader told ET. Naidu will share the dais with Modi at a function in Delhi on October 2, for the first time since TDP parted ways with BJP-led National Democratic Alliance (NDA) in 2005, added the party leader, who did not wish to be named.

BJP is keen to appoint Naidu as the convenor of NDA, the leader said, adding that Naidu had handled a similar responsibility when his party was a member of the United Front coalition.

Cong Dividing Country, says Naidu Without divulging details of his talks with BJP, Naidu told ET that a regime change was required at the Centre to bring clarity in policies, confidence in the minds of investors and stability in the India story. "Congress is dividing the country on the lines of religion, caste and regions. We need a stable government to put the country and its economy back on the rails," Naidu said in an interview.

Naidu was among those who attended a meeting at Akali Dal MP Naresh Gujral's home in Delhi on Saturday afternoon to discuss ways to strengthen the anti-Congress political platform ahead of the 2014 general elections. BJP leader Arun Jaitley and INLD leader Abhay Chautala were also present at the meeting.

In his interactions with CPI(M)'s Prakash Karat and JD(U)'s Sharad Yadav, too, Naidu drove home his party's point that efforts should be made to consolidate the anti-Congress votes under one banner, rejecting the idea of the Third Front, a person privy to the details said.

BJP has also been holding talks with INLD chief Om Prakash Chautala for a tie-up in Haryana, where the party already has an understanding with Kuldeep Bishnoi's Haryana Janhit Congress. :yay: "We could allot a seat to Bishnoi from our quota of seats. It will not create any hurdle," said a BJP leader involved in the talks. Abhay Chautala has expressed his party's keenness to work with BJP, the leader added.

Modi, who has been spearheading the party's efforts at coalition-building, has also held talks with other potential allies, including Babulal Marandi in Jharkhand, BS Yeddyurappa in Karnataka and AGP's Prafulla Mahanta. :nana: The alliance with Marandi can be worked out if BJP agrees to contest the next election under his leadership, a person familiar with the matter said. But this will involve shifting former chief minister Arjun Munda, considered a favourite of BJP president Rajnath Singh, out of Jharkhand.

The Gujarat CM is expected to cement his position in the party if TDP comes on board. His in-house rivals as much as those in other parties had labelled him as politically untouchable after Bihar Chief Minister Nitish Kumar's JD(U) severed its 17-year-old ties with BJP in opposition to Modi's elevation.
