the maid is on an Indian company/ government payroll but her salary must meet minimum salaries and labor laws when in the US! It is a law followed by all. They lived on US property not in the consulate building!

what arrest is not humiliating? if you don't want to be humiliated then don't commit a crime. The only part where this could have been handled better was discretion of not being strip searched i.e. not asked to change into jail clothing. This is no body cavity search btw, you strip to bra and panties, wear jail clothes in the presence of a female officer.


Let me tell you - had it been me an american arrested- what would have happened.

1. handcuffed on the spot
2. throw in the back of car and taken to jail
3. Booked , finger printed, photographed
4. given one call from pay phone to make " collect call only"
5. strip searched and thrown in jail till I made bail or saw a judge

what did she get?
1. Not handcuffed at point of arrest
2. allowed to sit in the car for 2 hrs making calls from her cellphone, with her cellphone
3. Booked , finger printed, photographed
4. Change into Jail clothing " known as strip search" and put in a cell

Again the only thing, given the low bar of her crime that we should have done is avoided the " changing into Jail clothing part". That is all that I would say could have been done because even americans can get that discretion, but depends on the booking officers in the jail.

Our laws are superior is many ways and citizens have way more rights than Indians do. and they are not to the level of absurd discrimination that indian laws still have. You even have laws about hindu and muslim marriages... how archaic is that? anyways...

Want to arrest americans on anti gay laws - do it. go to their bedrooms and watch them in the act -because just putting arms around each other is not evidence. if it were you would have straight indian males being put behind bars.

I agree Indian diplomat committed a crime .I also pointed it in my early post.But you dont even try to read that.Even if she committed a crime ,before arrest you must notify your own state dept about that.She is not a tourists or refugees or NRI.US already know about salaries given to the Indian employees in Indian embassy and they know it early that It is less than US standard .But they deliberatily take this case insult that diplomat ,that what i am talking about.

There is a video on Youtube of her being stripped naked and lying on the floor and her cavity is being searched. Most of it is blurred but you can make out that she is forced to comply. Why are the men police officers doing all the strip search?? It is demeaning to say the least. You will change your stance how she was treated.

Who would in the good senses within US Marshals office release an arrest video even if one exists when they have officially claimed through their spokesperson that there was no cavity search but only a strip search handled by a female official opening themselves up for a law suit? And if the intention is to expose, then don't you think they would have left the face unblurred?

The lawyer said Ms Khobagrade's base salary figure of USD 4,500 per month was required and appropriately reported on the DS-160 form, which is the online non-immigrant visa application required to be submitted by those seeking US visas.

It was submitted so that US Embassy officials in New Delhi could determine that Ms Khobragade would be earning enough money to afford to pay Ms Richard the USD 1,560 per month (9.75$/hour for 40 hours a week) which had been agreed to according to the contract between two.


"Somebody who messes up on the paperwork and causes a terrible thing to occur is very, very serious," Mr Arshack said.

Meanwhile, UN spokeswoman Morana Song confirmed Ms Khobragade's accreditation to the United Nations headquarters in New York, saying, "The United Nations has received notification to register Ms Khobragade as a member of the Permanent Mission of India to the United Nations."

"We can confirm that the United Nations has processed this request as per its standard procedures," she said.

Ms Khobragade was arrested on December 12 on charges of making false declarations in a visa application for her housekeeper. She was released on a USD 250,000 bond after being charged with visa fraud. Subsequent revelations that she was strip-searched and held with criminals triggered a row between New Delhi and Washington.

People who had filled up DS-160 would know(I had filled 3 forms on behalf of my relatives myself) there is only one entry to be made regarding salary details in the form and that is the employee's salary(in case he is a tourist, he need to enter zero) and not employer's salary. From day one, Devyani's father was hung up on DS-160 and blamed the maid for filling up the form and now her attorney is pointing to misinterpretation by the investigating agent. Only adds to the murkiness though additional documents would have been filed including Devyani's sponsor letter indicating the salary etc(as I have done it myself).

What Devyani Khobragade a practitioner of slavery and her lawyer said became big item of indian propaganda now. When in Sep US informed indian govt about the violation india did not find anything wrong with visa fraud and slave trade. Fact is Devyani Khobragade has no excuse to pay less than $4 ($3.31/hr to be exact) when minimum wage is $9.75. That requires salary to be little over $1500/month for 40 hrs/week work. US law required minimum that much to be paid. "$4500" story lawyer and indian media concocted is purely for public consumption and will not fly in court.

Besides, this is not first indian diplomat caught red handed with slave practice. Indians should come out of habit of blaming others for their uncivilized and barbaric actions.
