You are missing the point here. The Indian diplomat seems to have committed a crime according to US law. But the problem here is that the same diplomat who was not running anywhere for 6 months was arrested without even informing Indian embassy. Even if she does not have immunity, as an Indian diplomat, she deserves a court hearing without a humiliating arrest.
That is not how countries treat envoys. The Vienna Convention is a bare minimum set of privileges. In reality, countries especially friendly countries treat each others' diplomats with respect and even more privileges. Her arrest(or rather the manner of arrest) was therefore a humiliation for India.
If you want to gloat that Dominic Strauss Kahn was treated similarly, he did not represent any country. You will hear a boat load of instances where US claimed immunity and privileges for their consuls and even spies.
As someone pointed out, the Indian anti-gay law will similarly apply to all American diplomats(minus the ambassadors) in India. So if you want to stand on that pedestal, calling your laws somehow superior to everyone else(case in point: how does US give visa to a person with charges pending against him?), you are welcome.
But US diplomats everywhere should expect the same treatment. First they will be arrested and then they will listen to the charges(this is how Indian law operates for commoners). They will have no privacy in India(no privacy laws in India) and their sexuality will be restricted by the law(unfortunately by law in India). So be prepared for the consequences.
I've not missed a single point.
what arrest is not humiliating? if you don't want to be humiliated then don't commit a crime. T
he only part where this could have been handled better was discretion of not being strip searched i.e. not asked to change into jail clothing. This is no body cavity search btw, you strip to bra and panties, wear jail clothes in the presence of a female officer.
Let me tell you - had it been me an american arrested- what would have happened.
1. handcuffed on the spot
2. throw in the back of car and taken to jail
3. Booked , finger printed, photographed
4. given one call from pay phone to make " collect call only"
5. strip searched and thrown in jail till I made bail or saw a judge
what did she get?
1. Not handcuffed at point of arrest
2. allowed to sit in the car for 2 hrs making calls from her cellphone, with her cellphone
3. Booked , finger printed, photographed
4. Change into Jail clothing " known as strip search" and put in a cell
Again the only thing, given the low bar of her crime that we should have done is avoided the " changing into Jail clothing part". That is all that I would say could have been done because even americans can get that discretion, but depends on the booking officers in the jail.
Our laws are superior is many ways and citizens have way more rights than Indians do. and they are not to the level of absurd discrimination that indian laws still have. You even have laws about hindu and muslim marriages... how archaic is that? anyways...
Want to arrest americans on anti gay laws - do it. go to their bedrooms and watch them in the act -because just putting arms around each other is not evidence. if it were you would have straight indian males being put behind bars.
US diplomats depending on the level of immunity should be expected the same. US even put a saudi princess in jail recently for same crap....
Saudi princess, Meshael Alayban, accused of human trafficking 'slave maid' is cleared of all charges | Mail Online
what this guy sreekumar is saying is pure asinine ! his argument is no crime is committed.
I do have to wonder how come the dignity of the maid is not a question with you guys? All the BS I keep hearing about her( maid) is coming from the diplomats side of the aisle.
The diplomat may well be proved to be innocent, but the hooting and hollering by most of you guys seem to be about the diplomat's treatment. is the maid not a human too?
and what is worse is it seems this woman diplomat is all out crook... she is involved in that apartment scandal in india too.
