It seems they meant that we haven't inducted a newer generation fighter since 1985. M2K, MKI and Tejas Mk1 are below 4th gen to IAF. So we're yet to induct a 4th gen fighter according to them.

This makes sense since the biggest turn on for IAF at the moment is an AESA radar. This will be one of the main factors that'll define 4th gen, as long as it's not inside an ancient airframe à la Jaguar. Therefore, Rafale, Tejas Mk1A/Mk2 and SuperMKI will be 4/4+ gen.

Both evaluating and enforcement are the duties of the Court. Moreover CAG also is not above the Supreme Court hence it would also come under scrutiny, unfortunately this is how the system is designed.

The three main pillars of a state as enshrined in the Indian Constitution have to work in such a way that sometimes it seems to be contradict each other. This is the beauty the system has so that no institution can go beyond its prescribed domain. The Supreme Court is the final decision maker hence considered superior. Though this is NOT CORRECT.

Russian vintage junks can not be on same as American ones like USA made F-22 30 years ago and until now no fighter even j-20 nearly meets its standards.
These upgrades are thier life extensions for few years (2-5 years) so you can passes some of your time.

No wonder Pakistan is using the vintage Russian engines on the JF-17.
Last I heard, PAF was finding it absolutely difficult to keep F-16s flying in the air because of the unavailability of spares; while IAF's MiG-29s are getting upgraded to MiG-29UPGs
