IHC lashes out at Army's role 'as mediator' in government's agreement with protesters

The Islamabad High Court on Monday lashed out at the government as well as the Army for the role assigned to the military "as the mediator" in the agreement to end the sit-in at Islamabad's Faizabad Interchange.

The Army chief instead of following the orders of the chief executive became a mediator, pointed out Justice Shaukat Aziz Siddiqui.

Security forces had launched an operation against protesters camped out at the Faizabad Interchange on Saturday after the high court had ordered the clearance of the bridge that connects the federal capital with Rawalpindi. The same day, Chief of Army Staff Gen Qamar Javed Bajwa had advised Prime Minister Shahid Khaqan Abbasi to "handle the Islamabad dharna peacefully".

The day-long operation had culminated with the government seeking the military's assistance to disperse the participants who had put up fierce resistance to the security personnel's action.

However, the Army had said in its response to the government's call for assistance that while it was "fully ready" to take action, a "few points need deliberation". Subsequently, no troops were deployed in the city.

"Where is their Radd-ul-Fasaad now? Did they not see any Fasaad (anarchy) in this protest?" Justice Siddiqui asked as a hearing into the Faizabad protest was underway at the high court on Monday. The judge was referring to a military operation that was launched in February.

The judge remarked that this was proof of the 'military's involvement'.

"Who is the Army to adopt a mediator's role?" inquired the judge. "Where does the law assign this role to a major general?"

Soldiers who are inclined towards politics should turn in their weapons, Justice Siddiqui said, asking if the protests would have continued as they did if the Army's headquarters had been located near the Faizabad Interchange.

This whole thing was mishandled by the government to begin with and than they want the army to take the blame specially if anyone dies due to operation. Army did the right thing not to intervene. Justice Siddiqui is smoking some good stuff, he needs to lay off for a while. Its clouding his judgement.

With due respect (IMO) Army didn't created this mess nor involve. Govt failed to counter this situation and crisis by creating problem itself (amend the law when there was no need of that) and later backfire. Protestors demand for LM resignation. Many days chit chat going on btw protestors and Govt officials. All the talks were failed and govt mishandled the situation by using force. Later when the situation was out of control, govt requested mil to become mediator in this. Criticism on GHQ and Army is right here ? I mean they have nothing to do with this. But this is good, next time Army will never become part of any such thing.

PS: IMO, If PM/Govt call Army chief for discussion in case of crisis then this is completely fair and nothing wrong in that. PA is Army of Pakistan not India and Govt has power to discuss anything especially to tackle situation / Solution by discussing with the mil.

Army did not create the mess; possibly.

Government compounded the problem for itself when it allowed the dharna to start and then to expand. But once the Government ordered the Army to take control of security situation in Islamabad, the Army had to legal right to deny or delay obeying the directives. Whatever the Justice has said is factual, he has not said a single thing out of context. And please note that the Army was not called in a 'mediator', the Army was called in under Article 6 to aid the civil Government in bringing the situation under control by establishing the writ of the Government. The Army's response on the matter was advise for the PM to resolve the matter peacefully.

The next time there is a dharna for resignation of the Army Chief or CM or PM or Chief Justice what will be the course of action? I mean we have set a precedent here.......

Because of insubordination of the Army Chief, the political government had to surrender the writ of the state to those who had hijacked the capital of our country!

What a bloody shame!!!

The army in India cannot deny the government request according to our constitution. One simple question to Pakistani friends: Does the Pakistani constitution allow the Pakistani army to deny request of Pakistani government? If yes please enlighten me about the Pakistani constitution, if no then Is Pakistani army above Pakistani constitution?
 
No he's not, the problem would have been solved exactly the same way as it did now if army would have just came out on the call of govt, no one would have fought against the army.

The sitting government has no authority to go against the law and try to change the Pakistani constitution, the responsibility of the Army was to solve the problem and diffuse the situation which the sitting government created by breaking the constitutional law in the first place and they did, if the Pakistan Army is not above the Pakistani constitution then so is the sitting government.

If you think the Muslims of Pakistan would have sat in silence when one of their very basic tenets of faith (The finality of the Prophethood of Prophet Muhammad p-b-u-h) was challenged than you are living in the dream world, this could have gone a-lot bloodier than it did, the Army did the right thing by diffusing the situation.

Tell me something why were the dharna guys allowed to come all the way to Islamabad and stage a protest? Why were they not stopped in their barracks?
Than the demand of these protesters from day one was the resignation of Law minister. Today the government accepted the same demand they could have accepted 20 days earlier and if this was not the case than why is it accepted now? The government allowed the country to be held hostage and latter when it all spiral out of control, they wanted the army to step in so that if something happens or anybody gets killed, all blame will be put on army which is unfair and only highlights the malicious intent of this government.
 
Gov surrendered because army chose not to establish writ of the state.
Earlier when police started action on the orders of the government, the government later refused to take responsibility for the police action hence army wanted clarification and clear orders from government but seems government already ducked. Anyway Nawas Sharif should not have tempered the law in the first place and when he did he should have handled the situation before it went worsts. He was playing with fire and it backfired badly. At the end whatever happened and the government bogged down and all is a BAD omen for the country and masses in the long run.
