Khosa Sahab just made the SC questionable in eye of common man.

its a misconception that SC has taken the suo moto Cheif Justice himself in yesterday hearing clarify that its not a Suo Moto but the hearing of petition ..... and even enquire to the petitioner about his absence in first hearing ....

SC just making another confusion now and face saving to be honest. All media and all knows that Khosa sahab took suomoto. There is no doubt about it. Petitioner wants to withdraw the petition.

If anyone wants to keep saving the court sure go ahead but truth has come in front of public in shape of LHC verdict and then IK request SC then in return Khosa sahab defend these High courts and in doing so showing off by moving his shoulder making fun of Musharraf and then this.

So I think this whole episode was a parting shot from Mr. Khosa, who it appears to be a rather vindictive man.

That may well be the case. This is what I wrote in another thread:

The public debate at this time should not be about whether Gen Bajwa should get an extension of his tenure or not. It should be about how the Supreme Court is handling the matter. The manner in which it is being done makes the motives of the judges very suspicious.

The procedural issues could have, and should have been handled without all the spectacle. As for the government's reason for extending the COAS's tenure, it is the government's prerogative. The SC is not the competent authority to assess the country's security.

The legal system is based upon both statutory law and case law (precedent). Clearly, we have precedents, and in the past, the SC did not question the government's prerogative as the competent authority to make such a decision.

Even if we were to accept the SC's argument at face value, the fact that this is a last minute, last ditch, suo moto action by the SC, just before the retirement of Mr. Khosa, does nothing to dispel the impression that this is either a vindictive move, or part of a larger conspiracy.

Mr. Khosa has destroyed his legacy, and thrown the country into a wholly needless and preventable crisis. It's a shame, really.

The answer of the question is not written anywhere. It all based on tradition. Same traditions followed in British army and it not even written in British constitution.

the incompetence of PTI government is very evident ... they are master in making issues out of nothing, about this issue already they were aware yet they did not took any actions, infect out of 25 signatories they took signature of just 11 and that is what Chief justice has pointed out... on top of it this summary of extension is moving in government offices since August ... it went to four Departmental Secretaries what is their role ? if they cannot even point this one single mistake timely ??? then what is their use???? who selected them ?? and what is their role ??? it shows how incompitant our civil service ....

The dumb fellow Khosa is trying to look special by being anti army and anti government. He doesn't want to go down in history as some one who was in the same room as the government and Army.
What a dumb and cheap way of trying to feel special instead of letting your record speak for itself.

There is no doubt about it. Petitioner wants to withdraw the petition.

Petitioner of this case is himself an Advocate .... I need not remind one can withdraw a petition by filing a simple application of case withdrawal as far as I know no application was submitted to withdraw the petition ..... was any application to withdraw the petition submitted in the Supreme Court

Now plz don't assume that this simple thing was not in the knowledge of that Advocate who is an Habitual Petitioner in Supreme Court for all sort of trivial matter, and on the first day he just gave verbal statement to media in this regard but the second day gave a different statement to the media and now when issue is almost settle he has given this statement

Its not about saving the court .... its about to identify the reasons and those characters who created this fiasco and to those who want to use it as opportunity to create a situation of clash between Judiciary and Executive .....

hearing of petition .... which was decided to be heard by SC on next day of submission but the petitioner went missing without informing the court about his intentions officially, so court was bound to listen the case on the first hearing ....

Now the issue is many people in media are making comments on the basis of their emotions not on the basis of legal consideration .....

I believe British do not have a codified / written constitution.

It is a lapse in the Pakistan constitution and should be addressed.
