Devyani Khobragade case: India sets up special group

Khobragade brought her to this country with the intent of underpaying her and controlling her employment. That's the definition of human trafficking.

Doesn't matter under either U.S. law or the U.N.'s guidelines.

Because he acted on behalf of his country and not for his own benefit the U.S. official has immunity. Since Khobragade acted for her own benefit rather than that of her country she does not. Both cases are covered in the same Article of the Consular Convention - which, by now, you should have bookmarked, so I'm not going to bother to link to it for the umpteenth time.

Kindly dont twist ur statements according to ur wishes. Devyani and Sangeetha had signed a separate contract of agreeing to "underpayment" . Sangeetha can never claim she was cheated of "original" pay. US govt can tell Devyani cheated on the basis of visa records, but Sangeetha cannot, as she know what salary she got beforehand.
Secondly for working hours, its for Sangeetha to prove in court.
Behalf of US? Was there any order from US, asking him to evacuate them, and book tickets for them tax free? In such a case US can really face backlash.
Indo-US ties are going to take a hit for sure
 
As a matter of fact Human Trafficking is a big deal but not big enough. We have enough 'big deal' issues to deal with, without adding human trafficking to that list.

However this particular case (in US court) is about "lying to get a visa". LOL.

You know why ? because the US govt. just cannot charge the Indian diplomat with human trafficking :lol: ...... that just remains your wishful thinking and means to get your next orgasm.

There is nothing to worry about defending the diplomat in court. She will walk free. Of that I have NO DOUBT. So as such there is nothing to discuss.

She indeed will walk free. But not after go to the trial first. If she is found not guilty, she "will" walk free. If she is found guilty, she will serve her terms and then "will" walk free. So I agree with the basic premise that she "will" walk free.

I'm not, that is where this case is headed now, to the court.

Let it go to the court. The last time I checked the US court asked an Indian diplomat to pay 1.5 million $ to his maid :lol:

They are still waiting for that money to reach them. LOL.

India should just wait and watch every steps the American embassy/consular staff takes. Some times/Somewhere they are bound to break the law, however silly it may sound!!(As I said Law is an ***). Then only we can bargain. Presently Devyani is in US and as "Dog becomes Lion in its own territory", we can only rely on immunity and their court!!

Couple of points.

The US embassy/consular and their families would already be in a constant state of worry. Not much of a 'happy Christmas' for them. :P You can bet they would be sending out SOS to every possible US dept. that matters.

We really do not have to rely on their courts. Worst case would be we arrest their diplomat/consular member and we exchange prisoners.

You can imagine where the Indo-US relationship would head if Modi becomes PM. :P

The fact that the US is already liable for breaking a few of their own laws and international treaties will also work in our favor.
 
you really believe that US will give a prison sentence to her.any judgement harsher then monetary compensation will pretty much turn Indo-Us relationship to a retaliatory punishment game

light up. It would be a quick trial and if she has good representation, she will walk free without any time. I wonder if she has a jury trial or not. I would want to be on the jury for this one. :)

Let us contrast this case with the case of Raymond Davis in Pakistan. He was an ordinary employee of the American Embassy in Pakistan. He fired several bullets through the windscreen of his car and the bullets hit a motorcycle rider in the back. There was another related killing by an American consulate car that overran a Pakistani on the way when trying to rush the criminal back to embassy without any regard for traffic laws.

Hillary Clinton backed by the American president immediately set herself to do wahtever she could to find diplomatic immunity for the criminal. Foreign minister of Pakistan, a very seasoned and respected politician in Pakistan, took a principled stand and refused to grant automatic diplomatic immunity to the guy and said that law must take its course and diplomatic immunity can only be decided by the court if the law validates it. Unfortunately for the foreign minister, he was sacked by the corrupt and puppet PM when strings started to get pulled. Raymond Davis was freed, sent to US and things became rosy again.

Now Americans say law must be allowed to take its course. So the laws must be used when it suits Americans and never when it hurts them. Third world countries beware of American version and notion of justice.
 
One minor traffic mishap or something is required from a US consular member or his family member now and then it's time to :partay::partay:
