No, its more a moral and administrative specific.
In India, the common practice is (I think the whole south asia too incl. Pakistan)
Commit a crime, immediate arrest, few weeks of police custody, then bail.
The case will be fought in court for years, so the guy is free till that time. And once the verdict comes, he might get free or punished. If punished, will go to jail and again court battles for years. And at last, the higest court rules he is guilty (by that time, he might served half or full of his sentence.
The problem is there is a concept in the society that, you commit a crime, there is a higher chance to get out of it. It will take years to find the guilty. And the maximum sentence is life imprisonment, which 14 years.
Now there is a trend in Indian Court verdicts that they impose to serve the terms differently.( like life imprisonment for murder 14yrs + destruction of evidence 3 years over and above), no parole for 20 years & life impresonment with specifie terms (life impresonment means minimum of 35 years without parole)...we need such changes in the judiciary system, we still follow the old British system...
