Beleaguered blasphemy victim suffers more bail delay

Mukhtar Masih a deprived Christian man of 70 from a small rural village named Lumbanwalai near the city of Gujaranwala, was arrested for blasphemy on 28th January 2017, after it was alleged quite bizarrely that a derogatory letter about Islam signed with him name had been pinned to a local mosque.

Mukhtar Masih's writing does not match the writing on the offending letter and he is obviously innocent, however he remains incarcerated while he awaits his blasphemy trial.

Attempts were made by the family's persecutors to add the offence of insulting Muhammed, which under section 295C of the Pakistan Penal Code would have carried a death sentence and is unbailable. However in Gujaranwala Court on 7th March 2017 after a successful defence by BPCA funded advocate Abdul Hameed Rana the case was dismissed by Additional Sessions Court Judge Khizer Hayat Gondal.

Advocate Abdul Hameed Rana, said: "I explained to the judge that the court has no authority to impose any additional offence or to apply any further section of the law.

"There is no private complainant in the case as the police are the main complainant; no private individual can now add further offences.

"The judge agreed with me and set aside the complaint."

Several bail hearings have been missed due to failure of police to submit evidence to the court on time or judges being absent a common malaise in Pakistan's court process. Instead of dismissing the charges the courts have extended times required for the police to submit evidence and a hearing date is now fixed for 14th March.

Wilson Chowdhry, Chairman of the British Pakistani Christian Association, said: "Mukhtar Masih like every Christian blasphemy law victim before him is innocent.

His trial under blasphemy charges is a common manifestation of the hatred by a highly intolerant Muslim population in Pakistan against Christians.

"The unjust and discriminatory blasphemy laws of Pakistan are a tool to settle personal vendettas, steal property and to oppress Christians and other minorities.

"The continued stance by the Government of Pakistan to uphold such bias laws should make the nation an international pariah, but instead they are toasted as a great example of democracy in the Islamic world and are a recipient of foreign aid from nearly every Western nation.

"I pray that one day the leaders open their eyes and realize the future they plot for Pakistan only serves to breed anarchy and that one day they espouse a more egalitarian and stable trajectory."

In the meanwhile ailing 70 year old Mukhtar Masih continues to be imprisoned in isolation within a dingy cell with no access to daylight. He and his family pray for his deliverance from this latest persecution and have asked us to seek more global prayers for Mukhtar's release. So please do remember this family in your prayers. -

No one gets happy if innocent get punishment it seems like he maybe didn't do it but the case is in the court. We have to wait and see.
The real culprits are on the run let's see who will get the behansa police public or judge.

blasphemy alligations were on late Junaid Jamshed but no one lodge FIR against him he left the country bring some excuses when incident get dead he come back and rest you know. Ab ye Masiah neither court nor awam gives a damn he or his family suffering.
Rimsha masih despitebeing innocent had to leave Pakistan because of threats but so called ashiqs think its not a big deal at all

Quick investigation should be done and justice should be served.

Our police system needs major reform. Parties like PPP and PML(N) have utterly destroyed our institutions and everybody is suffering because of that
 

I (nobody) wouldn't need any certificate of my Ishq (love) with our Prophet (S.A.W.W.) and the same Ishq (love) says that no injustice at all so I wish that innocent must be freed so also, the culprit whosoever blames him with fake charges be punished as an example in due course of Law. Furthermore, in all this procedure, the most delay comes from Police end that actually is under political influence and sometimes Blasphemy charges are made on personal grounds and grudge as well. Also, we witness that this line of charge is mostly used in rural areas that are remote to city and mostly people uses local system of justice as well as blame opponents in enmity and revenge against other issues/disputes. I must say, the Law is not that infected but authorities (read Police here) are not much competent and mostly remains under influence of political elite that sometimes mislead institute or delay the process per handler's instruction. The system of investigation needs reforms and change for betterment.
 
This is my exact argument and I got people messaging and asking me not to discuss blasphemy as its a sensitive subject. But it has to be done because this is ruining the image of Faith and Country. Admit it, it's misused!
 
I Don't Understand That Why These So Called NGOs Saviour Of Christians Always Criticise The Law While They Never Said Anything Such Refarding Other Criminal Laws Where Fake Case Are Registered Under All Laws But Its The Job Of Our Prosecution And Legal System And Police To Provide Justice, There Is Not Single Person Who Has Been Punished Under Blasphemy But In implementation Of Law Created A Qadri Which Sacrificed His Life.
So The Problem Is Not Law But How It Implements And When It Implements.

Which sane person would do this? Please, some enlightened ulama e haq tell me which person in their right minds would do this in 98% Muslim country, where the radicals already rule the roost and even a whiff of blasphemy would be enough to kill you?

This law is doing more harm than good and has no bases in islam we need to get rid of it altogether.

I am not the Lawman and people who defined the Law, knows well (Constitution, Assembly, Parliament and Shura Council). However, if the Law is being implemented in wrong manners doesn't prove that the Law is wrong so we need proper implementation and reform of system for execution. I hope we remember the word of Justice SC (I think if I am not wrong) that if such charge is not proved, the one who made fake claim would have to face the consequences. So the Law is well balanced and all we need to implement it properly.
