New Delhi: The Batla House encounter has returned to haunt Delhi Police once again. The postmortem reports of the two suspected militants killed in the encounter have raised many questions. The reports were obtained by a Jamia Millia Islamia final year student, Afroz Alam Sahil (22), with RTI from National Human Rights Commission (NHRC). Another report prepared by forensic and medical experts — part of the postmortem reports — has not been made public.

The four-page autopsy reports of the Indian Mujahideen suspects Atif Amin and Mohammad Sajid reveal that they had suffered injuries by a blunt object apart from gunshot wounds.

Eight out of 10 bullet entry wounds on the body of Atif are on the back side, in the region below the shoulders and at the back of the chest, which point to the fact that he was repeatedly shot from behind.

Sajid’s post-mortem report says there were two wounds on his body which were not caused by a firearm. These injuries were antemortem in nature i.e caused before his death. The first nonfirearm injury is a 4-by-2 cm abrasion over the midline on Sajid’s back while the latter is a muscledeep laceration wound of 3.5 by 2 cm on the right leg. ‘‘In which genuine crossfire do people receive injuries only in the back and head region,’’ asked a member of the Jamia Solidarity Teacher’s Association (JSTA).

Forensic experts at AIIMS, who didn’t wish to be identified, said these injuries which are explained in the postmortem report could have been caused by Sajid falling down on an object or hitting a wall after being shot. If the bullet hits any vital organ, there is excessive loss of blood and inadequate supply of blood which causes haemorrhage,’’ said the expert. The range from which the two were shot is also critical but the report does not clarify that.

Another point which drills a hole in the police version is that Sajid was shot three times in the head with the bullets travelling downwards. To which the officials of Delhi Police said Sajid fell down after being hit by a bullet, and during the crossfire, he took the bullets in his head.

One of the bullets which hit Sajid exited from the back of his chest, another came out close to his jaw and the third came out from the rear side of his right shoulder. He also suffered another bullet injury in his head because of a shot from behind, claimed the report.
The report also confirms that Sajid has another bullet entry wound on his right shoulder, which went vertically down and lodged in his chest.

‘‘These bullet injuries strongly suggest that he was held down by force while bullets were pumped into his forehead, back and head,’’ claimed Manisha Sethi, a member of JSTA.

The post-mortem report of Atif reveals that he took 10 bullets in his chest, abdomen, thighs, shoulder, neck and lower back.
He is also shown to have a nonfirearm injury (No.7) which is an abrasion on his right knee.

Twenty-two-year-old Sahil, who got the report nearly 18 months after the encounter, said he approached NHRC several times and it was in October last year that he filed an RTI application with NHRC for the sixth time. It took him nearly six months to get the copy of the postmortem. The autopsies of Atif and Sajid were done three days after the encounter by a panel of three AIIMS doctors of forensic medicine.

Senior counsel Prashant Bhushan, speaking to TOI, said, ‘‘The autopsy report destroys the police theory of a genuine encounter. Moreover, there were burn marks on their bodies which explains that they were shot from a close range. We will once again demand a judicial probe into the encounter.’’

He added that the injuries in their head clearly suggest that they were made to sit and were then shot. Blunt injuries mentioned in the autopsy could not have been caused in a shootout.

Delhi Police spokesperson Rajan Bhagat refused to comment on the report and said, ‘‘The investigations into the case are still going on and we do not want to comment on the report.’’

Batla House encounter victims Atif Ameen and Mohd Sajid were hit by ‘blunt force impact by object or surface’, besides multiple gunshot wounds. The post-mortem report, a copy of which is with TwoCircles.net, has confirmed this. The family members and relatives of the two terror suspects of Azamgarh, who gave them last bath, had claimed the bodies had multiple injuries of brutal beating. The million dollar question: why the police had to resort to beating of the suspects during a ‘genuine’ encounter.

Whether Atif Ameen and Mohd Sajid were involved in terror activities only the court can decide. But genuineness of the September 2008 Batla House encounter in which the two Azamgarh youths were killed has been contested since the day one on various counts. The injury marks other than the gunshot wounds on their bodies were presented by the families and several independent fact finding teams and human rights activists as strong proof that the encounter was fake and the duo were killed pointblank.

This is the first time since the encounter that the post-mortem report has come into public, thanks to tireless efforts of RTI activist Afroz Alam Sahil, a Jamia Millia Islamia student. To get this post-mortem report he knocked at every suitable door – Delhi police, AIIMS, Central Information Commission and National Human Rights Commission, but was shunted out on one ground or the other. Ultimately today he received the report from NHRC.

The four-page post-mortem report of Atif Amen says the cause of death was “shock and haemorrhage as a result of multiple injuries as described. All the injuries are produced by firearm ammunition except injury no 7 which is produced by blunt force impact by object or surface.”

In total the 24-year-old had 21 injuries on his body and all the injuries were “antemortem in nature,” says the report. Of 21, the number of gunshot wounds was 16.

Describing the injury no 7, the report says it was “reddish brown abrasion of 1.5x1 cm over outer and interior aspect of right knee cap.”

Similarly, Mohd Sajid, who had five bullet holes on the upper side of the head, was also beaten with blunt object.

His four-page post-mortem report mentions the cause of death was “craniocerebral damage as a result of gunshot injuries to head.”

Sajid had 14 injuries on his body. “Injury no. 1-12 are produced by firearm ammunition while injury no 13 and 14 are produced by blunt force impact on surface or by object,” confirms the report adding all the injuries were antemortem in nature.

Describing injury no. 13 the report says it was “4x2 cm abrasion, red in colour over back of chest in midline” and injury no. 14 was “laceration of size 3.5x2cm horizontally over front of right leg in the middle.”

Of 14, he had 11 gunshot wounds.

The two-page report of Inspector Mohan Chand Sharma who sustained bullet injuries during the shootout mentions the cause of death as “haemorrhagic shock due to firearm injury to abdomen.”

While mentioning antemortem injuries on Inspector Sharma, the report prominently says the entry wound on left shoulder and left upper arm was explored and debrided. Similarly, the exit wound on left arm and 10 cm below left shoulder top and 8 cm above left elbow joint was also explored and debrided. The post mortem report also says that it is alleged the deceased sustained injuries during cross firing in a police encounter in Jamia Nagar on 19/09/2008, he was taken to Holy Family hospital where he died the same day at 7 pm.

You are right that this section is wrong one. It should have been in the proper section. But then 'WORLD AFFAIRS' section do not look the right place for it and I could not figure out the MORE APPROPRIATE ONE for it.

i am sad for this terrorist..as he were caught in saudi.....his head wud be rolling minutes after he shooted people.......but indian people will keep this terrorist send him to court for trials for several years until there is no hair left on the head of this terrorrist.....perhaps a stage will come when this caputered terrorist mind will become cow's dung.......and than indian will hang this person quietly and put to earth may be his body will be given to medical research.....

There is nothing in this report that disproves the police story. The doubts are being created on details that can be explained either way. Not conclusive to prove the police story wrong, those blunt injuries and those headshots are possible in a fierce encounter that killed a very senior police officer too.

Unless the theory is that the police officer was also killed by the police - then this becomes a conspiracy theory and then people can chose to believe what they want as its useless convincing conspiracy theory believers otherwise and vice versa.

Here is an Analysis of post-mortem reports

1) Atif Ameen sustained injuries on right knee cap (injury number 7); grazing effects in the interscapular region or back region in layperson’s terms (injury number 11), multiple abrasions on right buttock (injury number 21). See attached photo of Atif’s back and leg which clearly illustrate these injuries.

It is further explicitly stated that injury number 7 was "produced by blunt force impact by object or surface.”

11 1x0.5 cm Inter scapular region, 4cm right to midline

12 2x1.5 cm Right side back, 15 cm from midline, 29 cm below tip of the right shoulder

16 1 cm diameter Outer and back aspect of right forearm

· Almost (8 out of 10) all the entry wounds on the body of Atif Ameen are on the back side, in the region below the shoulders and at the back of the chest, which point to the fact that he was repeatedly shot from behind.

· Another one (no.6 on the table) is on the inner side of the left thigh but suspiciously, the trajectory of the shot is in the upward direction, thus suggesting that in this case the shot was fired from below. What caused the unusually large wound of 5 x 2.2 cm? Why were metallic objects present in the left thigh?

2) 17-year-old Md Sajid also displayed at least two injuries (numbers 13 and 14, interscapular region and right leg), which had been caused by blunt force impact by object or surface.” The gunshot injuries received by Sajid are as follows:

Gunshot Wound no. 1 Right frontal region of the scalp (forehead)

Gunshot Wound no. 2Right forehead

Gunshot Wound no. 5 Tip of right shoulder (going vertically downwards)

Gunshot Wound no. 8Back of left side chest (12 cm from root of neck)

Gunshot Wound no. 10Left side of occiput (in layperson’s term, back portion of the head)

The entry points of each of these gunshot wounds—and the fact that all but one bullet is travelling in a downward direction—strongly suggests that he was held down by force (which also explain the injuries on the back and leg region), while bullets were pumped down his forehead, back and head. Isn't the opposite true too? In a fake encounter injuries would only be in the right places... not to mention no senior police officer would die...

Also, an encounter is not a duel style affair, where one gets shot would depend on a trillion things. Hence one getting shot in head and back is only less likely, but not at all conclusive.

As to the other injuries, those are also possible in an encounter... (note - blunt force impact by object or surface)

See my point is those observations are only creating doubt by interpreting in a certain way, but thats not sifficient grounds to reject the police claim. No doubt this will convince the already convinced, but not others.

So how you explain the death of M.C.Sharma? He died due to??

And what do mean that because its top-to-bottom it has to be fake? If they are firing while lying on the floor they will get the top-to-bottom wounds? What so big deal? And why of all the place the will stage the encounter in the Jamia Nagar? They could have done it any where?

All bullet injuries were of VERY CLOSE range. Bullets were fired atmost from few centimeters. The nature of bullet holes put a BIG HOLE in official STORY.

M. C. Sharma was a victim of friendly fire, most probably. The delay in providing him the medical assistance is of great concern as well. HOLY FAMILY hospital is at most 2-3 minutes drive away from the ENCOUNTER SPOT. Why it took considerable time in taking Mr. Sharma to hospital is still debated. Moreover his bullet wound was on the stomach and he died by excessive bleeding, which indicates a delay in providing medical help to him.

Can you help point out where the report says the shots are point blank shots.

Friendly Fire?? He was shot from front. If this was fake encounter than do you mean that those killed were encircled by the police and fired upon? Means those killed were between 2 firing party? You are not making any sense on this?

If MC had recvd wound on his backside, I could have understood friendly fire but not in this case.

ANd you said probably? So what are the other scenarios? those killed were actually terrorist? Who fired at the police and MC got killed?

Regarding bullets fired from few CM, I have not found anything relating to article you have posted. If you are firring from so close distance
1) There will be burned skin
2) There will be deposit of gunpowder near the wound.

None of these are mentioned in the autopsy.
Also, they getting wounds in there back means they were lying on the floor and shooting upwards and they were being fired upon from the downward angle.

Whatever you say, I am not heard of fake encounter where senior officer got killed? Until this is explained, what happened in Batla house was encounter of terrorist by DP.
