New Delhi: In the first official document from cops detailing the sequence of events leading to the controversial Batla House encounter in 2008, the Delhi Police on Wednesday filed a chargesheet in the case in a Delhi court.

The 1100-page chargesheet, however, doesn’t mention any independent witnesses and relies on the testimonies of cops, doctors and experts. Though the crime branch recorded the statement of 57 witnesses, it could not trace any independent witnesses.

The chargesheet has been filed against Shehzad alias Pappu, the suspect arrested by Delhi Police from Azamgarh. However, no charges have been levelled against Mohammad Saif, who had allegedly locked himself inside the toilet in L-18 flat of Batla House when the encounter was on. Shehzad has been charged with the murder of inspector Mohan Chand Sharma, criminal conspiracy and firing on the police team.

Ariz alias Junaid, another militant who fled from the Batla House, has been declared proclaimed offender and a reward of Rs 5 lakh declared on him. They have been charged under sections 302 (murder), 307 (attempt to murder), 120 b (criminal conspiracy), 186 (obstructing public servant in discharge of public functions), 353 (assault or criminal force to deter public servant from discharge of his duty) and Arms Act.

The chargesheet contains details of the postmortem report conducted by AIIMS on inspector Mohan Chand Sharma and two alleged militants — Atif Ameen and Mohd Sajid. A report from the board of doctors who analyzed and detailed the nature of injuries is also part of the documents. It says that while Sharma suffered injuries from a .30 bore weapon, the two alleged terrorists were hit by bullets fired from 9mm pistol and AK-47 assault rifle. The .30 bore weapon used to fire on Sharma could not be traced, the cops said in the chargesheet.

Forensic reports from CFSL about the bullets fired at L-18 are also part of the chargesheet. It claimed that the investigation into the encounter by crime branch is based on scientific evidence.

The chargesheet remains silent on the role of policemen who first entered the L-18 Batla House and what triggered the firing. It merely states that a team of Special Cell investigating the September 13 serial blasts reached the flat tracking a mobile number. On verification, people holed up inside opened fire at the police team resulting in the death of Sharma and later two militants in the cross fire.

The chargesheet also discusses senior lawyer Prashant Bhusan’s allegations in the Delhi high court that the encounter was fake.

Rebutting his claim, the cops cite Shehzad’s confession. The chargesheet states that Shehzad claimed that he along with Ariz had fired on the police team and later fled from the scene taking advantage of the chaos. He then fled to Azamgarh and was hiding in Lucknow before going to Mumbai. He then went to Jodhpur from where he again came back to Azamgarh from where the UP ATS nabbed him.
