Al Jazeera’s report a false, fabricated, malicious attempt to debase Bangladesh Army: ISPR

Star Digital Report

The Army Headquarters outrightly rejected "all malicious attempt and claims of Al-Jazeera to debase a professionally highly skilled, universally accepted Chief of Army Staff without any valid evidence" in a report titled "All the Prime Minister's Men" broadcast on February 1 by the international news channel.

Mentioning that the report has drawn the attention of Headquarters, Bangladesh Army, ISPR issued a statement yesterday rejecting the claims made in the documentary.

"The report of Al-Jazeera, in the form of a documentary, consists of numerous false and fabricated stories in respect of the Government of Bangladesh and Bangladesh Army, creating unnecessary confusion among the general mass," the ISPR statement read.

"It is clear from the report that it has been intentionally prepared blending some untrue, fabricated, fictitious, speculative and unsupported information with some isolated incidents in order to discredit the Government of Bangladesh and the Bangladesh Army and the Chief of Army Staff of Bangladesh Army among the mass people of Bangladesh and the world," it said.

"Firstly, the documentary that has been broadcasted has revealed many false information about the purchase of spyware by the Bangladesh Army from Israel and direct and indirect involvement of the brothers of present chief of army staff in various procurement processes of the Bangladesh Army.

"It may be mentioned that Bangladesh Army has been successfully participating in UN peacekeeping missions since 1988. Since then Bangladesh has achieved the recognition of 'Highest Troops Contributing Country' a number of times and now (since August 31, 2020) among 120 countries around the globe. Till date, 124 peacekeepers from Bangladesh Army made supreme sacrifice and 222 peacekeepers have sustained injury for the cause of global peace in different UN Missions," the ISPR statement read.
"Reputation, expertise, capability and excellence earned through long experience in peacekeeping operations, drives Bangladesh Army to remain ever ready to deploy contingents of different types as per the requirements of the UN in a minimum possible time. Currently, under the United Nations Peacekeeping Capability Readiness System (UNPCRS), 16 contingents of the Bangladesh Army are phased out to replace the old units and in some cases are ready for new deployments, which is otherwise the highest among troops-contributing countries.

"On December 29, 2016, the United Nations Development Program (UNDPO) requested Bangladesh for the first time to inform regarding the capability of transforming the pledged 'Signal Unit' due to be deployed in the Democratic Republic of Congo (MONUSCO) into a 'Signal Intelligence Unit'. In the same note UN also sent a list of required manpower and equipment through Statement of Unit Requirement for the said unit. At that time Bangladesh Army did not have some equipment required for the Signal Intelligence Unit and those needed to be imported from abroad. Accordingly, Bangladesh Army informed the UN on January 5, 2017 that the Signal Intelligence Unit could be sent by Bangladesh after September 2018.

"Following this, Bangladesh started the process of procuring a Passive Signal Interceptor from Hungary in December 2017 following the standard Government procurement process, which was completed in June 2018. Although the equipment was procured in accordance with UN requirements, the UN later deployed a Tanzanian signal intelligence unit in Democratic Republic of Congo. As a result, the signal equipment so procured is lying with Bangladesh Army, not in use till date and ready for deployment within a shortest possible time upon requirement of UN," ISPR said in the statement.

"Note that the information provided by Al-Jazeera that the signal device was made by Israel is not true at all and the name of Israel is not engraved anywhere in the device. It is to be noted that there is no scope of corruption since the procurement of all military equipment in Bangladesh Army is done under a specific and set policy and following a number of steps.

"The procurement process for this signal equipment began long before the current Chief of Army Staff, General Aziz Ahmed, took over his office. The process started in 2017 during the tenure of previous Chief of Army Staff, following the procurement process of the Army Headquarters and with the approval of the Government the Directorate General Defence Purchase (DGDP) entered into the contract in June 2018. Hence the attempt of Al-Jazeera to link the Chief of Army Staff or his brother residing in Hungary in the process of procuring the said equipment was motivated by a completely nefarious motive.

"In addition, the documentary appears to have been made basing the long time stay of the brother of General Aziz in Hungary. It is pertinent to mention here that none of the brothers or relatives of the Chief of Army Staff has ever been involved in any kind of supply or purchase process of arms, ammunition or equipment in Bangladesh Army. It is conceivable that this documentary is just an attempt to create chaos and anarchy in the country by attacking the head of a reputed and well-organised organisation like the Bangladesh Army and a sensitive institution like the military by smearing his family members," the statement also read.

"On March 29, 2019, the wedding reception of the son of the Chief of Army Staff was held where distinguished and eminent personalities attended. Worth mentioning that, before that, both the brothers of the Chief of Army Staff (Anis and Hasan) were acquitted of the conspired, planned and fabricated cases through proper judicial process. As a result, none of his brothers were convicted or absconding on the day of the wedding reception where they attended. They appeared at the ceremony as fully acquitted and no case was pending against them at that time. After the official visit to Singapore in April 2019, the Army Chief left for Malaysia on a private visit and stayed at his elder brother's house. It is, therefore, clear that the incident of 'meeting of the Chief of Army Staff with his expatriate brother in Malaysia' shown in the report is purposefully presented as 'meeting with the fugitive accused' which is just a shameless propaganda.

"It is worth mentioning that the real name of the person named Sami in the Al-Jazeera report is 'Samiul Ahmed Khan', and his father is late Lt Col Abdul Basit Khan (Retd). Sami has previously been arrested by law enforcing agency and Military Police for theft, using uniform and forging credentials of army officers. He was declared unwanted (persona non grata) in all the cantonments of Bangladesh in 2006 for those criminalities. 'Samiul Ahmed Khan' currently bears the name 'Zulkarnain Saer Khan' (current passport number is EG0092902, previous passport numbers were BJ0520260, AC5075647, and B1765649) and is living in Hungary under a false identity using his father's name as 'Colonel Wasit Khan'. It may be mentioned that a case (No. 2/5/2020) was filed with the Ramna Model Police Station on May 5, 2020 on the allegations of anti-state propaganda against this swindler, greedy and fraudulent Sami, which is currently under investigation," the statement read.

Mentioning that the documentary has been intentionally articulated with hypothetical, unacceptable and unproven information by adding some fragmentary pictures or scenes from different times, ISPR said in the statement, "Almost the entire subject matter of the report is based on unsubstantiated hearsay and the informant has not been questioned or cross-examined by the affected parties.

"It goes without saying that the report has lost its acceptability, relevance and credibility due to the unilateral collection of evidence from a fraudulent and fugitive man like Sami and the production of such a baseless documentariy using unreliable and misleading information as evidence is deplorable."

"It is to be noted here that in the said report, an attempt has been made to directly mention and present the Chief of Army Staff of Bangladesh and portray his family as a mafia family. Such slanders and lies about the Chief of Army Staff appointed according to law by the Government of an independent and democratic country are utterly objectionable and unsolicited and which is not expected from a news agency like Al-Jazeera," the OSPR statement also read.

"The Army Headquarters outright rejects all malicious attempt and claims of Al-Jazeera to debase a professionally highly skilled, universally accepted Chief of Army Staff without any valid evidence," it added.

The government has granted clemency to the two controversial brothers, Haris Ahmed and Anis Ahmed, who had been facing life sentence. Haris was convicted in two murder cases and Anis in one. The home ministry had actually issued a gazette notification on 28 March 2019, pardoning them from their sentences.

In the recent news documentary, ‘All the Prime Minister’s Men,’ aired by the Qatar-based television channel Al-Jazeera, these two brothers were referred to as fugitive convicts. In Bangladesh too, up until yesterday, everyone knew them to be convicts on the run. But Prothom Alo investigations have proven otherwise.

The German-based media outlet Deutsche Welle had invited Gowher Rizvi, the prime minister’s international affairs advisor, to the talk show ‘Conflict Zone’. During the talk show, among other things, it was mentioned that these two fugitive brothers had been seen openly attending an event in the country.

Haris Ahmed and Anis Ahmed are the brothers of army chief General Aziz Ahmed. Also a murder convict, their other brother Tofail Ahmed alias Josef, was sentenced to death. However, he was freed following presidential pardon. Josef’s mother Renuja Begum had appealed for Josef to be pardoned. It is still not clear who appealed for clemency for Haris and Anis, or why and how this was done. Another younger brother of General Aziz Ahmed, Tipu Ahmed, was killed by opponents in 1999.

General Aziz Ahmed was appointed army chief on 25 June 2018. Just a month before that, on 27 May 2018, Josef was pardoned from his sentence. And nine months later, a circular was issued granting clemency to Haris and Anis too. They were pardoned from their life sentences under Section 401 of the Code of Criminal Procedure. Section 401(1) of the code states that “when any person has been sentenced to punishment for an offence, the Government may at any time without conditions or upon any conditions which the persons sentenced accepts, suspend the execution of his sentence or remit the whole or any part of the punishment to which he has been sentenced.”

According to sources in the home ministry, on the very day that the home ministry issued the gazette notification granting them clemency, copies of this were sent to two separate speedy trial tribunals in Dhaka. These two magistrate courts had passed the sentence on the accused. Court sources said that after receiving the circular, the court sent orders to the Mohammedpur and Kotwali police stations to revoke the arrest warrants against Haris Ahmed and Anis Ahmed.

The circular stated that, by power of Section 401 of the Code of Criminal Procedure, victims of political vengeance Haris Ahmed and Anis Ahmed had been pardoned from the life sentences that had been passed in a conspiratorial, planned, framed and fabricated case.
Pardoning a fugitive criminal amounts to unlawful use of authority and misuse of power
Shadeen Malik, Supreme Court lawyer
Copies of this gazette notification were sent to the principal secretary of the prime minister’s office, the law secretary, the inspector general of police, the personal secretary of the home minister and the secretary of the home ministry’s security services division. This gazette notification has remained a secret though it was sent to so many government offices nearly two years ago.

When asked about the matter of granting clemency to Haris Ahmed and Anis Ahmed, Dhaka’s Speedy Trial Tribunal-3 public prosecutor (PP) Mahbubur Rahman on Monday told Prothom Alo, “Nothing can be said without checking the files.” Dhaka’s Speedy Trial Tribunal-4 PP Abdul Quader said the same.
These two courts had sentenced Haris Ahmed and Anis Ahmed to life imprisonment.

Law minister Anisul Haque, when asked, also told Prothom Alo over mobile phone on Monday, “I do not know if anyone’s sentence has been pardoned. I have no idea about the matter.”

Supreme Court lawyer Shahdeen Malik told Prothom Alo that no fugitive criminal can enjoy any sort of legal privileges or rights. If any fugitive is pardoned under the Criminal Code of Procedure, that will be completely illegal. This is a clear provision of the law. He said that if anyone violates the law and takes steps to grant pardon, then in accordance to the law, departmental or administrative action can be taken against him or them. After all, pardoning a fugitive criminal amounts to unlawful use of authority and misuse of power.

However, law minister Anisul Haque told Prothom Alo there is no obligation for the accused to remain present to be pardoned under Section 401 of the criminal code. On Monday evening, Haris Ahmed’s name was still on the ‘wanted’ list on the Bangladesh Police’s website.

Haris, Anis and Josef sentenced for Mustafiz murder

Businessman of Mohammedpur, Mustafizur Rahman, was shot dead on 7 May 1996. Police issued charge sheet against Haris Ahmed, Anis Ahmed and Tofail Ahmed alias Josef in this case. On 25 May 2004, Dhaka’s Speedy Trial Tribunal-3 announced the verdict in this case. In the verdict, the court sentenced Josef and a certain Masud to death. And three fugitive accused, including Haris Ahmed and Anis Ahmed, were sentenced to life imprisonment.

According to the case details, Josef appealed from jail against this verdict of the magistrate court. Haris Ahmed and Anis Ahmed could not appeal as they were in hiding. It was on 20 September 2007, during the caretaker government, that the High Court passed its rule following the death reference and hearing of the appeals. The sentences against Tofail Ahmed Josef and the other accused, Kabil, were upheld. Masud, who had been sentenced to death, was acquitted.

Josef and Kabil appealed against the High Court verdict. During the term of the present government, the Appellate Division gave its verdict on 9 December 2015 where Josef’s death sentence was commuted to life sentence. Kabil was acquitted. The next year, 2016, Josef’s mother appealed to the president for him to be pardoned. In 2018 the president pardoned him and he was released from jail. In was on 28 March 2019 that the government issued a circular pardoning Haris Ahmed and Anis Ahmed in this case.
One person did appeal to us to be pardoned from life-term. I cannot remember his name. The honorable president granted the appeal. Another declared himself a mental patient. The honorable president said he could go abroad for treatment. That is all I remember
Asaduzzaman Khan, home minister
Haris and Josef sentenced for killing Abu Morshed

Dhaka University student Abu Morshed on 25 September 1995 was attacked on the premises of Dhaka’s judge court. He had gone that day to appear in court in a murder case. He was shot in front of Dhaka’s Bar Council building. He was taken to Dhaka Medical College Hospital where he died after 7 days on 2 October.

Morshed’s father, lawyer Azizullah Bhuiyan, filed a case in this regard with the Kotwali police station. The police submitted charge sheet against right persons including Haris Ahmed and Tofail Ahmed Josef in this case in 11 April 1997 during the Awami League government tenure.

Two others were named in a supplementary charge sheet the next year. On 4 October 1999, trial against these 10 accused began. On 10 August 2003, the case was sent to Dhaka’s Speedy Trial Tribunal-4.

Records show that during the hearing the defence claimed that the Morshed had been accused in the Babu murder case in Mohammedpur. Josef and others were witnesses in that case. They claimed they had been made accused in the Morshed murder as part of enmity against them.

However, on his death bed, on 27 September 1995, Morshed had made a deposition to the magistrate. He said that Haris, Mamun, Munna, Paris and Shaheen had surrounded him at the Dhaka Bar Council gate. Josef and Mamun shot him. On 3 March 2004, the court passed its verdict in this case, sentencing Josef and Tariq Saif alias Mamun to death. Haris Ahmed, Islam alias Munna, Ashanuzzaman alias Paris and Shaheen were sentenced to life imprisonment. Shoheb, Badal and Faruk were acquitted. Anis Ahmed was not accused in this case.

The court verdict declared that the accused had been sentenced on the basis of all evidence including the statement of the victim on his death bed.

Haris Ahmed did not appeal against this case. Yet the 28 March 2019 circular of the home ministry even pardoned him from this sentence.

When asked about the matter, home minister Asaduzzaman Khan told Prothom Alo over mobile phone on Monday night, “I know nothing about them (Haris Ahmed and Anis Ahmed) being pardoned. I cannot say anything without knowing about it.” However, he did say, “One person did appeal to us to be pardoned from life-term. I cannot remember his name. The honorable president granted the appeal.

Another declared himself a mental patient. The honorable president said he could go abroad for treatment. That is all I remember.”

As to whether a fugitive criminal can get legal rights, the home minister said, “A fugitive criminal does not get any legal rights. He will have to surrender to get legal rights.”

Translation of Pinaki Bhattacharya statement on Facebook above. I commend Pinaki's uprightness on this - Bravo!!

" Today's statement of the Chief of Army Staff Mr. Aziz regarding the pardon of the fugitive brothers is totally unacceptable.

The case of the army chief's brothers is not one. There are different cases in every one of the brothers' names. In some cases, however, they were accused together.

General Aziz became the Chief of Army Staff on June 25, 2016. One month prior, his younger brother Joseph's sentence was commuted on May 26, 2016. Nine months later, in 2019, the sentences of two other brothers, Harris and Anis, were commuted. So when General Aziz was the army chief, his two other brothers were fugitives and convicted criminals. How would General Aziz explain this?

The sentence of a fugitive and a convicted criminal cannot be commuted. The High Court of Bangladesh has specific instructions in this regard. The High Court has clearly stated that in the eyes of the law, there is no scope for remission of sentence from a fugitive state. The High Court has clearly stated this in the judgment of Sarwar Kamal v. State [32 BLD 529 = 64 DLR 329]. The judgment of the High Court became the de facto law of Bangladesh. The pardon of Anis and Harris is therefore illegal in the eyes of the prevailing law of Bangladesh, whoever pardons it.

The law minister said he did not know whether the sentence had been commuted. The home minister said the sentence could not be commuted while on the run. So the question is who created the file of this sentence waiver? This will be jointly made by the Ministry of Law and the Ministry of Home Affairs.

What does General Aziz have to say about Harris's fake identity, coming to the country with a fake passport? While at it, using a fake passport is also a crime under the law of the land. Has he committed a crime in every country where he has traveled using this passport?

General Aziz, why do you want to use the Army Institution a scapegoat responsible for your family crimes? What is the responsibility of the army to assume the ink-blot of the crime committed by your brothers on them?"

Hasina (by commuting the death sentences of these common street goondas) has completely thrown the dignity of our country (whatever Bangladesh still had) into the gutter.

I am ashamed of her, of AL, and the complete Mafia cabinet they represent.

Shame !!

Another interesting of the ISPR release have you noticed that Mohammad Hasan has been mentioned as Aziz Ahmed’s brother no longer Haris Ahmed. As of now Haris Ahmed has disappeared out of thin air.

If you look at the passport obtained by Haris Ahmed by the name Mohammad Hasan had no past passport number but Haris maintained passport in the past.

Plus he went to Hungary through Dhaka airport on 2015 the time when Haris Ahmed was still on most wanted list and still is both for Interpol and Bangladesh Police.

Wasn’t that identity created to cover up the name and create a new identity and avoid getting arrested at the airport?

If now the claim is he changed name legally how still a criminal on most wanted list got a passport?

Now trying to use the name Mohammad Hasan as Aziz Ahmed’s brother as the identity is already well established and can not be denied, ISPR is trying to make the equation 2 + 2 = 5.

While doing so Haris Ahmed disappeared out of thin air and still at the most wanted list of the Bangladesh Police.

Worth mentioning that, before that, both the brothers of the Chief of Army Staff (Anis and Hasan) were acquitted of the conspired, planned and fabricated cases through proper judicial process.

Here father name of Mohammad Hasan is Suleman Sarkar.

But at the Bangladesh Police most wanted list the father name is Abdul Wadud.

ISPR notice shows Hasan as brother of Army Chief but could not fix these past passport issue or father name etc. ISPR must provide explanation to these issues.

At the prothom alo report mentioned above used their mother name as Renuja Begum.

Josef’s mother Renuja Begum had appealed for Josef to be pardoned.

However at 9:06 minute of the All the Prime Minister’s name at the NID mother’s name used as Rahela Begum.

So considering both name change and both parent’s name change it can be said that Mohammad Hasan is a complete fake identity and now ISPR in it’s report using that person’s name as Army Chief’s brother.

Both ISPR and Army Chief owe and explanation.

Now we need to know who has pardoned if it really happened. Haris Ahmed or Mohammad Hasan? If Hasan than how he obtained passport earlier and why both Hasan and Haris Ahmed has different identity?

People were starting to forget this report just like any other cases in BD but ISPR just had to bring that up again and make things worse. First they got caught for using UN as excuse now people are talking about Aziz's two fugitive brothers amnesty.

To make thing worse Bangladeshi Consular General of Hungary Nyerges Ambras wrote a letter to the Government of Hungary for Haris Ahmed aka Mohammad Hasan introducing him as a businessman and requested him to grant visa.

Even if we assume Haris Changed his name to Mohammad Hasan still he was a criminal and a Consular General of a country can’t request another government to let a criminal come to the country under a fake name.

If he never changed name than it is a diplomatic blunder.

All parties involve Aziz Ahmed, Foreign Ministry and Nyerges Ambras must provide explanation to this.

It is not possible without green signal of Foreign Ministry Nyerges Ambras wrote the letter.

In June 2015, Nyerges wrote a letter to the Immigration Office asking for a positive assessment of “Mohammad Hasan’s” application for residence. To his knowledge, the Bangladeshi businessman wanted to open a restaurant and a guest house in Budapest. “We are convinced that his successful business activities can serve as a reference for businessmen in Bangladesh interested in investing in Hungary,” Nyerges wrote.
