The purpose of this article is to defend Capital Punishment which is mentioned in the article 295-C against the Blasphemer of Rasool Allah(P.B.U.H). Arguments are presented from Quran, Hardees and Ijma e Ummat as these things constitute the basic sources of Shariah. The article only discusses the legitimacy of Capital punishment to a person whose blasphemy has been established. I will only stick to Dalail e Sharia. It should be noted that I have just collected the evidence.

-Say, [O Muhammad], "If you should love Allah, then follow me, [so] Allah will love you and forgive you your sins. And Allah is Forgiving and Merciful." Aale Imran 31

-And whatever the Messenger has given you - take; and what he has forbidden you - refrain from. And fear Allah; indeed, Allah is severe in penalty. Al Hashar 7

And whoever opposes the Messenger after guidance has become clear to him and follows other than the way of the believers - We will give him what he has taken and drive him into Hell, and evil it is as a destination. An-Nisa 115

There are countless occasions where this article 295-C is mocked and ridiculed by our secular liberal members. Some even presented verses of holy Quran to negate this article. I request moderators to allow this discussion because if certain people have the right to oppose and ridicule this law than others should also have the right to defend it. I demand that if the thread needs to be deleted because it's against forum rules than all discussion regarding blasphemy law should be banned immediately. Add this topic to banned list so that no one can argue for or against it.


Evidence from Quran:

1. Indeed, those who abuse Allah and His Messenger - Allah has cursed them in this world and the Hereafter and prepared for them a humiliating punishment. Ahzab-57

· In this verse Abuse of Allah is the abuse of messenger because no one can hurt or abuse Allah as God doesn’t exist in any Materialistic form. Tafsir e Roohul bayan V-7 P-237, Tafseer e Mazhari V-9 P-289

· Insult and abuse of Prophet (whether it's direct or indirect) of his personality, religion and ancestry is infidelity. A person who is involved in committing such act became apostate(Murtad) and he is liable to Death. Tafseer e Mazhari V-9, P-291

· “Respect of Allah and His prophet is same thing” Allama Ibn e Qayam

· “Abuse and Insult of Prophet is Kufr” Ibn e Taimiyah

· “Ibn e Hamam Said The person who Abuses prophet become apostate, his repentance will not be accepted and he will be killed” Tafseer e Mazhari

· “According to one tradition Hazrat Abu Bakar Siddiq Also gave the same fatwa” Tafseer e Mazhari

· “They (People who commit blasphemy) are cursed in this world and their final punishment is death” Tafseer e Saadi

· “It is stated in this verse that It is obligatory to kill those people who intentionally abuses Allah and His prophet” Ibn e Taimiyah

· Same thing is stated in Tafsir Abi Saod V-4, P-77, Saadi, Abu lais Samarqandi

And those who harm believing men and believing women for [something] other than what they have earned have certainly born upon themselves a slander and manifest sin. Ahzab 58

· Try to understand the difference between abuse of Holy prophet and abuse of Believers. Same word “Yu’uzoon” has been used but punishments are different.


If the hypocrites and those in whose hearts is disease and those who spread rumors in al-Madinah do not cease, We will surely incite you against them; then they will not remain your neighbors therein except for a little. Ahzab 60


Accursed wherever they are found, [being] seized and massacred completely. Ahzab 61

· Prophet said “Curse on Momin amounts to(is equal to) his death” Bukhari, Muslim

· Reason of their curse is mentioned in previous verse that they used to Abuse prophet

· As they are accused so wherever they are found seize them and kill them. Sarim ul Maslool

[This is] the established way of Allah with those who passed on before; and you will not find in the way of Allah any change. Ahzab 62



2. And among them are some who criticize you concerning the [distribution of] charities. If they are given from them, they approve; but if they are not given from them, at once they become angry. Tauba 58

· “People who criticize prophet were Hypocrites” Ibn e Kasir, Saadi, Tafseer e Mazhari

· These people who used to abuse prophet were hypocrites, Ibn e Taimiyah

· Qatadah commented on Allah's statement, We were told that a bedouin man, who had recently embraced Islam, came to the Prophet , when he was dividing some gold and silver, and said to him, `O Muhammad! Even though Allah commanded you to divide in fairness, you have not done so.' The Prophet of Allah said, (Woe to you! Who would be fair to you after me then) The Prophet of Allah said next, (Beware of this man and his likes! There are similar persons in my Ummah who recite the Qur'an, but the Qur'an will not go beyond their throat. If they rise (against Muslims rulers) then kill them, if they rise, kill them, then if they rise kill them.) Ibne Kasir


And among them are those who abuse the Prophet and say, "He is an ear." Say, "[It is] an ear of goodness for you that believes in Allah and believes the believers and [is] a mercy to those who believe among you." And those who abuse the Messenger of Allah - for them is a painful punishment. Tauba 61

· These people who abuse Messenger were Hypocrites Saadi, Tafseer e Mazhari, Ibn e Abbas, Ibn e Kasir



Do they not know that whoever opposes Allah and His Messenger - that for him is the fire of Hell, wherein he will abide eternally? That is the great disgrace. Tauba 63

· Opposing Allah and his messenger is Kufr because of the punishment suggested in above verse.

· “Punishment of blasphemer of Rasool Allah is Death” Saadi, Ibn e Taimiyah


And if you ask them, they will surely say, "We were only conversing and playing." Say, "Is it Allah and His verses and His Messenger that you were mocking?" Tauba 65

· This verse has been revealed for hypocrites who are abusing prophet

· Due to blasphemy of Rasool Allah they have committed Kufr.

· Tafsir e Madarik V-2 P-234 , Safwa tut tafasir V-1 P-546, tafseer e kashaf V-2, P-286, tafseer e roohul bayan V-3 P-459, Mulla Ali Qari Sharh shifa V2 P-404, Ibn e Taimiyah


Allah has promised the hypocrite men and hypocrite women and the disbelievers the fire of Hell, wherein they will abide eternally. It is sufficient for them. And Allah has cursed them, and for them is an enduring punishment. Tauba 68

· Allah has promised fire of hell for hypocrite men and women because they have committed blasphemy against the prophet.


O Prophet, fight against the disbelievers and the hypocrites and be harsh upon them. And their refuge is Hell, and wretched is the destination. Tauba 73

· Allah has ordered prophet to fight against hypocrites and be harsh upon them

· Reason of their hypocrisy is already established by previous verses

· (Strive hard against the disbelievers and the hypocrites) "With the hand, or at least have a stern face with them.'' Ibn `Abbas said, "Allah commanded the Prophet to fight the disbelievers with the sword, to strive against the hypocrites with the tongue and annulled lenient treatment of them.'' Ad-Dahhak commented, "Perform Jihad against the disbelievers with the sword and be harsh with the hypocrites with words, and this is the Jihad performed against them.'' Similar was said by Muqatil and Ar-Rabi`. Al-Hasan and Qatadah said, "Striving against them includes establishing the (Islamic Penal) Law of equality against them.'' In combining these statements, we could say that Allah causes punishment of the disbelievers and hypocrites with all of these methods in various conditions and situations, and Allah knows best. Ibn e Kasir

· Atta’a Said This verse has abolished all orders of pity and forgiveness. Tafsir e Mazhari V-5, P-238


They swear by Allah that they did not say [anything against the Prophet] while they had said the word of disbelief and disbelieved after their [pretense of] Islam and planned that which they were not to attain. And they were not resentful except [for the fact] that Allah and His Messenger had enriched them of His bounty. So if they repent, it is better for them; but if they turn away, Allah will punish them with a painful punishment in this world and the Hereafter. And there will not be for them on earth any protector or helper. Tauba 74

· @The Sandman I have seen all the available tafaseer including Rohul Bayan, Ibne Kasir, Dur e Mansoor, tafsir e ibne abbas, tafsir e saadi, madarik, qurtabi and didn’t found anything closely related to your assertion. Could you provide a reference of Single tafsir by an authentic Ahlus Sunnah or Ahl e Tashiyo Aalim to support your claim? Or in fourteen hundred years this revelation has only come to you that these Ayats are against Death penalty of Blasphemer.

· Bro you need to understand the fact that your opinion, your assertions, your interpretations are of no value in matters of Shariah. Same could be said about me. You need to study a bit about Fundamentals of Tafseer.

· Indeed, Allah confers blessing upon the Prophet, and His angels [ask Him to do so]. O you who have believed, ask [ Allah to confer] blessing upon him and ask [ Allah to grant him] peace. Ahzab

· Word “Yusaloona” is used. If its right to interpret Quran on the basis of your own knowledge then what would be your answer to a person who starts saying that Allah has commanded us to offer prayer on Rasool Allah (Naoz o Billah). Thousands of examples like this could be given.


3. Indeed, those who oppose Allah and His Messenger are abased as those before them were abased. And We have certainly sent down verses of clear evidence. And for the disbelievers is a humiliating punishment. Mujadla 5


Indeed, the ones who oppose Allah and His Messenger - they will be among those most humiliated. Mujadla 20

· “Azaleen” Zaleel

· they are among the miserable, the cast out, banished from goodness; they are the humiliated ones in this life and the Hereafter. Ibn e Kasir

· “They are among most humiliated creatures” Mazhari

Allah has written, "I will surely overcome, I and My messengers." Indeed, Allah is Powerful and Exalted in Might. Mujadla 21

And to Allah belongs [all] honor, and to His Messenger Al Munafeqon 8

· “Ibn e Taimiyah Said their lives have become permissible to be taken” Sarim ul maslool


4. Make not the calling of the Messenger among you as your calling one of another. Allah knows those of you who slip away under shelter. And let those beware who oppose the Messenger's commandment, lest some Fitnah should befall them or a painful torment be inflicted on them. An Nur 63


· Ad-Dahhak said, reporting from Ibn `Abbas: "They used to say, `O Muhammad,' or `O Abu Al-Qasim,' but Allah forbade them to do that, as a sign of respect towards His Prophet , and told them to say, `O Prophet of Allah,' `O Messenger of Allah.''' This was also the view of Mujahid and Sa`id bin Jubayr. Qatadah said: "Allah commanded that His Prophet should be treated with respect and honor, and that he should be a leader.'' Muqatil said concerning the Ayah: "When you address him, do not say, `O Muhammad,' or `O son of `Abdullah'; rather honor him and say, `O Prophet of Allah,' or, `O Messenger of Allah.' Ibn e Kasir

· (or a painful torment be inflicted on them.) means in this world afflicting them with capital punishment, or by law of prescribed punishment, or by confinement in prison, or so on. Imam Ahmad recorded that Abu Hurayrah said, "The Messenger of Allah said: Ibn e Kasir

· Ibne abi hatim, imam razi, mahmood alossi, imam qurtabi, shanqeti, Allama sindhi has said the same thing about this verse

5. O you who have believed, say not [to Allah 's Messenger], "Ra'ina" but say, "Unthurna" and listen. And for the disbelievers is a painful punishment. Baqrah 104
· Ibn e Abbas Said when this Verse is Revealed Muslim agreed that if anyone abuse prophet or his words have the probability of Abuse then he should be punished by death. Dalail un Nabuwa Abu Noaem, Allama shaukani

· Ibn e Umar Narrated, Prophet Said “I was sent with the sword just before the Last Hour, so that Allah is worshiped alone without partners. My sustenance was provided for me from under the shadow of my spear. Those who oppose my command were humiliated and made inferior, and whoever imitates a people, he is one of them.” Imam Ahmad, Ibne Kasir

· It is established from this verse that People should restrain themselves from the words which have the probability of abuse. Our Scholars agreed that “Hadd” will be imposed on the person who is involved in such acts. Ahkam ul Quran ibne Arabi V-1, P- 32

6. O you who have believed, do not raise your voices above the voice of the Prophet or be loud to him in speech like the loudness of some of you to others, lest your deeds become worthless while you perceive not. Indeed, those who lower their voices before the Messenger of Allah - they are the ones whose hearts Allah has tested for righteousness. For them is forgiveness and great reward. Hujarat 2,3
· In these Ayat, Allah the Exalted teaches His faithful servants the good manners they should observe with the Messenger , which are respect, honor and esteem Ibn e Kasir
· “Deeds become worthless when a person has commited Kufr” Ibn e Taimiyah

7. [Remember] when your Lord inspired to the angels, "I am with you, so strengthen those who have believed. I will cast terror into the hearts of those who disbelieved, so strike [them] upon the necks and strike from them every fingertip." Anfal 12

· “I will cast fear, disgrace, and humiliation over those who defied My command and denied My Messenger” Ibn e Kasir


That is because they opposed Allah and His Messenger. And whoever opposes Allah and His Messenger - indeed, Allah is severe in penalty. Anfal 13

8. O you who have believed, whoever of you should revert from his religion - Allah will bring forth [in place of them] a people He will love and who will love Him [who are] humble toward the believers, powerful against the disbelievers; they strive in the cause of Allah and do not fear the blame of a critic. That is the favor of Allah ; He bestows it upon whom He wills. And Allah is all-Encompassing and Knowing. Al Maidah 54

9. And We did not send any messenger except to be obeyed by permission of Allah . And if, when they wronged themselves, they had come to you, [O Muhammad], and asked forgiveness of Allah and the Messenger had asked forgiveness for them, they would have found Allah Accepting of repentance and Merciful. An Nisa 64


But no, by your Lord, they will not [truly] believe until they make you, [O Muhammad], judge concerning that over which they dispute among themselves and then find within themselves no discomfort from what you have judged and submit in [full, willing] submission. An Nisa 65


· In his Tafsir, Al-Hafiz Abu Ishaq Ibrahim bin `Abdur-Rahman bin Ibrahim bin Duhaym recorded that Damrah narrated that two men took their dispute to the Prophet , and he gave a judgment to the benefit of whoever among them had the right. The person who lost the dispute said, "I do not agree.'' The other person asked him, "What do you want then'' He said, "Let us go to Abu Bakr As-Siddiq.'' They went to Abu Bakr and the person who won the dispute said, "We went to the Prophet with our dispute and he issued a decision in my favor.'' Abu Bakr said, "Then the decision is that which the Messenger of Allah issued.'' The person who lost the dispute still rejected the decision and said, "Let us go to `Umar bin Al-Khattab.'' When they went to `Umar, the person who won the dispute said, "We took our dispute to the Prophet and he decided in my favor, but this man refused to submit to the decision.'' `Umar bin Al-Khattab asked the second man and he concurred. `Umar went to his house and emerged from it holding aloft his sword. He struck the head of the man who rejected the Prophet's decision with the sword and killed him. Consequently, Allah revealed this verse Dur e Mansoor, Ibn e Kasir, kamalain

· Allah's messenger didn’t take any notice of the killing and his blood is wasted. Dur e Mansoor, Sarim ul Maslool, kamalain

· This hadees is also narrated by Abul Aswad

· Ahmad bin Hambal has taken evidence from this hadith.

· they adhere to your judgment and thus do not feel any hesitation over your decision, and they submit to it inwardly and outwardly. They submit to the Prophet's decision with total submission without any rejection, denial or dispute. Ibn e Kasir

· Prophet has given no compensation to the slain man's family because of the fact that he has rejected prophets descion.


10. Indeed, the penalty for those who wage war against Allah and His Messenger and strive upon earth [to cause] corruption(Fasad) is none but that they be killed or crucified or that their hands and feet be cut off from opposite sides or that they be exiled from the land. That is for them a disgrace in this world; and for them in the Hereafter is a great punishment, Maidah 33

· Is there any “Fasad” worst than blasphemy of Rasool Allah

Evidence from Hadith:


1. Narrated Jabir bin `Abdullah: Allah's Messenger (ﷺ) said, "Who is willing to kill Ka`b bin Al-Ashraf who has hurt Allah and His Apostle?" (Azallaho wa Rasoloho) Thereupon Muhammad bin Maslama got up saying, "O Allah's Messenger (ﷺ)! Would you like that I kill him?" The Prophet (ﷺ) said, "Yes," Muhammad bin Maslama said, "Then allow me to say a (false) thing (i.e. to deceive Ka`b). "The Prophet (ﷺ) said, "You may say it." Then Muhammad bin Maslama went to Ka`b and said, "That man (i.e. Muhammad demands Sadaqa (i.e. Zakat) from us, and he has troubled us, and I have come to borrow something from you." On that, Ka`b said, "By Allah, you will get tired of him!" Muhammad bin Maslama said, "Now as we have followed him, we do not want to leave him unless and until we see how his end is going to be. Now we want you to lend us a camel load or two of food." (Some difference between narrators about a camel load or two.) Ka`b said, "Yes, (I will lend you), but you should mortgage something to me." Muhammad bin Mas-lama and his companion said, "What do you want?" Ka`b replied, "Mortgage your women to me." They said, "How can we mortgage our women to you and you are the most handsome of the 'Arabs?" Ka`b said, "Then mortgage your sons to me." They said, "How can we mortgage our sons to you? Later they would be abused by the people's saying that so-and-so has been mortgaged for a camel load of food. That would cause us great disgrace, but we will mortgage our arms to you." Muhammad bin Maslama and his companion promised Ka`b that Muhammad would return to him. He came to Ka`b at night along with Ka`b's foster brother, Abu Na'ila. Ka`b invited them to come into his fort, and then he went down to them. His wife asked him, "Where are you going at this time?" Ka`b replied, "None but Muhammad bin Maslama and my (foster) brother Abu Na'ila have come." His wife said, "I hear a voice as if dropping blood is from him, Ka`b said. "They are none but my brother Muhammad bin Maslama and my foster brother Abu Naila. A generous man should respond to a call at night even if invited to be killed." Muhammad bin Maslama went with two men. (Some narrators mention the men as 'Abu bin Jabr. Al Harith bin Aus and `Abbad bin Bishr). So Muhammad bin Maslama went in together with two men, and sail to them, "When Ka`b comes, I will touch his hair and smell it, and when you see that I have got hold of his head, strip him. I will let you smell his head." Ka`b bin Al-Ashraf came down to them wrapped in his clothes, and diffusing perfume. Muhammad bin Maslama said. " have never smelt a better scent than this. Ka`b replied. "I have got the best 'Arab women who know how to use the high class of perfume." Muhammad bin Maslama requested Ka`b "Will you allow me to smell your head?" Ka`b said, "Yes." Muhammad smelt it and made his companions smell it as well. Then he requested Ka`b again, "Will you let me (smell your head)?" Ka`b said, "Yes." When Muhammad got a strong hold of him, he said (to his companions), "Get at him!" So they killed him and went to the Prophet (ﷺ) and informed him. (Abu Rafi`) was killed after Ka`b bin Al-Ashraf." Bukhari H-4037 or Book-64, H-84, Muslim H-1801

· Imam Shafi has taken the evidence from this Hades that “A non-muslim(Zimi) who abuses prophet should be killed as his agreement is nullified due to the act of Blasphemy”

· This Hadees is Absolute evidence (Nas e Qatai) of the punishment of Blasphemer.

· “Ka’ab bin Ashraf was in agreement with Holy Prophet and he regularly abuses holy prophet” Imam Muhammad bin Ishaq



2. Narrated Al-Bara bin Azib: Allah's Messenger (ﷺ) sent some men from the Ansar to ((kill) Abu Rafi`, the Jew, and appointed `Abdullah bin Atik as their leader. Abu Rafi` used to hurt Allah's Messenger (ﷺ) and help his enemies against him. He lived in his castle in the land of Hijaz. When those men approached (the castle) after the sun had set and the people had brought back their livestock to their homes. `Abdullah (bin Atik) said to his companions, "Sit down at your places. I am going, and I will try to play a trick on the gate-keeper so that I may enter (the castle)." So `Abdullah proceeded towards the castle, and when he approached the gate, he covered himself with his clothes, pretending to answer the call of nature. The people had gone in, and the gate-keeper (considered `Abdullah as one of the castle's servants) addressing him saying, "O Allah's Servant! Enter if you wish, for I want to close the gate." `Abdullah added in his story, "So I went in (the castle) and hid myself. When the people got inside, the gate-keeper closed the gate and hung the keys on a fixed wooden peg. I got up and took the keys and opened the gate. Some people were staying late at night with Abu Rafi` for a pleasant night chat in a room of his. When his companions of nightly entertainment went away, I ascended to him, and whenever I opened a door, I closed it from inside. I said to myself, 'Should these people discover my presence, they will not be able to catch me till I have killed him.' So I reached him and found him sleeping in a dark house amidst his family, I could not recognize his location in the house. So I shouted, 'O Abu Rafi`!' Abu Rafi` said, 'Who is it?' I proceeded towards the source of the voice and hit him with the sword, and because of my perplexity, I could not kill him. He cried loudly, and I came out of the house and waited for a while, and then went to him again and said, 'What is this voice, O Abu Rafi`?' He said, 'Woe to your mother! A man in my house has hit me with a sword! I again hit him severely but I did not kill him. Then I drove the point of the sword into his belly (and pressed it through) till it touched his back, and I realized that I have killed him. I then opened the doors one by one till I reached the staircase, and thinking that I had reached the ground, I stepped out and fell down and got my leg broken in a moonlit night. I tied my leg with a turban and proceeded on till I sat at the gate, and said, 'I will not go out tonight till I know that I have killed him.' So, when (early in the morning) the cock crowed, the announcer of the casualty stood on the wall saying, 'I announce the death of Abu Rafi`, the merchant of Hijaz. Thereupon I went to my companions and said, 'Let us save ourselves, for Allah has killed Abu Rafi`,' So I (along with my companions proceeded and) went to the Prophet (ﷺ) and described the whole story to him. "He said, 'Stretch out your (broken) leg. I stretched it out and he rubbed it and it became All right as if I had never had any ailment whatsoever." Bukhari H-4039 Ordered to kill shatim e rasool


3. Chapter: The ruling regarding one who reviles the prophet (pbuh)



Narrated Abdullah Ibn Abbas:A blind man had a slave-mother who used to abuse the Prophet (ﷺ) and disparage him. He forbade her but she did not stop. He rebuked her but she did not give up her habit. One night she began to slander the Prophet (ﷺ) and abuse him. So he took a dagger, placed it on her belly, pressed it, and killed her. A child who came between her legs was smeared with the blood that was there. When the morning came, the Prophet (ﷺ) was informed about it.

He assembled the people and said: I adjure by Allah the man who has done this action and I adjure him by my right to him that he should stand up. Jumping over the necks of the people and trembling the man stood up.

He sat before the Prophet (ﷺ) and said: Messenger of Allah! I am her master; she used to abuse you and disparage you. I forbade her, but she did not stop, and I rebuked her, but she did not abandon her habit. I have two sons like pearls from her, and she was my companion. Last night she began to abuse and disparage you. So I took a dagger, put it on her belly and pressed it till I killed her.

Thereupon the Prophet (ﷺ) said: Oh be witness, no retaliation is payable for her blood.Sunan Abi Daood H-4361, Nisai, Sunan Ibne Ba’ata

· It is established from the heading of Imam Abu Dawood that he agrees to the content of Hadees. Furthermore, he brings this Hadees in the Book of Hadood (Kitab ul Hadood)

· Rasool Allah owned the killing by saying that no retaliation is payable for her blood.

· “Imam Ahmad bin Hanbal took the evidence from this hadees that Punishment of blasphemer is death” Ibn e Taimiayah

· “This hadees is authentic” Albani

· Khatabi Said its evident from this hadees the person who abuses prophet should be killed

4. Narrated Ali ibn AbuTalib:A Jewess used to abuse the Prophet (ﷺ) and disparage him. A man strangled her till she died. The Messenger of Allah (ﷺ) declared that no recompense was payable for her blood. Sunan Abi Daood 4362, Nisai V-7 P-110, Nail ul Autar Imam shaukani 379, Imam Shuabi

· This hadees and previous one is evidence of the fact that Death sentence will be equally carried out on Muslim and non-Muslim

· This hadees is authentic” Ibne Taimiayah



5. Narrated AbuBakr: AbuBarzah said: I was with AbuBakr. He became angry at a man and uttered hot words. I said: Do you permit me, Caliph of the Messenger of Allah (ﷺ), that I cut off his neck? These words of mine removed his anger; he stood and went in. He then sent for me and said: What did you say just now? I said: (I had said Permit me that I cut off his neck. He said: Would you do it if I ordered you? I said: Yes. He said: No, I swear by Allah, this is not allowed for any man after Muhammad (ﷺ). Abu Dawud said: This is Yazid's version. Ahmad bin Hanbal said: That is, Abu Bakr has no powers to slay a man except for three reasons which the Messenger of Allah (ﷺ) had mentioned: disbelief after belief, fornication after marriage, or killing a man without (murdering) any man by him. At the conquest of Makkah: Holy prophet Mohammad (S.A.W) announced general amnesty to all except those who were guilty of blasphemous acts and sacrilegious statements, Ibn e Khatal was one of the convict (Tareekh-e-Tabari Page 104 / History written by Al Tabari) This is evident from the following Hadith. Narrated Anas bin Malikl:On the day of the Conquest, the Prophet entered Mecca, wearing a helmet on his head. When he took it off, a man came and said, “Ibn e Khatal is clinging to the curtain of the Ka’ba.” The Prophet said, “Kill him.”Sahih Bukhari Volume 5, Book 59, Number 582:

7. Uqba Bin Abi Muait and Nazar Bin haris are among prisoners of Badar. Both were killed due to their attitude towards prophet. Ibn e Taimiyah.



8. Ibne Umar Said “Punishment of Blasphemer of Rasool Allah is death” Imam Ahmad, Ibn e Taimiyah



Scholars have written several accounts of Blasphemers in their history books but I have skipped all of them because Sahih Ahadees are present and there is no need to mention historic records.

Evidence from Ijma e Ummat:

Ijma has been observed regarding the punishment of a person whose blasphemy has been established. I have not seen any second opinion regarding this issue.

Abu Sulaiman Khatabai said: I don’t know a single Muslim who had argued against the punishment of death to the blasphemer. Al Shifa
Ibne Munzar Said: “Ijma has been recorded from Islamic Scholars regarding the punishment of death of a person who has committed blasphemy against Rasool Allah.”

I have seen many individuals quoting those Ahadees in which Rasool Allah has forgiven the Blasphemer. I don’t know why these people don’t understand a simple point. The authority to forgive a Blasphemer rests with the prophet. No one can take his place. It is his prerogative to forgive.

The purpose of this article is to defend Capital Punishment which is mentioned in the article 295-C against the Blasphemer of Rasool Allah(P.B.U.H). Arguments are presented from Quran, Hardees and Ijma e Ummat as these things constitute the basic sources of Shariah. The article only discusses the legitimacy of Capital punishment to a person whose blasphemy has been established. I will only stick to Dalail e Sharia. It should be noted that I have just collected the evidence.

Say, [O Muhammad], "If you should love Allah, then follow me, [so] Allah will love you and forgive you your sins. And Allah is Forgiving and Merciful." Aale Imran 31

And whatever the Messenger has given you - take; and what he has forbidden you - refrain from. And fear Allah; indeed, Allah is severe in penalty. Al Hashar 7

And whoever opposes the Messenger after guidance has become clear to him and follows other than the way of the believers - We will give him what he has taken and drive him into Hell, and evil it is as a destination. An-Nisa 115

There are countless occasions where this article 295-C is mocked and ridiculed by our secular liberal members. Some even presented verses of holy Quran to negate this article. I request moderators to allow this discussion because if certain people have the right to oppose and ridicule this law than others should also have the right to defend it. I demand that if the thread needs to be deleted because it's against forum rules than all discussion regarding blasphemy law should be banned immediately. Add this topic to banned list so that no one can argue for or against it.

1. Indeed, those who abuse Allah and His Messenger - Allah has cursed them in this world and the Hereafter and prepared for them a humiliating punishment. Ahzab-57

· In this verse Abuse of Allah is the abuse of messenger because no one can hurt or abuse Allah as God doesn’t exist in any Materialistic form. Tafsir e Roohul bayan V-7 P-237, Tafseer e Mazhari V-9 P-289

· Insult and abuse of Prophet (whether it's direct or indirect) of his personality, religion and ancestry is infidelity. A person who is involved in committing such act became apostate(Murtad) and he is liable to Death. Tafseer e Mazhari V-9, P-291

· “Respect of Allah and His prophet is same thing” Allama Ibn e Qayam

· “Abuse and Insult of Prophet is Kufr” Ibn e Taimiyah

· “Ibn e Hamam Said The person who Abuses prophet become apostate, his repentance will not be accepted and he will be killed” Tafseer e Mazhari

· “According to one tradition Hazrat Abu Bakar Siddiq Also gave the same fatwa” Tafseer e Mazhari

· “They (People who commit blasphemy) are cursed in this world and their final punishment is death” Tafseer e Saadi

· “It is stated in this verse that It is obligatory to kill those people who intentionally abuses Allah and His prophet” Ibn e Taimiyah

· Same thing is stated in Tafsir Abi Saod V-4, P-77, Saadi, Abu lais Samarqandi

And those who harm believing men and believing women for [something] other than what they have earned have certainly born upon themselves a slander and manifest sin. Ahzab 58

· Try to understand the difference between abuse of Holy prophet and abuse of Believers. Same word “Yu’uzoon” has been used but punishments are different.


If the hypocrites and those in whose hearts is disease and those who spread rumors in al-Madinah do not cease, We will surely incite you against them; then they will not remain your neighbors therein except for a little. Ahzab 60


Accursed wherever they are found, [being] seized and massacred completely. Ahzab 61

· Prophet said “Curse on Momin amounts to(is equal to) his death” Bukhari, Muslim

· Reason of their curse is mentioned in previous verse that they used to Abuse prophet

· As they are accused so wherever they are found seize them and kill them. Sarim ul Maslool

[This is] the established way of Allah with those who passed on before; and you will not find in the way of Allah any change. Ahzab 62



2. And among them are some who criticize you concerning the [distribution of] charities. If they are given from them, they approve; but if they are not given from them, at once they become angry. Tauba 58

· “People who criticize prophet were Hypocrites” Ibn e Kasir, Saadi, Tafseer e Mazhari

· These people who used to abuse prophet were hypocrites, Ibn e Taimiyah

· Qatadah commented on Allah's statement, We were told that a bedouin man, who had recently embraced Islam, came to the Prophet , when he was dividing some gold and silver, and said to him, `O Muhammad! Even though Allah commanded you to divide in fairness, you have not done so.' The Prophet of Allah said, (Woe to you! Who would be fair to you after me then) The Prophet of Allah said next, (Beware of this man and his likes! There are similar persons in my Ummah who recite the Qur'an, but the Qur'an will not go beyond their throat. If they rise (against Muslims rulers) then kill them, if they rise, kill them, then if they rise kill them.) Ibne Kasir


And among them are those who abuse the Prophet and say, "He is an ear." Say, "[It is] an ear of goodness for you that believes in Allah and believes the believers and [is] a mercy to those who believe among you." And those who abuse the Messenger of Allah - for them is a painful punishment. Tauba 61

· These people who abuse Messenger were Hypocrites Saadi, Tafseer e Mazhari, Ibn e Abbas, Ibn e Kasir



Do they not know that whoever opposes Allah and His Messenger - that for him is the fire of Hell, wherein he will abide eternally? That is the great disgrace. Tauba 63

· Opposing Allah and his messenger is Kufr because of the punishment suggested in above verse.

· “Punishment of blasphemer of Rasool Allah is Death” Saadi, Ibn e Taimiyah


And if you ask them, they will surely say, "We were only conversing and playing." Say, "Is it Allah and His verses and His Messenger that you were mocking?" Tauba 65

· This verse has been revealed for hypocrites who are abusing prophet

· Due to blasphemy of Rasool Allah they have committed Kufr.

Allah has promised the hypocrite men and hypocrite women and the disbelievers the fire of Hell, wherein they will abide eternally. It is sufficient for them. And Allah has cursed them, and for them is an enduring punishment. Tauba 68

· Allah has promised fire of hell for hypocrite men and women because they have committed blasphemy against the prophet.


O Prophet, fight against the disbelievers and the hypocrites and be harsh upon them. And their refuge is Hell, and wretched is the destination. Tauba 73

· Allah has ordered prophet to fight against hypocrites and be harsh upon them

· Reason of their hypocrisy is already established by previous verses

· (Strive hard against the disbelievers and the hypocrites) "With the hand, or at least have a stern face with them.'' Ibn `Abbas said, "Allah commanded the Prophet to fight the disbelievers with the sword, to strive against the hypocrites with the tongue and annulled lenient treatment of them.'' Ad-Dahhak commented, "Perform Jihad against the disbelievers with the sword and be harsh with the hypocrites with words, and this is the Jihad performed against them.'' Similar was said by Muqatil and Ar-Rabi`. Al-Hasan and Qatadah said, "Striving against them includes establishing the (Islamic Penal) Law of equality against them.'' In combining these statements, we could say that Allah causes punishment of the disbelievers and hypocrites with all of these methods in various conditions and situations, and Allah knows best. Ibn e Kasir

· Atta’a Said This verse has abolished all orders of pity and forgiveness. Tafsir e Mazhari V-5, P-238


They swear by Allah that they did not say [anything against the Prophet] while they had said the word of disbelief and disbelieved after their [pretense of] Islam and planned that which they were not to attain. And they were not resentful except [for the fact] that Allah and His Messenger had enriched them of His bounty. So if they repent, it is better for them; but if they turn away, Allah will punish them with a painful punishment in this world and the Hereafter. And there will not be for them on earth any protector or helper. Tauba 74

· @The Sandman I have seen all the available tafaseer including Rohul Bayan, Ibne Kasir, Dur e Mansoor, tafsir e ibne abbas, tafsir e saadi, madarik, qurtabi and didn’t found anything closely related to your assertion. Could you provide a reference of Single tafsir by an authentic Ahlus Sunnah or Ahl e Tashiyo Aalim to support your claim? Or in fourteen hundred years this revelation has only come to you that these Ayats are against Death penalty of Blasphemer.

· Bro you need to understand the fact that your opinion, your assertions, your interpretations are of no value in matters of Shariah. Same could be said about me. You need to study a bit about Fundamentals of Tafseer.

· Indeed, Allah confers blessing upon the Prophet, and His angels [ask Him to do so]. O you who have believed, ask [ Allah to confer] blessing upon him and ask [ Allah to grant him] peace. Ahzab

· Word “Yusaloona” is used. If its right to interpret Quran on the basis of your own knowledge then what would be your answer to a person who starts saying that Allah has commanded us to offer prayer on Rasool Allah (Naoz o Billah). Thousands of examples like this could be given.


3. Indeed, those who oppose Allah and His Messenger are abased as those before them were abased. And We have certainly sent down verses of clear evidence. And for the disbelievers is a humiliating punishment. Mujadla 5


Indeed, the ones who oppose Allah and His Messenger - they will be among those most humiliated. Mujadla 20

· “Azaleen” Zaleel

· they are among the miserable, the cast out, banished from goodness; they are the humiliated ones in this life and the Hereafter. Ibn e Kasir

· “They are among most humiliated creatures” Mazhari

Allah has written, "I will surely overcome, I and My messengers." Indeed, Allah is Powerful and Exalted in Might. Mujadla 21

And to Allah belongs [all] honor, and to His Messenger Al Munafeqon 8

· “Ibn e Taimiyah Said their lives have become permissible to be taken” Sarim ul maslool


4. Make not the calling of the Messenger among you as your calling one of another. Allah knows those of you who slip away under shelter. And let those beware who oppose the Messenger's commandment, lest some Fitnah should befall them or a painful torment be inflicted on them. An Nur 63


· Ad-Dahhak said, reporting from Ibn `Abbas: "They used to say, `O Muhammad,' or `O Abu Al-Qasim,' but Allah forbade them to do that, as a sign of respect towards His Prophet , and told them to say, `O Prophet of Allah,' `O Messenger of Allah.''' This was also the view of Mujahid and Sa`id bin Jubayr. Qatadah said: "Allah commanded that His Prophet should be treated with respect and honor, and that he should be a leader.'' Muqatil said concerning the Ayah: "When you address him, do not say, `O Muhammad,' or `O son of `Abdullah'; rather honor him and say, `O Prophet of Allah,' or, `O Messenger of Allah.' Ibn e Kasir

· (or a painful torment be inflicted on them.) means in this world afflicting them with capital punishment, or by law of prescribed punishment, or by confinement in prison, or so on. Imam Ahmad recorded that Abu Hurayrah said, "The Messenger of Allah said: Ibn e Kasir

· Ibne abi hatim, imam razi, mahmood alossi, imam qurtabi, shanqeti, Allama sindhi has said the same thing about this verse

5. O you who have believed, say not [to Allah 's Messenger], "Ra'ina" but say, "Unthurna" and listen. And for the disbelievers is a painful punishment. Baqrah 104
· Ibn e Abbas Said when this Verse is Revealed Muslim agreed that if anyone abuse prophet or his words have the probability of Abuse then he should be punished by death. Dalail un Nabuwa Abu Noaem, Allama shaukani

· Ibn e Umar Narrated, Prophet Said “I was sent with the sword just before the Last Hour, so that Allah is worshiped alone without partners. My sustenance was provided for me from under the shadow of my spear. Those who oppose my command were humiliated and made inferior, and whoever imitates a people, he is one of them.” Imam Ahmad, Ibne Kasir

· It is established from this verse that People should restrain themselves from the words which have the probability of abuse. Our Scholars agreed that “Hadd” will be imposed on the person who is involved in such acts. Ahkam ul Quran ibne Arabi V-1, P- 32

6. O you who have believed, do not raise your voices above the voice of the Prophet or be loud to him in speech like the loudness of some of you to others, lest your deeds become worthless while you perceive not. Indeed, those who lower their voices before the Messenger of Allah - they are the ones whose hearts Allah has tested for righteousness. For them is forgiveness and great reward. Hujarat 2,3
· In these Ayat, Allah the Exalted teaches His faithful servants the good manners they should observe with the Messenger , which are respect, honor and esteem Ibn e Kasir
· “Deeds become worthless when a person has commited Kufr” Ibn e Taimiyah

7. [Remember] when your Lord inspired to the angels, "I am with you, so strengthen those who have believed. I will cast terror into the hearts of those who disbelieved, so strike [them] upon the necks and strike from them every fingertip." Anfal 12

· “I will cast fear, disgrace, and humiliation over those who defied My command and denied My Messenger” Ibn e Kasir


That is because they opposed Allah and His Messenger. And whoever opposes Allah and His Messenger - indeed, Allah is severe in penalty. Anfal 13

8. O you who have believed, whoever of you should revert from his religion - Allah will bring forth [in place of them] a people He will love and who will love Him [who are] humble toward the believers, powerful against the disbelievers; they strive in the cause of Allah and do not fear the blame of a critic. That is the favor of Allah ; He bestows it upon whom He wills. And Allah is all-Encompassing and Knowing. Al Maidah 54

9. And We did not send any messenger except to be obeyed by permission of Allah . And if, when they wronged themselves, they had come to you, [O Muhammad], and asked forgiveness of Allah and the Messenger had asked forgiveness for them, they would have found Allah Accepting of repentance and Merciful. An Nisa 64


But no, by your Lord, they will not [truly] believe until they make you, [O Muhammad], judge concerning that over which they dispute among themselves and then find within themselves no discomfort from what you have judged and submit in [full, willing] submission. An Nisa 65


· In his Tafsir, Al-Hafiz Abu Ishaq Ibrahim bin `Abdur-Rahman bin Ibrahim bin Duhaym recorded that Damrah narrated that two men took their dispute to the Prophet , and he gave a judgment to the benefit of whoever among them had the right. The person who lost the dispute said, "I do not agree.'' The other person asked him, "What do you want then'' He said, "Let us go to Abu Bakr As-Siddiq.'' They went to Abu Bakr and the person who won the dispute said, "We went to the Prophet with our dispute and he issued a decision in my favor.'' Abu Bakr said, "Then the decision is that which the Messenger of Allah issued.'' The person who lost the dispute still rejected the decision and said, "Let us go to `Umar bin Al-Khattab.'' When they went to `Umar, the person who won the dispute said, "We took our dispute to the Prophet and he decided in my favor, but this man refused to submit to the decision.'' `Umar bin Al-Khattab asked the second man and he concurred. `Umar went to his house and emerged from it holding aloft his sword. He struck the head of the man who rejected the Prophet's decision with the sword and killed him. Consequently, Allah revealed this verse Dur e Mansoor, Ibn e Kasir, kamalain

· Allah's messenger didn’t take any notice of the killing and his blood is wasted. Dur e Mansoor, Sarim ul Maslool, kamalain

· This hadees is also narrated by Abul Aswad

· Ahmad bin Hambal has taken evidence from this hadith.

· they adhere to your judgment and thus do not feel any hesitation over your decision, and they submit to it inwardly and outwardly. They submit to the Prophet's decision with total submission without any rejection, denial or dispute. Ibn e Kasir

· Prophet has given no compensation to the slain man's family because of the fact that he has rejected prophets descion.


10. Indeed, the penalty for those who wage war against Allah and His Messenger and strive upon earth [to cause] corruption(Fasad) is none but that they be killed or crucified or that their hands and feet be cut off from opposite sides or that they be exiled from the land. That is for them a disgrace in this world; and for them in the Hereafter is a great punishment, Maidah 33

· Is there any “Fasad” worst than blasphemy of Rasool Allah

Evidence from Hadith:


1. Narrated Jabir bin `Abdullah: Allah's Messenger (ﷺ) said, "Who is willing to kill Ka`b bin Al-Ashraf who has hurt Allah and His Apostle?" (Azallaho wa Rasoloho) Thereupon Muhammad bin Maslama got up saying, "O Allah's Messenger (ﷺ)! Would you like that I kill him?" The Prophet (ﷺ) said, "Yes," Muhammad bin Maslama said, "Then allow me to say a (false) thing (i.e. to deceive Ka`b). "The Prophet (ﷺ) said, "You may say it." Then Muhammad bin Maslama went to Ka`b and said, "That man (i.e. Muhammad demands Sadaqa (i.e. Zakat) from us, and he has troubled us, and I have come to borrow something from you." On that, Ka`b said, "By Allah, you will get tired of him!" Muhammad bin Maslama said, "Now as we have followed him, we do not want to leave him unless and until we see how his end is going to be. Now we want you to lend us a camel load or two of food." (Some difference between narrators about a camel load or two.) Ka`b said, "Yes, (I will lend you), but you should mortgage something to me." Muhammad bin Mas-lama and his companion said, "What do you want?" Ka`b replied, "Mortgage your women to me." They said, "How can we mortgage our women to you and you are the most handsome of the 'Arabs?" Ka`b said, "Then mortgage your sons to me." They said, "How can we mortgage our sons to you? Later they would be abused by the people's saying that so-and-so has been mortgaged for a camel load of food. That would cause us great disgrace, but we will mortgage our arms to you." Muhammad bin Maslama and his companion promised Ka`b that Muhammad would return to him. He came to Ka`b at night along with Ka`b's foster brother, Abu Na'ila. Ka`b invited them to come into his fort, and then he went down to them. His wife asked him, "Where are you going at this time?" Ka`b replied, "None but Muhammad bin Maslama and my (foster) brother Abu Na'ila have come." His wife said, "I hear a voice as if dropping blood is from him, Ka`b said. "They are none but my brother Muhammad bin Maslama and my foster brother Abu Naila. A generous man should respond to a call at night even if invited to be killed." Muhammad bin Maslama went with two men. (Some narrators mention the men as 'Abu bin Jabr. Al Harith bin Aus and `Abbad bin Bishr). So Muhammad bin Maslama went in together with two men, and sail to them, "When Ka`b comes, I will touch his hair and smell it, and when you see that I have got hold of his head, strip him. I will let you smell his head." Ka`b bin Al-Ashraf came down to them wrapped in his clothes, and diffusing perfume. Muhammad bin Maslama said. " have never smelt a better scent than this. Ka`b replied. "I have got the best 'Arab women who know how to use the high class of perfume." Muhammad bin Maslama requested Ka`b "Will you allow me to smell your head?" Ka`b said, "Yes." Muhammad smelt it and made his companions smell it as well. Then he requested Ka`b again, "Will you let me (smell your head)?" Ka`b said, "Yes." When Muhammad got a strong hold of him, he said (to his companions), "Get at him!" So they killed him and went to the Prophet (ﷺ) and informed him. (Abu Rafi`) was killed after Ka`b bin Al-Ashraf." Bukhari H-4037 or Book-64, H-84, Muslim H-1801

· Imam Shafi has taken the evidence from this Hades that “A non-muslim(Zimi) who abuses prophet should be killed as his agreement is nullified due to the act of Blasphemy”

· This Hadees is Absolute evidence (Nas e Qatai) of the punishment of Blasphemer.

· “Ka’ab bin Ashraf was in agreement with Holy Prophet and he regularly abuses holy prophet” Imam Muhammad bin Ishaq



2. Narrated Al-Bara bin Azib: Allah's Messenger (ﷺ) sent some men from the Ansar to ((kill) Abu Rafi`, the Jew, and appointed `Abdullah bin Atik as their leader. Abu Rafi` used to hurt Allah's Messenger (ﷺ) and help his enemies against him. He lived in his castle in the land of Hijaz. When those men approached (the castle) after the sun had set and the people had brought back their livestock to their homes. `Abdullah (bin Atik) said to his companions, "Sit down at your places. I am going, and I will try to play a trick on the gate-keeper so that I may enter (the castle)." So `Abdullah proceeded towards the castle, and when he approached the gate, he covered himself with his clothes, pretending to answer the call of nature. The people had gone in, and the gate-keeper (considered `Abdullah as one of the castle's servants) addressing him saying, "O Allah's Servant! Enter if you wish, for I want to close the gate." `Abdullah added in his story, "So I went in (the castle) and hid myself. When the people got inside, the gate-keeper closed the gate and hung the keys on a fixed wooden peg. I got up and took the keys and opened the gate. Some people were staying late at night with Abu Rafi` for a pleasant night chat in a room of his. When his companions of nightly entertainment went away, I ascended to him, and whenever I opened a door, I closed it from inside. I said to myself, 'Should these people discover my presence, they will not be able to catch me till I have killed him.' So I reached him and found him sleeping in a dark house amidst his family, I could not recognize his location in the house. So I shouted, 'O Abu Rafi`!' Abu Rafi` said, 'Who is it?' I proceeded towards the source of the voice and hit him with the sword, and because of my perplexity, I could not kill him. He cried loudly, and I came out of the house and waited for a while, and then went to him again and said, 'What is this voice, O Abu Rafi`?' He said, 'Woe to your mother! A man in my house has hit me with a sword! I again hit him severely but I did not kill him. Then I drove the point of the sword into his belly (and pressed it through) till it touched his back, and I realized that I have killed him. I then opened the doors one by one till I reached the staircase, and thinking that I had reached the ground, I stepped out and fell down and got my leg broken in a moonlit night. I tied my leg with a turban and proceeded on till I sat at the gate, and said, 'I will not go out tonight till I know that I have killed him.' So, when (early in the morning) the cock crowed, the announcer of the casualty stood on the wall saying, 'I announce the death of Abu Rafi`, the merchant of Hijaz. Thereupon I went to my companions and said, 'Let us save ourselves, for Allah has killed Abu Rafi`,' So I (along with my companions proceeded and) went to the Prophet (ﷺ) and described the whole story to him. "He said, 'Stretch out your (broken) leg. I stretched it out and he rubbed it and it became All right as if I had never had any ailment whatsoever." Bukhari H-4039 Ordered to kill shatim e rasool


3. Chapter: The ruling regarding one who reviles the prophet (pbuh)



Narrated Abdullah Ibn Abbas:A blind man had a slave-mother who used to abuse the Prophet (ﷺ) and disparage him. He forbade her but she did not stop. He rebuked her but she did not give up her habit. One night she began to slander the Prophet (ﷺ) and abuse him. So he took a dagger, placed it on her belly, pressed it, and killed her. A child who came between her legs was smeared with the blood that was there. When the morning came, the Prophet (ﷺ) was informed about it.

He assembled the people and said: I adjure by Allah the man who has done this action and I adjure him by my right to him that he should stand up. Jumping over the necks of the people and trembling the man stood up.

He sat before the Prophet (ﷺ) and said: Messenger of Allah! I am her master; she used to abuse you and disparage you. I forbade her, but she did not stop, and I rebuked her, but she did not abandon her habit. I have two sons like pearls from her, and she was my companion. Last night she began to abuse and disparage you. So I took a dagger, put it on her belly and pressed it till I killed her.

Thereupon the Prophet (ﷺ) said: Oh be witness, no retaliation is payable for her blood.Sunan Abi Daood H-4361, Nisai, Sunan Ibne Ba’ata

· It is established from the heading of Imam Abu Dawood that he agrees to the content of Hadees. Furthermore, he brings this Hadees in the Book of Hadood (Kitab ul Hadood)

· Rasool Allah owned the killing by saying that no retaliation is payable for her blood.

· “Imam Ahmad bin Hanbal took the evidence from this hadees that Punishment of blasphemer is death” Ibn e Taimiayah

· “This hadees is authentic” Albani

· Khatabi Said its evident from this hadees the person who abuses prophet should be killed

4. Narrated Ali ibn AbuTalib:A Jewess used to abuse the Prophet (ﷺ) and disparage him. A man strangled her till she died. The Messenger of Allah (ﷺ) declared that no recompense was payable for her blood. Sunan Abi Daood 4362, Nisai V-7 P-110, Nail ul Autar Imam shaukani 379, Imam Shuabi

· This hadees and previous one is evidence of the fact that Death sentence will be equally carried out on Muslim and non-Muslim

5. Narrated AbuBakr: AbuBarzah said: I was with AbuBakr. He became angry at a man and uttered hot words. I said: Do you permit me, Caliph of the Messenger of Allah (ﷺ), that I cut off his neck? These words of mine removed his anger; he stood and went in. He then sent for me and said: What did you say just now? I said: (I had said Permit me that I cut off his neck. He said: Would you do it if I ordered you? I said: Yes. He said: No, I swear by Allah, this is not allowed for any man after Muhammad (ﷺ). Abu Dawud said: This is Yazid's version. Ahmad bin Hanbal said: That is, Abu Bakr has no powers to slay a man except for three reasons which the Messenger of Allah (ﷺ) had mentioned: disbelief after belief, fornication after marriage, or killing a man without (murdering) any man by him. The Prophet (ﷺ) had powers to kill. Nisai, V-2, P-153, Abu daood 4363

At the conquest of Makkah: Holy prophet Mohammad (S.A.W) announced general amnesty to all except those who were guilty of blasphemous acts and sacrilegious statements, Ibn e Khatal was one of the convict (Tareekh-e-Tabari Page 104 / History written by Al Tabari) This is evident from the following Hadith. Narrated Anas bin Malikl:On the day of the Conquest, the Prophet entered Mecca, wearing a helmet on his head. When he took it off, a man came and said, “Ibn e Khatal is clinging to the curtain of the Ka’ba.” The Prophet said, “Kill him.”Sahih Bukhari Volume 5, Book 59, Number 582:

7. Uqba Bin Abi Muait and Nazar Bin haris are among prisoners of Badar. Both were killed due to their attitude towards prophet. Ibn e Taimiyah.



8. Ibne Umar Said “Punishment of Blasphemer of Rasool Allah is death” Imam Ahmad, Ibn e Taimiyah



Scholars have written several accounts of Blasphemers in their history books but I have skipped all of them because Sahih Ahadees are present and there is no need to mention historic records.

Evidence from Ijma e Ummat:

Ijma has been observed regarding the punishment of a person whose blasphemy has been established. I have not seen any second opinion regarding this issue.

Abu Sulaiman Khatabai said: I don’t know a single Muslim who had argued against the punishment of death to the blasphemer. Al Shifa
Ibne Munzar Said: “Ijma has been recorded from Islamic Scholars regarding the punishment of death of a person who has committed blasphemy against Rasool Allah.”

Ibn e Munzar, Abu bakar Farsi, Qazi Ayaz, Ibn e Taimiyah, Imam khatabi, Imam Ishaq bin Rahwae

I have seen many individuals quoting those Ahadees in which Rasool Allah has forgiven the Blasphemer. I don’t know why these people don’t understand a simple point. The authority to forgive a Blasphemer rests with the prophet. No one can take his place. It is his prerogative to forgive.

Guys from bottom of my heart I defend blasphemy law but I think it should not be discussed on open forum like this due to following reasons :

  1. Discussion means everyone has right to say anything which he has in his mind ,, there will be people with no understanding of Islam will start giving arguments ...
  2. There might be person doing blasphamey here now ...
  3. Devine law is law it can't be changed ...
  4. I can bet there is not a single person qualified to discuss its implementation plus minus ...
  5. Discussing here means creating doubts in the mind of people who do not have appropriate level of understanding of Islam ...
I request mods to delete this thread or restrict posting of this thread to knowledgeable persons only ...

Many of the members here say that Blasphemy is not a punishable offense in Islam, also one of the Senior moderator claims that religious people are incapable of a logical debate and never provide strong arguments to support their claim. So, this is a great effort. I myself was writing a thread on the similar topic with reference taken from Quran Ahadith and Islamic history but could not complete it, So hats off to you bro @Gillani88 .
Now, if there are people on the forum who can claim that Blasphemy must not be punished and they provide arguments and they are provided freedom by the mods than this thread should also be allowed freely.
 
Did you just try and do a half hearted copy and paste job of the verse from the Holy Qur'an and try to claim it establishes the death sentence for blasphemy? Nice job, you left the start of the verse here, missed the next few verses and jumped to the conclusion of the Ulama. Why don't you put the verses further along from that verse and then show me you how you claim to the conclusion that verse demands what you believe it to?
 
Prophet Muhammad (P.B.U.H) personally encouraged and ordered killing of blasphemer Kaab bin Ashraf... it is in Bukhari

He replied in the affirmative. So, Muhammad bin Maslama went to him (i.e. Ka'b) and said, "This person (i.e. the Prophet) has put us to task and asked us for charity." Ka'b replied, "By Allah, you will get tired of him." Muhammad said to him, "We have followed him, so we dislike to leave him till we see the end of his affair." Muhammad bin Maslama went on talking to him in this way till he got the chance to kill him.

It is mentioned in Kashaf Al Bari that Ka'ab wrote insulting poems.

Are you sure it had nothing to do with him breaking the covenent as a tribal leader that he signed with Muslims, or the pact that he formed with the Qur'aish to attack Muslims from behind? His punishment was for treason.

Abi Raafe used to hurt the Apostle of ALLAH in two ways; he used to financially assist the enemies as well as speaking ill. So, Prophet PBUH sent people to execute him.

Nothing you have posted suggested he was murdered for blashpmey, nothing in the Holy Qur'an suggests such a punishment. Unless of course you mean his words can hurt Allah Ta'ala or Rasool (saw)?

Do you know his back ground? He was one of the tribal leaders who signed the Medina pack with the Muslims and then broke it, he also secretly planned to join forces with the Quraish to attack the Muslims.

He (saw) NEVER retaliated for personal insults, or he (saw) would have surely ordered several others to death including the chief of the hypcorites Abdullah bin Ubay, you have forgotten what he said about the Rasool (saw)? His own son asked permission to kill him, but he refused, and even led Janaza for him. And Hazrat Omer (ra) even asked permission to kill him and so did many other muslims? Why do you guys pick and choose which examples you want to use and even then hide the other parts of the background?

The friend above who did not post the full verse from the Holy Qur'an may need a reminder as well:

Verily, those who annoy Allah and His Messenger—Allah has cursed them in this world and in the Hereafter, and has prepared for them an abasing punishment. And those who malign believing men and believing women for what they have not earned shall bear the guilt of calumny and a manifest sin. (Ch.33:Vs.58-59)

Where does it state kill them? Allah is saying he will curse them himself and will look to them.

Despite the ill-treatment and disrespect shown to both the Holy Prophet(saw) and the Holy Qur’an, God instructed him not to retaliate, because, says God: “We will, surely, suffice thee against those who mock” (Ch.15:V.96). In other words, God Himself is sufficient to deal with those who commit blasphemy against Him, the Holy Prophet(saw) or the Holy Qur’an and He does not allow anyone else to mete out punishment in this regard. The Holy Prophet(saw) was advised by God to remain patient and to …follow not the disbelievers and hypocrites, and leave alone their annoyance, and put thy trust in Allah; for Allah is sufficient as a Guardian (Ch.33:V.49).

The Holy Qur’an gives clear guidance on how Muslims should behave when they are faced with those committing blasphemy. Instead of punishing the blasphemers, believers are advised to leave the company of such people until they change the topic of their conversation. Allah says:

when you hear the Signs of Allah being denied and mocked at, sit not with them until they engage in a talk other than that; for in that case you would be like them… (Ch.4:V.141).

A true Muslim, therefore, along with invoking Durud (sending salutations upon the Holy Prophet(saw)), should strive to follow the example set by the Holy Prophet(saw). He should obey all the injunctions given by God, and endeavour to lead every moment of his life in the way the Prophet(saw) did. When a Muslim adopts this approach, his Durud will emanate from his heart, and he will become a paragon of virtue and high moral standards. This is how the honour of the Holy Prophet(saw) can truly be upheld, rather than by holding rallies and burning tyres and killing those who insult.

To silence others, a Muslim follows the example of the Holy Prophet (saw), and thereby does not give an opportunity for anyone to raise objections against Islam or hurl abuse against it. Instead, his excellent behaviour would lead people, even the opponents of Islam, to stand up and take notice, and praise the teachings of Islam and the person of the Holy Prophet(saw) for inspiring such excellent conduct.
