They are going to go for death penalty, but whether or not they will have one is another issue

It wasn't like in the 60s and 70s, where the court will hand out death sentence like candy, today, a lot of issue have to be considered in order to justify a death sentence.

This case somehow remind me of a case about a Latino Gang member killed a 9 years old girl during drive by in California, he was sentenced to death and then get a retrial, and then he was convicted again and sentence to life with parole.
