Jirga system will not deliver results in Pakistan. This system is in practice in some parts of the country and there are cases in which this system is responsible for extremely bad judgements. I do not recommend this system.

I however agree that Pakistan needs to get rid of British colonial era justice system and create a new justice system. However, Pakistan need to revisit is political system as well. No system will deliver results in a corrupt environment and under the shadow of dynasty politics - if the tradition of bringing wrong people to power continue.

The problems is lack of oversight and accountability. If an Islamic judicial system is to be established, it must start from grassroots and work itself all the way up to the Mufti.

A Qazi should be held accountable for all judgements, and can himself face strict punishment if corruption or favoritism is revealed.

Number one is the objective of the Islamic and British/Western systems are totally different.

Islamic system obliges the Qazi to use everything at his disposal to ascertain the truth and judge fairly based on Quran, Sunnah, Ijma e Ulema, and law of the state. In this way justice is quick, affordable, and simple for all. Qazi's judgements are monitored by his direct superior, who in turn is monitored by a superior all the way up.

Western system is a cumbersome system which delays verdicts for days, requires juries, procedure in court, and heavy legal fees. The aim to is impartially carry out the letter of the law. No space is given if evidence arrives late, or if the court needs to convene elsewhere outside the courtroom. Otherwise a re-trial is needed, adding to more time wasted and more fees.

Pakistani justice and political system have failed and have become enemies of the people of Pakistan. It is time to throw t all out and start fresh.

What goes Around Comes Around.
Well the judges and lawyers involved in his release are 100% responsible. If they didn't this s.o.b would not not been able to commit the crime.

Maybe other scum lawyers and judges would think 10 times before releasing a convicted rapist.
And who will rape the mothers and sisters of those alleged rapists to execute the punishment?? And after the punishment there will be one more rapist fully supported by law. Are we eliminating rapists or promoting more rapists? And does that mean we should amend our constitutional law and legal framework to give rise to legal rapists lol?
Guys come on I know just like me you are very angry but that's not how things work.
Though personally I fully support the amendment of ppc(Pakistan penal code) to cut the penises of rapists or to hang them publicly.

I sincerely hope that the lashes that you have mentioned are not as depicted above. The purpose of the punishment is public (require gathering) admonishment of the nature of crime (once the punishment has been served, the weight of the crime should not hang over the perpetrator) and never to kill/maim that person. There are so many issues that have to be addressed in between as well.

Rapists should be executed, because the crime falls under fisad al ard, regardless of his marital status.

Whippings are for zina (fornication) and that is not a capital crime if the consenting couple is unmarried.

After the punishment and taubah, those individuals (fornicators) are cleansed of sin. There are famous ahadith about it.

Once a married female who committed zina bore a child and she came to receive her punishment, and Prophet Muhammad saws pretended not to hear. He kept giving her chances to back down, but she was honest with him. He delayed the punishment until after her child was born, then again when the child was weaning, and eventually she kept coming back for her punishment as per fiqh. When she was executed, the blood of her got on a Sahabah who uttered something about the unclean blood.

Prophet Muhammad saws said to that man, you do not know that Allah swt has forgiven her and she is now a person of Jannat.

Note, here I am speaking about Zina, and not Rape. Rape is a terrible crime as a human being's sanctity and honor is tarnished against their will.

Any change in judiciary requires passing major laws, that would need to be ratified by senate. The Senate is controlled by the very people whom the law would affect.

Back in 2016, Child S abuse was criminalized in Pakistan, and the punishment was increased to 7 years. This was in 2016. Just now, March 2020, the punishment was increased to death or life in prison.

You can see how slow and outdated our politicians are when it comes to updating criminal law. Both time it took for a major event to happen, before any law was updated.



Back in 2016, PPP objected to execution. Again they objected in 2020. And now they are again objecting to it. If we want any law to pass, we need to first get rid of these politicians.

Its not necessary to stone or whip. Even a peaceful death (by inducing coma) is fine. Those punishment are in perfect system and of a maximum threshold. So like we cannot burn the culprit.
Plus DNA/finger prints are good evidence but can be planted, else enough for punishment. A authentic video/witness, cannot be refuted.

How are they in perfect system? The purpose of the justice system is correctional/reformation. If you kill that person no matter how "humanely" (you are discounting that fact that people who undergo death through lethal injection have typically resigned to the fact whether the were right/wrong/mentally challenged and therefore you do not see them struggle -which you think of as humane), you fail at correcting the person.

Any judgement should be cognizant of how the action came to be. People are not born criminal/rapist but are shaped by the society that they live in. We live in a society that goes by "Live and Let Live" policy and in doing so are not mindful of the externalities that we create. One personality may have stronger constitution and able to indulge with moderation but that might not be the same of the other, who due to lack of constitution -even from no fault of his own, is unable to moderate himself. Why should one be punished and the other remain free? Take this in context of alcohol consumption ("lowers your inhibition" colloquially referred to as beer googles) to understand why Islam forbids it. There is a small debate by Mathew Perry (Chandler) which is worth a watch as well

It is the planned destabilization which Indians like Gaurav were talking about. Most of these abductors, rapists, and thieves are connected with drug mafia and ransom mafia. It is not inconceivable to fathom that outside powers may be pushing them to commit more violent crimes.

FIA needs to get to the bottom of this and reveal their findings. I would not doubt another Kulbushan Yadav behind these incidents.

About the sectarian angle, there are rallies going on against the 'scholar' who abused Sahabah publicly with abusive language. All these issues are converging.

We also have the case of Noorani trying to create a witchhunt against Gen Bajwa, with the main target being CPEC.

We should be alert.

I don't buy the story of rapist running away in fields with his wife. Encounter is on the cards, just wait few days.
