I don't care if it is common or is 'Muslim'. The rapist earning the right to get married to his victim by his evil act is disgusting and sick. I just hope such crap does not also exist in Pakistani law. Hoping the British influence effaced such mediavalism.

This law is not Islamic. Marry your rapist may be a punishment for the rapist but it is twice more punishment for the women to call a rapist (who she possibly hated the most on the planet) her husband.

Islam would punish the rapist but would not put any conditions on the victim.

Your ignoring the reality of the pressure that would be brought on the victim to agree in order to save the life of the animal. This is profoundly unfair and places even greater burden and stress on the victim. All men need to think that females are their mothers, sisters, daughters and only a biological accident separated them from being born a female.

actually this law is common among Muslim nations including Iran and Arab countries the Islamic law does not prevent two person from getting married so they are free the girl is free to marry the rapist if she dose not marry him the guy will get executed if the girl decide to marry him he will get the punishment but he will not get executed this is not new, the rapist will not go free he will just get a reduce sentence plus that he has to obey every reasonable request that the girl or her family place before the wedding, so here Turkey is just trying to join the club nothing more.

It means a Sharia law, right? Which allow child marriage and protect the rapist from judgement. But, what has the victim from this law? Why should a child-victim marriage her rapist?

It's outright stupid.

A few clarifications though...

1. It is not a law that allows rapists to avoid punishment. Non consensual sex is still considered a crime.
2. The law is aimed at reducing the number of people in prison for statutory rape (ie having sexual relations with someone below the age of consent (18 in Turkey). This scenario could include teenagers who are prosecuted for having sex with thier girlfriends. It limits the age gap at 10 years.

It's still ridiculous and stupid. Why?

1. I don't know if there is a lower limit. What happens if a 19 year old wants to marry a 9 year old? That's sick and unacceptable.
2. It would be simpler to reduce the age of consent.

1) Who will marry and take care of the girl for the rest of the life after she has lost her virginity

2) The bad name that the family gets and ostracisation of the girl's family by the society

3) Who will marry the siblings of the girl

The loopholes have been getting closed up. It's a horrible law. Not Islamic at all.

Rape equates to a death sentence, nothing less. This law will basically give an incentive to rapists and that is stupid.

More stupid is the fact that the difference can be upto of 10 years... meaning it legalizes child marriage if the victim is a minor. Moreover, this legalizes martal rape, no?

Even more stupid is that the AKP claims this law is to stop the injustice of child marriages.

If a married person rapes some other woman, that is just simple adultery and the man is to be stoned to death.
If the person is unmarried and involves himself in sexual activities outside of marriage it is called 'zina' which is punishable by 100 lashes and deportation for both the persons involved.

I dont know what is the law on rape however. In Islamic jurisprudence it is difficult to produce evidence of rape as there is requirement of witness. The procedure is difficult because a false allegation can cost someone's life.

With modern technology it is getting easy to prove the act itself, but there is no way to prove that the two unmarried persons were involved with consent or not. Here the application of law becomes tricky. If there was no consent, and it was a forced act, then the person is to be flogged with 100 lashes and deported and the woman shall be excused (according to a hadith). In Quran, Allah the almighty says that a fornicator shall not marry anyone but another fornicator. But in the case of rape, the act of fornication was not committed by the victim but the actual perpetrator. Hence I think that the victim is allowed to marry a chaste man in her life and not forced to marry the person who raped her.
