What's new

There will be no voting tomorrow, Speaker will exercise his powers - Arshad Sharif

It's unofficial martial law right now with Bajwa calling the shots.

And we should fully support Imran Khan on this Bajwa is an as*hole. Generals like him have ruined the reputation of Pakistan army. If people start hating its army, our defence is badly expected.

Also, SC has no right to dictate parliament. Just like parliament cant dictate SC on how it should run its everyday business.

IK is taking the road not previously taken as far as Pak is concerned....

It's the time to panic for the US policymakers! It might be one such rare moments when the "neutrals" might ask for "do more" instead of always being asked so! I am pretty sure they're enjoying the game...

Pakistan and the governments lawyers are asleep? If this is the case how on earth did the supreme court have a view?

No one has violated any constitution from Government of Pakistan side

The Speaker / President / Prime Minister can say No any time !
This is "their Right"

Speaker of Assembly has right , to Say No also Prime Minister can say Yes
Prime Minister of Pakistan has right to Say No also can say Yes
President of Pakistan has right to say No also can say Yes

Valid Reason for Rejection (Constitutionally valid reason for saying no!)
  • Emergency
  • External Threat
  • Recent Missile Launch
  • If PTI Party members , join other party without resigning to vote against party

A Speakers can reject a Petition Until he is satisfied !! This is his right given to him by Oath taking and constitution

1- TV is running a media circus , and Supreme Court is simply running around in circle

2- When they have no power , claiming that they need to enforce something

Private TV channels are running the story , as they wish because they want majority of Pakistani to be confused

You say that no one violated the constitution whereas the Deputy Speaker violated the constitution when he arbitrarily refused to follow the process and call for vote of no confidence; which incidentally was not called precisely because Imran Khan was about to lose his Premiership. Now just imagine for a moment if this was all done by Nawaz Sharif.....hard to even imagine for you, right? But I have a fair idea of what you would be calling for if that were the case.

If there was indeed a conspiracy then it should have been investigated by the agencies and the LEA's! Is the deputy speaker even a competent authority to hand out sentencing and that too without even an investigation? Does the LAW give the speaker/DS the mandate to brand anyone a traitor? matter should have been taken to courts to decide. Only the courts can decide who is a traitor and only the courts can hand out sentencing.

If Article 69 was indeed this absolute then the Government's own highest law officer, the Attorney General, would have defended the Deputy Speaker's Action. Whereas, the AG clearly stated that he could not defend the actions of the DS which also imply how unconstitutional they were.

Also, how can any one have absolute powers without check and balance? What the DS did was unconstitutional and the whole world knows it; there was no investigation on the matter and the DS arbitrarily decided to brand 197 members of the Parliament as traitors! What gave him the right or authority to do that?

Matter of fact, if Article 69 is indeed absolute then the entire process of vote of no-confidence is rendered useless as the Speaker and DS are always from the Treasury and they would never allow voting against their own party.

Finally, let me ask you this, who will defend the constitution and law within the Parliament if the Treasury/Speaker/DS etc., violate it?

Hey patwari, Mubarak ho failed state banana Republic.
Please come out of the black and white mindset. Not everyone who is opposed to PTI and Imran Khan is a Patwari or Jiyala or anything else.

The rest of your comment notwithstanding, just a clarification here.

As you have said in the post yourself, the the AG represents the state of Pakistan (commonly regarded as the government), NOT the legislature or the Dy Speaker.

In the constitution, the govt and the speaker are two different entities.

What the AG meant by this was that he is not here to defend (replace defend with represent) the speaker, since the speaker has his own lawyer. He is here to represent the state and aid the court, not represent the speaker.
I saw an interview of the AG on GEO where Hamid Mir asked him whether the Speaker could defer the Vote on No Confidence by any means and the AG very clearly stated that the Speaker does not enjoy absolute powers and will have to (emphasis on "have to") call the vote of no-confidence. Furthermore, the AG also stated in the Supreme Court that the proceedings of Parliament, even with protection of Article 63, can still be reviewed by the Supreme Court.

It is clear that the DS over-reached his position and violated the constitution of Pakistan. And therefore the only way to correct this gross violation is to take the matter to the highest law forum of Pakistan, the Supreme Court.

I ain't even debating any of that mate.

But your post made it seem as if he said I would not support the Dy Speakers move, while that was not the case with this statement, that's all.

Biden probably put the condition, free education for your children and free shopping for your wife if you can topple PTI government. Bajwa is worried if his children will get free education in USA or not.
