Justice Umar Ata Bandial asked Masoodur Rehman Abbasi who had told him that the chief justice was "sector in-charge of a political party" in a Supreme Court hearing on Friday.



The Supreme Court (SC) on Friday rejected PPP's Masoodur Rehman Abbasi's apology for his disrespectful outburst against Chief Justice of Pakistan (CJP) Gulzar Ahmed.

The four-judge bench, headed by Justice Umar Ata Bandial, said it would frame charges against Abbasi in the next hearing, a date for which would be fixed later.

The court also appointed the attorney general as the prosecutor in the case.

Abbasi, an office-bearer of the PPP’s Karachi chapter, is facing contempt of court charges for uttering derogatory remarks against the CJP at a public gathering. In a video and audio clip circulated on social media websites, the PPP leader could be seen making indecent and disrespectful remarks about the judiciary.

He was subsequently issued a contempt notice by the apex court on June 22.

During a hearing on Monday, Abbasi told the court he was not in his “senses” when he made the remarks. Consequently, he was arrested by the Federal Investigation Agency (FIA) on Wednesday and the next day was sent on a four-day remand with the agency until July 4.

In today's hearing, Abbasi said he was the sole earner for two wives and seven children and requested relief from the court. He said in a written apology that he respected all courts and that he was troubled due to his mother's death and some domestic squabbles.

"Due to my troubles I don't know what I uttered. Judges are like fathers for me," said the PPP leader as he pleaded forgiveness, adding that he was ready to apologise in whatever manner the court ordered.

To this, Justice Ijazul Ahsan recalled that in the video Abbasi had said if the court summoned him, he would "show the court its status".

"Now that you have been summoned, show us our status," Justice Ahsan said, telling Abbasi that he should have considered his circumstances before uttering "such big statements".

"What does the chief justice have to do with the atom bomb and missile [technology]? This way anyone can apologise after making insulting statements."

Justice Bandial asked Abbasi who had told him that the chief justice was "sector in-charge of a political party" to which the latter replied that no one had told him and he had said so himself.

The bench said that the FIA investigation would reveal the reason for his speech and told him to maintain his dignity, adding that the court would take a decision in accordance with the law.

An FIA official present in court told the bench that Abbasi was being interrogated and his remand had been obtained from a sessions court. "We will not take a soft approach towards whoever is behind Abbasi," he added.

The court said it would review similar cases of PML-N's Nehal Hashmi, Daniyal Aziz, Talal Chaudhry and others.

Land mafia threatened MPA of removal and govt acted on it

ISLAMABAD: In August 2019, Prime Minister Imran Khan assigned a task to one of his MPAs from Rawalpindi, Chaudhry Muhammad Adnan. He was then Parliamentary Secretary (Revenue). Identification and recovery of grabbed state land was his task.

In November 2020, Adnan wrote to the PM saying the land mafia threatened him that he would be de-notified if he continued working against them. Before this letter, he had also informed the Punjab chief minister about this threat. In December 2020, just a month after his letter to the PM, the land mafia’s threat was translated into reality. Adnan’s revenue portfolio was de-notified.
What happened in-between is a history which spells out the power of the mafia in its pronounced form. While the land worth more than Rs325 billion which he identified remained in the possession of its grabbers, the officers who went after them were made a horrible example. They were transferred to far-flung areas.

This is despite the fact that the action was taken against the grabbers on the directions of the Chief Minister Office. Who from within the government acted on behalf of the mafia remained a mystery as fingers are pointed towards the influential members of the present administration.
Adnan mentioned in the letter addressed to PM that he identified “thousands of kanals of encroached state land worth around Rs325 billion in Mouza Kotha Kalan and Mouza Topi and benami properties in Rawalpindi.” The grabbers he exposed didn’t belong only to the opposition parties, PTI politicians were also included. One of them is also a member of Rawalpindi Development Authority from where NoCs were issued on the basis of forged records.

He named all of them and shared revenue records to prove that it was the state land under their occupation. While action was taken to some extent against a PML-N senator, those affiliated with PTI were left untouched.

Right in the middle of his letter to the PM, Adnan mentions the power of the mafia. “The land mafia is so strong that whoever takes action against them gets transferred such as an operation to retrieve state land in Mouza Kotha Kalan was carried out on 05-June-2020 after the FIRs were lodged against illegal encroachers… the next day they again illegally encroached the state land and the Deputy Commissioner Rawalpindi, ADC (R) Rawalpindi, Assistant Commissioner (Saddar) and Tehsildar Rawalpindi got transferred.”

Another failed attempt to vacate the encroached land was also pointed out in the letter. In August 2020, the Senior Member Board of Revenue (SMBR) ordered the retrieval of all those state lands which were mentioned in Adnan’s letter to the SMBR.

No action was taken; instead, the tehsildar who prepared all the reports of encroachments on state land got transferred. He also reminded the PM why the bureaucracy is hesitant to translate his (PM) orders into actions.

In the meeting of Good Governance Council Punjab held three days after SMBR’s order fell flat, the PM reiterated his order for the recovery of encroached land “without taking any pressure” but no department took any action.

Why? Adnan explained to PM in his letter: “If someone takes action against the land mafia, they take relief from courts therefore laws should be made so that land mafia would not be able to take relief from the courts for encroaching/ selling state land.”

He shared the list of encroached land and illegalities of the housing societies alongside the motorway and Chakri Road Rawalpindi but, he wrote in the latter, no action was taken. Instead, he received threats from the land mafia about which he informed the chief minister of Punjab. To the CM, he also informed that the mafia had warned him that his revenue portfolio would be de-notified if he continued exposing them.

If the land mafia is so strong that nobody can take action against them, then Adnan suggested to the PM in the letter that he was ready to tender resignation from the post of parliamentary secretary (revenue). While no action was taken against the mafia, Adnan’ last prayer was answered. The CM de-notified him from the revenue office, something he had shared with him as a warning from the mafia.

The National Bank of Pakistan’s (NBP) staff union on Thursday filed a plea in the Islamabad High Court (IHC) for initiating contempt of court proceedings against Information and Broadcasting Minister Fawad Chaudhry for criticising the court’s verdict in a tweet.

Justice Mohsin Akhtar Kayani will take up the plea on Friday (today).

In a tweet earlier this week, the minister said the country would never be able to come out of its economic crisis unless judicial reforms were introduced.

"My head is spinning after reading about the decision to ban TikTok and remove the NBP president. What are our courts doing? The country has already suffered losses worth billions of dollars due to judicial activism," Fawad added.

Supreme Court to indict PPP leader over derogatory speech against CJP



ISLAMABAD: The Supreme Court (SC) will indict Masood-ur-Rehman, an activist of Pakistan People’s Party and the alleged contemnor, over his derogatory speech against Chief Justice Gulzar Ahmed.

A four-member larger bench of the apex court, headed by Justice Umar Ata Bandial, heard the contempt of court proceedings against the PPP activist. The court appointed Attorney General Khalid Javed to prosecute the alleged contemnor and adjourned the hearing for framing the charge.

In pursuance of court’s earlier order, Masood-ur-Rehman submitted a hand-written reply in the contempt matter. The court, however, expressed dissatisfaction over the reply and observed that the instant reply was not sufficient.

“If you want to tender an apology, it has to be submitted as per the required standard,” Justice Bandial told the alleged contemnor. Additional Attorney General Sohail Mahmood submitted that before proceeding in the matter, the court may charge the alleged contemnor on that date or subsequent date after receiving the evidence.

The court then decided to indict the alleged contemnor and appointed Attorney General as prosecutor for framing the charge against the alleged contemnor. Earlier, at the outset of hearing, Masood submitted that he was tendering an apology, saying he respected the judiciary as well as all the institutions.

Justice Mazahir Ali Akbar Naqvi asked the alleged contemnor as to why he made a derogatory speech and on whose directions. The judge asked the FIA to investigate that on whose directions the alleged contemnor made a speech. “Such a speech cannot be made without planning,” Justice Mazahir Naqvi observed.

The FIA submitted that the alleged contemnor was being interrogated and his physical remand had been granted by the court. The FIA assured the court that whosoever found guilty of provoking the alleged contemnor for making such a speech, would not be spared.

“I seek apology,” Masood-ur-Rehman pleaded, adding that he was ready to tender an apology.

Justice Bandial observed that the court would proceed in accordance with the law. Justice Bandial asked Masood about other people, present at the venue during the speech. The function was held at a wedding hall wherein all the district office-bearers of the party were present.

“You termed the Chief Justice a sector in-charge of a political party. Who guided you to make such a statement,” Justice Bandial asked the alleged contemnor. “Nobody guided me and I made the speech on my own,” Masood replied.

Meanwhile, the court adjourned the hearing for date-in-office and decided that the alleged contemnor would be indicted for which the court appointed Attorney General as prosecutor for framing the charge against Masood-ur-Rehman.

The FIA had told the Supreme Court that the audio and video in which Masood-ur-Rehman, General Secretary PPP Sindh, made indecent and disrespectful remarks about the chief justice of Pakistan was genuine and no editing was made in the video/audio.
