QUETTA: A bench of the Supreme Court of Pakistan on Wednesday hearing an appeal moved by former president retired Gen Pervez Musharraf granted bail to the ex-army strongman, DawnNews reported.

A two-judge bench of the apex court, headed by Justice Nasirul Mulk, heard Musharraf's appeal against the Balochistan High Court’s rejection of his bail application in the Nawab Akbar Bugti murder case.

The bench observed that substantial evidence was not available to involve Musharraf in the criminal conspiracy regarding Bugti’s murder and granted bail to the former president.

Musharaf was also ordered by the Supreme Court to pay two bail bonds of Rs 1 million each.

Though the court had summoned Jamil Bugti, a son of Nawab Akbar Bugti, who is a complainant in the case, he remained absent from today’s hearing.

Musharaf's counsel, Advocate Ibrahim Satti, stated that the Anti-Terrorist Court and the High Court had rejected Musharraf's bail plea on grounds of technicalities.

Satti further said that Musharraf had been kept under house arrest for more than six months only because of the Akbar Bugti case and that according to a court ruling, in case a bail application was rejected over technical grounds, the apex court was the authority to rule on the matter.

Additional Prosecutor General Balochistan Tahir Iqbal Khattak said "Musharraf is accused of being part of a criminal conspiracy."

He further added that Musharraf was chief executive and a CD recording was available with the complainant's councsel displaying the attack on Bugti's home.

"People were killed during those attacks," he declared.

Justice Sarmad Jalal Osmany in return inquired as to "whether anyone had witnessed Musharraf or his alleged accomplices conspiring against Bugti?"

The court then stated that no substantial evidence was available to implicate Musharraf in the murder case.

The apex court then granted Musharraf's request for bail, and ordered him to submit two bonds of Rs 1 million each as surety.

Musharraf is also involved in two other cases, namely the Benazir murder case and the judges detention case. He had been granted bail in both cases.

On August 2006, Baloch nationalist leader Nawab Akbar Khan Bugti was killed in an explosion in a cave, where he had taken refuge during a military crackdown ordered by Musharraf who was president and army chief at the time.

Bugti had led an armed campaign to press for provincial autonomy and a greater share of profits from Balochistan’s natural resources.

The death of the Baloch chieftain sparked angry protests in parts of the country.

Well this was bound to happen. Just a waste of time for the courts and useless money wasted on the case.
General Musharraf was innocent of all charges.
This was done to make him stay away from elections.
He should just go away from Pakistan, as he was treated badly. We dont deserve him. He was happy doing his own stuff.

The Supreme Court Wednesday accepted former President and Army Chief Pervez Musharraf’s bail plea in the murder case of Baloch nationalist leader Nawab Akbar Bugti.
The former military dictator could leave Pakistan soon as Thursday as he has now secured bails in all the cases he was facing in the county, his lawyer said after the court decision.
Musharraf had been implicated in four cases – promulgation of Emergency on Nov 3, 2007, judges’ detention case, and murder cases of ex-PM Benazir Bhutto and Nawab Akbar Bugti. He had been given bail in rest of the three cases earlier, while no challan had been filed in another case pertaining to high treason.
A three-judge bench, headed by Justice Nasirul Mulk and comprising Justice Sarmad Jalal Usmani and Justice Musheer Aalam Khan, accepting bail directed Musharraf’s counsel to deposit two surety bonds of Rs1 million each. In the previous hearing, the court had issued notice to applicant Jamil Bugti, a son of Nawab Akbar Bugti, but he did not appear before the bench on Wednesday.
During the proceeding, the bench observed that substantial evidence was not available to establish that Musharraf was involved in the criminal conspiracy regarding the murder of Akbar Bugti. “This is a case of criminal conspiracy for which solid evidences are required, and due to their unavailability, there is no justification for rejection of the bail plea,” it added.
Musharraf’s fate has been subject to intense speculation since he became the first former army chief to be arrested this year, breaking an unwritten rule that the top ranks of the military are untouchable, even after they have retired.
“The jail staff present at his house will pack up and leave as soon as they get the orders from the lower court,” Ahmed Raza Kasuri, who heads the Musharraf defence team, told Reuters. “Musharraf can fly to Dubai tomorrow once these legal formalities are completed,” he said.
During the hearing, the bench asked Balochistan Additional Prosecutor General Tahir Khattak about the evidences gathered against Musharraf. Khattak told the court that according to the statements of co-accused, Musharraf had ordered to take action against Bugti. He also stated that a CD recording in this regard was also available. Khattak insisted that Bugti was killed on the directives of Musharraf. Justice Sarmad Jalal Osmany questioned if anyone had witnessed Musharraf or his alleged accomplices conspiring against Bugti.

For both the Musharraf lovers and the one against him; the real reason why Musharraf may not be tried or convicted is because he will open a Pandora's box on other activities of the Army that are extra-judicial and borderline criminal. After not being able to leave his house other than for court visits and under strict security, this may be his last visit to Pakistan. Perhaps, the establishment thinks its better to avoid him serving a criminal sentence than have him point out others for the same.

However, as of now he has been arrested again on further criminal charges
