Divorce In Islam from a Woman point.

Some people raise the question regarding the right of wife to pronounce divorce in Islam and many misunderstandings are there in our society centering this issue. In Islam woman is deprived in no respect and any question of injustice or anti-woman bias is inconceivable as Allah (SWT), the Lawgiver, is independent of any consideration of sex. In Islam wife is fully entitled to initiate or pronounce divorce though the procedure is different from that of her husband. If the husband is missing for a certain period of time or an indefinite time, or if he suffers from a fatal incurable disease, or if he is sexually impotent, and in some other cases and circumstances, the wife is given every right to initiate divorce. Moreover, if she suffers unhappiness, misery or incompatibility with her husband, then also she can do it with the intervention of court. There is another system of dissolution of marriage by the woman that is called "Khula" through which the wife can get separation from husband by returning the marital gift or part of it. It is not necessary that she should have a definite ground for pursuing Khula. Thus we see that both the husband and the wife can initiate divorce in Islam though the procedure is different.

Divorce in the Light of Islam

The rights of women in Islam: an ... - Google Books

It is not essential to seek Khula through court, the two parties can separate through mutual agreement. But if the husband does not agree then the wife can contact the court. As far as the question whether in case of Khula the amount more than dower can be demanded or not is concerned, the scholars differ on it. Some scholars regard it as unlawful. They quote the following Hadith as a proof. The Prophet (SAW) said:

"Don't demad the amount greater than the dower." (Ibn Majah)

The scholars have also differed on the matter whether Khula is a divorce or cancellation of Nikah. But the fact is whatever name you give it, its commands will remain the same. In case of Khula, the waiting period (Iddah) of a women is one menstruation period. When Rabi bint Masoodt obtained Khula from Thabit (RA), the Prophet (SAW) asked her to wait until one menstruation period before she could go her home. (An-Nissai, Abu Daud, Tirmizee)

Another thing worth mentioning is that in case of Khula, the husband does not have the right to touch his wife. Of course in that case it will negate the concept of Khula.

The Right of Khula (Separation)

So in the light of the above the lady was eligible and could have and should have used her right to Khula and the one where the husband and wife agree right at the time of the nikah to give the wife the power of divorce is called Tawfid. Both are 2 different things.

The first thing that must be clarified is that a woman may not declare divorce (talaq or khula), unless she has had this right stipulated in her marriage contract, or if she was granted this right by her husband at some other point in time (before or after the marriage). However, a woman may seek annulment of her marriage in certain situations, and there is a procedure that must be followed for this to occur. It is best that one consult a local, reliable scholar in order to see to how this can be done. The following link will help clarify what happens when a husband refuses to divorce his wife:

Lolz this case is now becomming a 1000 episode long Indian Soap Opera a la Ekta Kapoor named " Kion aik Pakistani say pyar kiya" where Shoaib met Ayesha and made her fall for him. He made her pregnant and than left her. Poor Ayesha was left devastated. Later Shoaib fell for another girl named Sania and seeing his love betraying him Ayesha could no longer keep quite and came out fighting. Shoaib is now denying having anything to do with Ayesha.

Now what will happen next is there will suddenly emerge a little girl who Ayesha will claim to be Shoaib's daughter and was not lost in abortion but secretly kept in an orphange all this time. Ayesha will then die in a horrible accident and leave the little girl to Shoaib who will after reluctance accept her and tell Sania that he has to take care of his daughter so he will not marry her. Sania will than go back to his old love Shadab (or whatever his name is) and will marry him. Meanwhile Shoaibs daughter will grow 25 years old (While Shoaib remains the same except a few white hair) and one day they will find out that Ayesha didn't actually die in the accident but lost her memory and is living as a school teacher in Timbaktoo............

This is the story of the first 100 episodes and if Ms Ekta Kapoor is reading this forum we will sign a contract for the next 400. :victory:

P.S: I have even given it a name starting with a "K" as per her liking :p:.

Nikaah was performed to a signatory Maha Siddiqui, not Ayesha Siddiqui. Thats another thing Ayesha is now claiming she and Maha are one and the same. Lays credibility to Malik's claim that she deceived him.

Interestingly Malik knew who was Maha, in the interview he said he knew Maha.

indian police should interrogate as shown in the video:

:D

Malik came out with some clarifications.

He said he has met the fat girl they show on TV, he used to call her Apa. He was told he is marrying some other girl whom he never met personally. He has met the fat girl but as sister of Ayesha, not as Ayesha.

Even he's come out and asked the Siddiquis that why is Ayesha hiding and not coming forward?

Moreover he said "Ask her who is Reema and Mona", indicating that she has had other aliases as well before.

He kept repeating, "I'm here and I'm not running away" and sab ilzamaat ka "khundun" kardia. Khundun sounds like some mithai.

What is going is correct as per process.
Malik claimed he got married, he took entire team to Ayesha house and how many will believe that he did not see his wife before doing that, then he sent his trophy also to Ayesha.
Police is questioning him as per law, he will be free if they find nothing. Given the amount of circumstantial evidence Malik does not come clean just on his statement.

What Pakistani's are doing here is by default siding with Malik even though lot of evidence goes against. Worst you guys are blaming GOI when they do nor even have a role to play.
