He did not

-Insult Islam/Mohammed/Allah
-He did not abuse any one by name
-He did directly not exhort 100cr Hindus to kill any one.

-use past sad incidents to say what would happen if Police is taken away.
-give an indirect threat of riots

His speech was repulsive, but is this going to stand in a court of law on account of hate speech ? I dont think so.

He was a very cunning man. I think he legally vetted his speech before actually delivering that.

Anyway a case has been filed against him, let law take its own course.

But hear the speech carefully and you realise that Togadia has been clever while Owaisi was plain stupid. He uses unparliamentary language for Owaisi but without taking his name. As far as the references to the riots are concerned, Togadia will take recourse to the excuse that he was merely quoting facts while Owaisi was issuing a threat. In his speech, Togadia issues a veiled threat couching it in praise of the sword-wielding Goddess Durga. Owaisi in contrast spoke of Hindu Gods and Goddesses in an offensive manner.

If we must get into hair-splitting, the other crucial difference is that Togadia is relatively a nobody while Owaisi is the leader of the All India Majlis-e-Ittehadul Muslimeen (AIMIM) in the Andhra Pradesh Assembly. He is an elected representative and he is under oath to promote religious amity

This is what I said. His speech can be considered unwarranted, but legally its *not* going to stand scrutiny.

I understand there are people who cheer in the crowd and there are those who cheer silently on internet.

I think you are not aware laws and legal procedures.
IPC is not just about words. Its much wider. Please read it before posting. And of course you can defend any hate speech by providing all sort of reasoning.

He said what would happen if police are removed for 15 minutes and that too cunningly by referring to past incidents.

Just assuming he gave a hate speech (repulsive speech, yes) and then asking him to be arrested just because your youth icon Owaisi was also arrested reeks of ignorance. Cases are decided on individual culpability..not in a competitive manner. Just because an Owais, who was stupid enough to openly abuse people by names, abuse the Gods and Godesses of the majority religion in land, was arrested does not mean another guy who was more sly and cunning in his speech will also be arrested.

There are plenty of Muslims also who have evaded and continue to evade the long arm of law like Imam Bukhari.

People like Togadia are a necessity in India to remind people like Owaisi that this is a Hindu country and people with this mentality will be slaughtered if need arises. If there were no people like Owaisi , then I would say otherwise. Similar is the case with organisations like RSS that we keep bashing all the time.
