If we see this case as fraud then

- Legally fraud, cheating, deceiving or lying required to be proved in court of law with evidences

- Now in her case she has voluntarily admitted about mutual consent which clear that it could not be termed as fraud or cheating

- Additionally she had not plead that her consent was achieved under the influence or against her free will

- Maximum it only indicates that at the time of entering into a relationship the terms of their relationship and concluding status was not clear enough so whatever happened between the two adults during the period of relationship happened under their respective assumptions which may not be the same for both parties in relationship

which court declares ''false marriage promise'' as fraud and prosecutes for it, what BS is this. In the western countries the couples dont date because of ''fake marriage promises'' no promises are made as im aware of esp in the west, dating can go on for as long as ten years even for life time with female expecting marriage proposal from the guy, finally if a party decides that dating has been going on for far too loing with no marriage in sight, call it quits.

She laid the trap but has fallen into it herself, i think sex without marriage is a punishable offense !??

It is never really imposed but this is where I draw a boundry rape cases should be punished but false accusations should carry same punishment

She would never have won the case as she is wrong. The judges know how revenge accusations work. She was with him for quite a while. The man did nothing wrong accept ofcourse using her and then dumping her. But you can't be jailed or whatever for that.

Yes but there is no law. And no way to confirm someone's word/ say. Until and unless it is written. Even Islam says that. That is why you have nikkah nama

as stated, the laws are only invoked in very extreme cases involving a rural disadvantaged young girl not having enough maturity and poverty and being lured into marriage. The laws have been made to cater the specific needs of indian socioeconomic reality. The consensual sex is not considered rape.
