If we see this case as fraud then

- Legally fraud, cheating, deceiving or lying required to be proved in court of law with evidences

- Now in her case she has voluntarily admitted about mutual consent which clear that it could not be termed as fraud or cheating

- Additionally she had not plead that her consent was achieved under the influence or against her free will

- Maximum it only indicates that at the time of entering into a relationship the terms of their relationship and concluding status was not clear enough so whatever happened between the two adults during the period of relationship happened under their respective assumptions which may not be the same for both parties in relationship
