FINAL SUBMISSION
BY THE REPUBLIC OF INDIA

(1) The Government of India requests this Court to adjudge and declare that, Pakistan acted in
egregious breach of Article 36 of the Vienna Convention on Consular Relations, 1963 (Vienna
Convention) in:
(i) Failing to inform India, without delay, of the detention of Jadhav;
(ii) Failing to inform Jadhav of his rights under Article 36 of the Vienna Convention on
Consular Relations, 1963;
(iii) Declining access to Jadhav by consular officers of India, contrary to their right to visit
Jadhav, while under custody, detention or in prison, and to converse and correspond with
him, or to arrange for his legal representation.
And that pursuant to the foregoing,
(2) Declare that:
(a) the sentence by Pakistan’s military court arrived at, in brazen defiance of the Vienna
Convention rights under Article 36, particularly Article 36 paragraph 1 (b), and in
defiance of elementary human rights of Mr. Jadhav, which are also to be given effect as
mandated under Article 14 of the 1966 International Covenant on Civil and Political
Rights (ICCPR), is violative of international law and the provisions of the Vienna
Convention;
(b) India is entitled to restitutio in integrum;
(3) Annul the decision of the Military Court and restrain Pakistan from giving effect to the
sentence or conviction in any manner, and
(4) direct it to release the Indian National, Jadhav, forthwith, and to facilitate his safe passage to
India;
5) In the alternative, and if this Court were to find that Jadhav is not to be released, then
(i) Annul the decision of the Military Court and restrain Pakistan from giving effect to the
sentence awarded by the Military Court,
or in the further alternative
(ii) direct it to take steps to annul the decision of the military court, as may be available to it
under the laws in force in Pakistan,
and in either event
(iii) direct a trial under the ordinary law before civilian courts, after excluding his confession
that was recorded without affording consular access, and in strict conformity with the
provisions of the ICCPR, with full consular access and with a right to India to arrange for
his legal representation.

India has asked Pakistan to provide "unimpeded" consular access to Kulbhushan Jadhav in an environment free from the "fear of intimidation" and reprisal, in sync with the ruling by the International Court of Justice in his case, official sources said today.

Earlier this week, Pakistan sent India a proposal offering consular access to Mr Jadhav on Friday.

On Thursday, India sent a communication to Pakistan making clear its position that the consular access must be "unimpeded" and should be in the light of the judgement by the International Court of Justice or ICJ.

Official sources said Pakistan's response to India's communication is now awaited.

The External Affairs Ministry on Thursday said it was evaluating Pakistan's offer of granting consular access to Kulbhushan Jadhav in the ICJ judgement in the case.

There were reports that Pakistan had put some conditions to grant consular access to Mr Jadhav, reported news agency Press Trust of India.


One of the conditions reportedly was the presence of a Pakistani official when the Indian prisoner is allowed to meet Indian officials as part of the consular access, reported Press Trust of India.

Kulbhushan Jadhav, 49, a retired Indian Navy officer, was sentenced to death by a Pakistani military court on charges of alleged "espionage" in April 2017 following which India had moved the International Court of Justice.

Following the ICJ order, India has asked Pakistan to grant full consular access to Mr Jadhav at the earliest in "full compliance and conformity" of the world court's verdict.

In its 42-page order, the court, while rejecting Pakistan's objection to admissibility of the Indian application in the case, held that "a continued stay of execution constitutes an indispensable condition for the effective review" of the sentence of Kulbhushan Jadhav.

Monkey is as good as dead for Indoos. They just want to play politics and Pakistan is playing that game much better.

There was no order by ICJ to give 'unimpeded' access.

There is nothing in in the LAW stating terms and conditions. It should be accept it or reject it. Pakistan should not change any conditions put.

lets teach you basics... when we ask and you don't give but are forced to give when dragged to ICJ its called snatching...not begging. Its a right every country has.
