Referendum is going to take place under UN supervision anyway. This was ALWAYS the case. But you don't even complete the FIRST precondition for it to take place. It's YOU who has to act on the UN resolution first. Did you know this, Sir?

If you take this to ICJ along with KBJ case (as you said in your previous post), then your case will be suspended on the first date itself, at the very least.

we are not obliged to prove that he got fair trial or not.

and for us prove kalboshan guilty at ICJ and expose India as a terrorist country. mission accomplished.

and the reason is that we wanted to expose India there and force India to ICJ , thus giving us an opportunity to take Kashmir issue there.

In the elections held on 27 April 2012, Dalveer Bhandari secured 122 votes in the United Nations General Assembly against 58 for his rival, Florentino Feliciano, who was nominated by the Government of the Philippines.

He was re-elected for a second term on 20 November 2017 after UK's nominee Christopher Greenwood withdrew his nomination

we will if we get guarantee that such referendum will happen in IOK an that too under UN supervision. but we don't trust you.

so UN should take Kashmir and hold referendum and then give it to the winner.

UN will say if Pakistan wishes you can go ahead & conduct referendum in AJK & GB because you are the ones continuously screaming of referendum at the UN.

They will just keep saying it's a bilateral issue, solve it with India. UN won't intervene unless India requests. India has a strong influence in the UN. Pakistan will keep crying. People are only going to mock & laugh at your broken record played continuously at the UN.

Why should I claim honest or dishonest. As though If I say Indians & their judges are the most honest people, you are going to agree.

Nobody cares about statements & stance of themselves. It's others view which counts. So here too, You should worry about whom will they say dishonest India or Pakistan. That carries more weight & meaning.
 
Pakistan has presented evidence which proves that Jadhav had two different identities, both legally issued by the Indian Govt.

and the resolution never say Indian forces should be allowed to Kashmir. it says we just pull back.

I had posted this a few days ago. May be you will find it relavent to your question above. Please go through it.

BTW, I never said Pakistan has to unilaterally pull out the troops. I only asked why Pakistan isn't implementing the UN pre-conditions of pulling out the troops. Of course it has to be done by both but the difference is that Pakistan has to pull out everyone from disputed area (including those who were allowed to settle in there by you). On the other hand, India will reduce the troops to minimum to maintain the law and order.

India doesn't have to pull out entire troops from there.

  • In the first step, Pakistan was asked to use its "best endeavours" to secure the withdrawal of all tribesmen and Pakistani nationals, putting an end to the fighting in the state.
  • In the second step, India was asked to "progressively reduce" its forces to the minimum level required for keeping law and order. It laid down principles that India should follow in administering law and order in consultation with the Commission, using local personnel as far as possible.

That's the precondition which Pakistan never met. Why?

India already agreed to the UN resolution. We don't have to RE-AGREE to it. We (and the UN) are just waiting for you to complete the preconditions of the resolution.

FYI, ICJ doesn't have jurisdiction on UNSC resolution. The UNSC resolution passed under their charter-VI is non implementable, therefore even the UNSC cannot force anyone to implement the same, let alone ICJ. It's rather a set of guidelines and have no value more than toilet paper. LOL :lol::lol::lol::lol:

OK. Now let the court analyse the proofs Pakistan has provided and the details of the trail and decide for itself. India has never contested the proof's or denied Mr. Yadhav's identity, India has only two plea,

i) Counselor access to Yadhav. Which will be partly achieved on 25th this month I guess.

ii) The transparency and legal sanctity of his (closed room) trail in Pakistan.


FYI, we have officially, neither accepted or denied providing Mr. Yadhav a second passport with a Muslim pseudo-name. So you can claim that it was issues legally by GOI. But please be patient and wait for GOI to file our counter, and let the ICJ take a decision after analyzing all the facts provided. :-)

ICJ has no jurisdiction. Only thing that can keep him alive is if he continues to spill out worthy intelligence.

I'm not talking about whether ICJ has jurisdiction or not. What I'm saying Pakistan will not hang Mr. Yadhav if the ICJ verdict is against. Let's wait and see. :)
