Pak investigator wants country to admit mistakes about Mumbai attacks

As of today, muslims' biggest concern globally (and especially so in Pakistan) is being branded "not muslim enough" and killed. How many muslims/humans have died in your country for not being muslim enough or being the wrong kind of muslims? How many shias, how many ahmadis, how many Hazaras? The flags on the LeJ and SSP proudly fly in huge rallies in your cities, and murderers chant "kafir, kafir, XYZ kafir" before massacring busloads of people. Being killed for being unIndian in India is far less a possibility than being killed for not being muslim enough in Pakistan.

Spare your concern (fake as it is) for Indian muslims being branded unIndian. Worry about your own people being killed for not being muslim enough first. Learn to prioritize your concerns.


Unfortunately and with tragic consequences ...... Pakistanis do not hesitate to direct this question of not being "MUSLIM ENOUGH" at their own Country men and Compatriots. The Shias and Qadiyanis among them have been subjected to this indignity regularly, who else will this question be directed at ?

He is the latest traitor of Pakistan(?) I hope tabs are kept on him.

So.... will there a fatwa of "wajib-ul-qatl" also declared against Mr.Tariq Khosa?

I believe those so called Muslims who are posing or questioning their fellow countrymen with these questions are themselves not muslims. They are just power hungry or money seekers who want to remain in limelight by hook and crook. I am sure they must be doing all these things which as per Islam should not be done. They claim to represent the purest of the lands for muslim among the world but still do all the unholy things.
They kill their fellow muslim country men and then claim to be muslims.
They give the adultrated food to their country men and then claim to be from the land of the pure
They dont care about their minorities then claim to be land of allah. Funnier thing, even in Saudi they themselves are treated with worst of the treatment.
they silence their own country men who try to follow the foot steps of their allah by speaking truth...and audacity is they honor the murderer.
They use all western inventions/technologies and then also curse them. Most disgraceful creatures who call themselves as the whole world sole muslims' torch bearers.
These people not only bring bad name to their own country but also to the whole muslim world.

New Delhi: India feels that its stand is vindicated in the disclosures made by the Pakistani chief investigator of the 26/11 Mumbai attacks that the carnage was planned and launched from his country and the operation was directed from an ops room in Karachi.

"We have always insisted that the 2008 terror attack were planned, financed and carried out by people from Pakistan. Also, it is our view that 99 per cent of the evidence in the Mumbai case is in Pakistan," government sources said.

Pakistani prosecutors had enough evidence to nail perpetrators of the deadly attacks and if they had revealed it, the outcome of the Mumbai trial case would have been different, sources said, adding all those responsible for it including Zakiur Rehman Lakhvi would not have been roaming free in that case.

The sharp reaction came in wake of revelations made by Tariq Khosa, chief investigator of the 26/11 attacks, that the mayhem was planned and launched from his country and that the operation was directed from an ops room in Karachi.

Khosa, a top police officer who was made Director General of the Federal Investigation Agency (FIA) weeks after the 2008 Mumbai attack that left 166 people dead, has written a revealing article in Dawn newspaper giving graphic details of the plot and its investigation, thereby confirming what India has been saying for long.

Laying down the facts of the Mumbai attacks trial in the article, Khosa writes, "First, Ajmal Kasab was a Pakistani national, whose place of residence and initial schooling as well as his joining a banned militant organisation was established by the investigators.

"Second, the Lashkar-e-Taiba (LeT) terrorists were imparted training near Thatta, Sindh, and launched by sea from there. The training camp was identified and secured by the investigators," he writes.

He also demanded that Pakistan's state security apparatus should ensure that the perpetrators and masterminds of the "ghastly terror attacks" are brought to justice.

Noting that the case has lingered on for far too long, Khosa said dilatory tactics by the defendants, frequent change of trial judges and assassination of the case prosecutor as well as retracting from original testimony by some key witnesses have been serious setbacks for the prosecutors.

THE Mumbai terror attacks were claimed by India to be its 9/11. For more than 66 hours, 10 highly trained militants played havoc in India’s commercial metropolis, spraying bullets and shedding the blood of innocent civilians and tourists in November 2008, bringing the two nuclear neighbours to the brink of an all-out war.

In Ufa, Russia on July 10, 2015, both the prime ministers of Pakistan and India were “prepared to discuss all outstanding issues,” and both the leaders “condemned terrorism in all its forms” and agreed to cooperate with each other “to eliminate this menace from South Asia”. Therefore, we in Pakistan should welcome this development wholeheartedly.

Didn’t we suffer the pain and agony of our own 9/11 on Dec 16, 2014, at the hands of the Tehreek-i-Taliban Pakistan and its surrogates and aren’t we as a nation determined to root out terrorism in all its forms from our soil? The answer is obviously a resounding yes and I have no doubt that the political and security leadership have resolved to eliminate the scourge of terrorism, militancy and extremism through the counterterrorism National Action Plan. The duality and distinction between good and bad Taliban, including all militants and terrorists, should stand removed from Miramshah to Muridke, from Karachi to Quetta.

Against this backdrop, the agreement between PMs Sharif and Modi in Ufa to approve the meeting of their national security advisers to “discuss all issues related to terrorism” was a welcome development. Pakistan’s concerns in respect of the botched investigation into the Samjhauta Express bombing and alleged covert support to the Baloch insurgency as well as reported ‘terror financing’ both in Karachi and Fata by Indian and other foreign agencies should not only be highlighted but concrete evidence presented to put a stop to such means of non-kinetic warfare resorted to by sleuths from both sides to further their so-called national interests.

There are very knowledgeable and competent professionals with investigation and intelligence background in Pakistan who can meet the Indian security officials and talk as professionals. They too have many skeletons in their cupboards. So why fight shy? Let both India and Pakistan admit their mistakes and follies and learn to co-exist while trying to find solutions to their thorny issues through peaceful means.

The entire state security apparatus must ensure that the perpetrators and masterminds of the ghastly terror attacks are brought to justice. The case has lingered on for far too long. Dilatory tactics by the defendants, frequent change of trial judges, and assassination of the case prosecutor as well as retracting from original testimony by some key witnesses have been serious setbacks for the prosecutors. However, cognizance was taken by the Islamabad High Court which directed the trial to be concluded within two months.

The following facts are pertinent. First, Ajmal Kasab was a Pakistani national, whose place of residence and initial schooling as well as his joining a banned militant organisation was established by the investigators. Second, the Lashkar-e-Taiba (LeT) terrorists were imparted training near Thatta, Sindh and launched by sea from there. The training camp was identified and secured by the investigators. The casings of the explosive devices used in Mumbai were recovered from this training camp and duly matched. Third, the fishing trawler used by the terrorists for hijacking an Indian trawler in which they sailed to Mumbai, was brought back to harbour, then painted and concealed. It was recovered by the investigators and connected to the accused. Fourth, the engine of the dinghy abandoned by the terrorists near Mumbai harbour contained a patent number through which the investigators traced its import from Japan to Lahore and then to a Karachi sports shop from where an LeT-linked militant purchased it along with the dinghy. The money trail was followed and linked to the accused who was arrested. Fifth, the ops room in Karachi, from where the operation was directed, was also identified and secured by the investigators. The communications through Voice over Internet Protocol were unearthed. Sixth, the alleged commander and his deputies were identified and arrested. Seventh, a couple of foreign-based financiers and facilitators were arrested and brought to face trial.

After an exchange of multiple investigation dossiers with the Indian police authorities, the trial court was requested to give approval to obtain voice samples of the alleged commander and his deputies for comparison with the recorded voices. The court ruled that the consent of the accused should be obtained. Obviously, the suspects refused. Then a plea was submitted before the sessions court to authorise the investigators to take the voice samples despite the lack of consent. The plea was denied on account of there being no such provision in the Evidence Act or the antiterrorism law applicable at that time. The investigators then went in appeal before the High Court. That appeal, I believe, is still pending. The Fair Trial Act, 2013 caters for admissibility of such technical evidence. However, its application with retrospective effect is a moot point.

The Mumbai case is quite unique: one incident with two jurisdictions and two trials. While the Indians managed to nab Ajmal Kasab and were able to obtain his confession to close the trial, proving conspiracy in a different jurisdiction is more complex and requires a far superior quality of evidence. Therefore, the legal experts from both sides need to sit together rather than sulk and point fingers.

Indian interlocutors, engaged during the talks between the then prime ministers of India and Pakistan in Egypt in 2009, had conceded that the Pakistani investigators had done a professional job in the indictment of seven perpetrators of the attack. However, the Pakistani authorities should not forget that the FIA declared various other facilitators and operatives as fugitives in the case. The trial will not be over with the disposal of those under arrest or on bail. Other missing links need to be uncovered after the absconders’ arrest.

This case will not be over soon.

Are we as a nation prepared to muster the courage to face uncomfortable truths and combat the demons of militancy that haunt our land? That is the question!

Are there any who actually believe that? i have yet to meet someone (in India) who does not believe it was" LeT".

I was having similar view, But few days back i saw a picture of a book release with diggu on dias and the book was on a topic, 26/11 and RSS...... it was there in the indian political thread, You can search for it.... I think @Star Wars posted it.....

Anyone who's followed the 26/11 investigations by Pakistan knows this; what they also know is that the delay is due to legal complexities (inadmissibility of evidence, the absence of laws and inter-country legal frameworks) than anything nefarious on part of Pakistan ! Anyone who doesn't ought to give Ahmer Bilal Soofi - the man who followed this very closely - a listen or a read.

Are you kidding me? Are you really that blind or act like one?

Every other day, your compatriots (even the supposedly 'saner' ones too) don't hesitate to say that 26/11 was an inside job! Many times, I had to counter them by asking how they feel if somebody says same thing about APS Peshawar!

And then apologists like you can come and say what's new?

In short nothing new here too. In fact article shows sincerity and seriousness of Pakistani state in investigations of these attacks. After all FIA is a Pakistani state institution and Tariq Khosa was a government servant who investigated these attacks

The fact is, if Pakistan was ever sincere about punishing the perpetrators, it wouldn't even have needed any Judicial process to punish them - just as it happens so frequently with Baloch leaders or anyone against the military establishment there.

What is even worse - the Pakistan has taken to use the prosecution of the perpetrators as bargaining chip in her negotiations with Indians!

I mean, how low can you get?

I have seen that too..can we take legal action against this diggu dog who is creating an atmosphere of mistrust and confusion in the country...
 
Guys..the world knows who did Mumabi attack..Pakistan has the obvious interest in supporting all the anti Indian people..So we do not have to prove them..They will be always in the denial...But one thing i would like to mention, we should really appriciate the electronic media of Pakistan which even dare to publish such articles..That signifies that there are good section of people in Pakistan who really do not like all these activities of Pakistan itself in India....And they should be the reason, Indian Gov should not stop talking to Pakistan Gov...
 
I remember reading in wikileaks about progress by Pakistani authorities on the Mumbai attacks case.

At that time i assumed any of this progress was just to keep the Americans satisfied.

These new revelations are making me change that thought

Yes. There was a chance. But now their fatwa carrying out service is also Indian(read TTP). So that leaves the good old Hafeez sahib to deliver justice.
