RTI activist Subhash Agrawal, who had sought declassification of documents pertaining to Bose, made a strong plea before the Commission citing section 8(2) of the RTI Act which allows exempted records to be disclosed if public interest in disclosure outweighs the harm to the protected interests.

"Notwithstanding anything in the Official Secrets Act, 1923 nor any of the exemptions permissible in accordance with sub-section (1), a public authority may allow access to information, if public interest in disclosure outweighs the harm to the protected interests," the Act says.

Section 8(3) of the RTI Act also allows disclosure of information withheld under Section 8(1), as is the present case, if the information related to any event which happened 20 years before the request it made.

"Subject to the provisions of clauses (a), (c) and (i) of sub-section (1), any information relating to any occurrence, event or matter which has taken place, occurred or happened twenty years before the date on which any request is made under secton 6 shall be provided to any person making a request under that section:

"Provided that where any question arises as to the date from which the said period of twenty years has to be computed, the decision of the Central Government shall be final, subject to the usual appeals provided for in this Act," the Act says.
 
well it's a shame that Bose's family was snooped upon. But politicians in power snooping upon opposition and in this case potential opposition, is not really earthshaking news. Two mysteries though are:

1) Why aren't ALL files related to Bose being declassified in spite of BJP's election promise
2) Does that mean there indeed is a mystery around Bose's death?

I really do not think the files would have been kept confidential to protect somebody abroad such as the reason of 'in the interest of not jeopardizing foreign relations'. It's gotta be somebody within Indian sub-continent that perhaps is being protected?

I hate to add such a conspiracy theory but that's what lack of transparency leads to

Apparently,the W.B. Govt. has got near about 30 classified files about Netaji and our Hon'able C.M. Shri Mamata Banerjee has decided to declassify those files as she feels that the general public of Bengal and India need to know the truth about Netaji(Please don't expect anything exploxive in those files,if there was indeed some classified news then i think the previous Left Front Govt. would have released it decades earlier):coffee:

Buoyed by the West Bengal government's decision to publicise files on Subhas Chandra Bose, Netaji's family members on Sunday said they would be meeting Prime Minister Narendra Modi seeking declassification of similar files with the central government.

The family members would also urge Modi to write to the Russian and British governments for declassifying similar files said to be in the possession of their respective spy agencies.

"Most of the files that can unravel the Netaji disappearance mystery are with the Indian government. The West Bengal government has shown the way and it is now time for the Centre to act," Netaji's grandnephew and family spokesperson Chandra Kumar Bose told IANS.

West Bengal Chief Minister Mamata Banerjee on Friday declared declassifying of all state government files on Netaji.

At least 64 files on Netaji in possession of the state government will be kept at the city police archive from September 18 for public access.

Chandra Kumar said it is also crucial that efforts are made for declassifying secret files on Netaji by the erstwhile KGB as well as the British Secret Intelligence Service.

"While the Indian government has to act first, we would also urge Modi to write to both the Russian and British governments for providing access to classified documents both by the KGB and the MI6," said Chandra Kumar.

"Russian authorities had told the Justice Mukherjee Commission that if the Indian prime minister writes to Russian government, they may declassify the KGB files. But unfortunately, no such efforts were made then.

"We have also got a positive reply from the British authorities on the issue after we wrote to them regarding the MI6 files on Netaji. Signs are positive and we are hopeful that Modi will act and fulfill billions of Indians' wish to know what actually happened to Netaji," he said.

A section of the family along with researchers would be meeting Modi between October 10 and 14.

"Since our earlier appointment with Modi could not take place as he had to go on a foreign visit, we got a call from the PMO (Saturday) asking for a next date. We have sent details of the family members and researchers desirous of attending the meeting. The PMO has assured of an appointment in October," he added.

Netaji descendants had earlier, too, raised the issue of declassification of files with Modi.

New Delhi: Even as West Bengal government gets ready to make documents on Netaji Subhas Chandra Bose public, the controversy over his death in a plane crash in 1945 in Taiwan has been ignited again.


As per a report in The Indian Express, some of these documents suggest that in 1948-49 American and British intelligence agencies believed that Netaji was alive and that he played an important role in Communist uprisings in Southeast Asia.

The IE report further suggests that the Information and Broadcasting Ministry had also confirmed the same thing to Netaji’s nephew Amiya Nath Bose in 1948.

The letter read: “I regret I could not find out that news about Netaji which have been published in Chinese newspaper in Nanking some time ago. I am still believing that he is alive.”

These files are among the 64 files on Netaji Subhas Chandra Bose that would be declassified and put in public domain on Friday.

In February this year, the Narendra Modi government in reply to an RTI plea had refused to disclose records related to Netaji's alleged death 70 years ago, saying there was a larger public interest involved in making them public.

Toeing the line of the previous UPA government, the PMO had cited an exemption clause in the RTI Act which allows withholding of information that could prejudicially affect relations with a foreign country.

Kolkata: In a historic and bold step, the West Bengal government, Friday, declassified 64 files relating to Netaji Subhas Chandra Bose and brought them into the public domain.

The files – in digitised format – were handed over the family members of Netaji by Kolkata Police Commissioner Surajit Kar Purkayastha.

“The files related to Netaji have been placed in the Kolkata police museum archive from today,” Purkayastha said. "It was quite a big task because in a short period of time we had to digitise entire files," he added.


As per reports, out of the 64 police, 9 are crucial as they contain intelligence inputs which may thorw light on the fate of Netaji Subhas Chandra Bose – the most important question being whether the founder of Indian National Army died in a plane crash in Taiwan in August 1945.

Recently, some files relating to Bose, declassified by the central government, had revealed that the Ministry of Home Affairs had snooped on at least two of Netaji's nephews.

The files revealed that the Intelligence Bureau had kept the relatives of Netaji under close surveillance between 1948 and 1968 when Jawaharlal Nehru was the Prime Minister.

Subsequent to this, family members of Netaji met Prime Minister Narendra Modi and urged him to declassify all Netaji files.

The Chief Minister also announced that the record of the freedom struggle from 1937 to 1947 would be digitised in order to preserve history.

Asked whether the files to be declassified can throw any clue about the alleged snooping on Netaji's nephew by the Central government from 1948 to 1968, Banerjee said, “You have the options. It is better for you to go through the files to get the answers.”

The West Bengal government declassified 64 closely-guarded files on Netaji Subhas Chandra Bose at an event at a police museum in Kolkata on Friday.

"Today is a historic day. Our government has made all Netaji files public. People have a right to know about the brave son of India," chief minister Mamata Banerjee said in a tweet.

People will, however, not immediately have direct access to the document. The common people can access the content from Monday (September 21).

"[For now]...public will get to see the original files that will be kept in a glass case," Kolkata plice commissioner Surajit Kar Purkayastha said.

"There are 12,744 pages in total in these files. All have been digitised. It was quite a stupendous task."

Purkayastha handed over the first DVD containing information in the files to Krishna Bose, wife of Netaji's nephew and aide Sisir Bose at the police academy in north Kolkata.

The programme began at 10.20am and lasted 30 minutes. It was attended by Bose family members, researchers and mediapersons. Tight security was in place to manage a big crowd that never turned up.

Bose's family members and researchers have repeatedly maintained the secret files lying in Delhi are of significance, as they contain the answer to the key questions on the disappearance of the firebrand leader and the subsequent years. The Centre has 130 files.

Of the 64 files declassified on Friday, nine belonged to the Intelligence Branch and the other 55 to the Kolkata police special branch (intelligence wing). All were stored in an office on Lord Sinha Road in south Kolkata.

Surprisingly, Kolkata's response was lukewarm, although the issue hogged media limelight since chief minister Mamata Banerjee announced just a week ago (on September 11) that her administration will bring the files in public domain.

HT spoke to students of a few prominent colleges in the city on Thursday evening. While there was some amount of curiosity, none said they would visit the museum and pore over the files.

Mr. Subhas Chandra missing from his residence, search by relatives and friends - The Hindu

As the West Bengal govt. declassifies the Netaji Files, we bring to you this report from the January 28, 1941 edition of The Hindu.

Great anxiety prevails among the relatives and friends of Mr. Subhas Bose since last night, when it was noticed that he was not in his room where he had been confined since his release from jail in the first week of December.

It is stated that for some days past Mr. Bose had been observing strict silence and spending his time in religious practices. It is learnt that, as desired by Mr. Subhas Chandra Bose, no member of his family entered his room throughout Saturday, nor did Mr. Bose send for any one on that day. This caused anxiety among members of his family. On Sunday afternoon, they entered his room, but could not find Mr. Bose in his bed. Enquiries were made in all possible places including the residences of Mr. Bose's nearest relatives and friends, but so far no information has been received of Mr. Bose's whereabouts.

Some members of Mr. Bose's family believe that it is possible that Mr. Bose might have left his house some time on Saturday night.

The United Press adds:

Mr. Arabindo Bose, Mr. Subhas Bose's nephew, who was the only person allowed to look after Mr. Subhas Bose, in the course of a talk, stated that from January 16, Mr. Bose had taken a vow of silence and shut himself in his room which was partitioned by a screen, behind which he used to sit on a tiger's skin reading the Gita and other religious books, and meditating. Fruits, milk and water were placed outside the screen once a day, and the utensils removed only the next morning. If Mr. Bose wanted anything to be done in the meanwhile, he would place a slip outside the screen or ring the bell, but would not allow anybody to talk or disturb him.

On the 26th morning, Mr. Arabindo Bose, having found that the fruits and milk kept for Mr. Bose remained untouched since the previous evening, grew anxious and, after consultation with the other members of the family, dropped a slip over the screen, intimating that he would wait for half-an-hour, and if no response came by that time, would enter the room to see what had happened. Having had no response within the half-hour, Mr. Arabindo and the other members of the family entered the room and found Mr. Bose absent.

Intimation was immediately conveyed to Mr. Sarat Bose, who was in his gardenhouse at Rishra, a few miles from Calcutta. Men were sent to Belur, Dhakshineswar andv other places to find out Mr. Bose's whereabouts, but with no result.

Forward Bloc President's statement

The possibility of Mr. Subhas Chandra Bose having gone to Pondicherry is suggested by Sardar Sardul Singh Caveesher, Acting President of the Forward Bloc, in a statement to the Press TIIP Sardar Sahib says:

"I am shocked to hear that Mr. Subha Chandra Bose left his home yesterday; without any notice to his relatives.

"About a month back during my last visit to Calcutta, I had three pretty long interviews with him on the present Indian and international situation. Even then, I found that his illness had greatly told on his mind. He was much depressed that, at such a critical juncture, the Congress leadership had failed the country. I told him that public pressure was having its effect, and even Gandhiji had shown an inclination to adjust himself, to some extent, to the changed situation. I further told him that, by patient and steady work, it would not be very difficult to see that the Congress adopted the right course. But he had no such hopes. I found him talking like an inspirea person. He seemed to have felt during his illness that only sanyasis could free the country from its present bondage. He talked to me of some sanyasi ashrams in South India.

"During my present visit to Calcutta, I could not meet Mr. Subhas Bose and I could not know of recent developrflents in his mind. I, however, think that in all probability he has gone to Pondicherry."

No news from Pondicherry

"There is absolutely no news here about Mr. Subhas Chandra Bose", states a telegram received by Mr. Sarat Chandra Bose this afternoon from an inmate of the Sri Arobindo Ghosh's Ashram at Pondicherry, where he had sent a wire early this morning enquiring whether Mr. Subhas Chandra Bose was there.

Mr. Mukunda Lai Sarkar, acting Ser cretary of the Provincial Forward Bloc, has been sent to Chundernagore to make personal enquiries there.

Case against Mr. Bose, Magistrate issues warrant

When the case against Mr. Subhas Chandra Bose under the Defence of India Rules, came up for hearing before Khan Bahadur Wali-ul-Islam, Additional Chief Presidency Magistrate, the counsel for the accused informed the court that Mr. Bose was not in his house, and the members of his family did not know when and where he had left.

The Magistrate thereupon ordered the issue of a warrant of arrest against Mr. Bose under Section 38 (5) of the Defence of India Rules and for his production before him on February 3.

Mr. Bose is being prosecuted in this court in connection with a speech delivered by him at Mohammed Ali Park in April last and for the publication of an article entitled "The Day of Reckoning" in the English weekly Forward Bloc.

Following the issue of warrant of arrest against Mr. Subhas Chandra Bose, the Special Branch Police conducted this evening a search of Mr. Bose's residence at Elgin Road for over three hours, particularly, of the room to which Mr Bose was confined since his release from detention. They also examined some of the members of his family and the menials, and recorded their verbal statements on Mr. Bose's whereabouts.

As the West Bengal govt. declassifies the Netaji Files, we bring to you this report from the November 11, 1941 edition of The Hindu.

“It has been common talk in certain quarters in this country for some time that Mr. Subhas Chandra Bose is either in Rome or in Berlin and has entered into a pact with the Axis powers to assist by Fifth Column methods any German invasion of India. Leaflets to this effect have made their appearance in this country and leave no doubt that he has gone over to the enemy” said Mr. E. Conran Smith, Secretary to the Home Department, replying to a question in the Council of State by Raja Yuvaraj Dutta Singh as to whether there was any information in the possession of Government concerning the whereabouts of Mr. Subhas Chandra Bose and his activities.

Replying to supplementaries by Mr. Ramnarian Mahta, Mr. Conran-Smith said that the Government’s source of the information was certain leaflets, which had appeared in this country. They were too long to be read out, but he gave short extracts from two of them. These extracts were: “The day has arrived for rebellion in India. A pact has been signed at a Conference in Berlin. The revolutionary Subhas Bose was also present,” (2) “He (Subhas Bose) is now in a European country and is maintaining close contact with the Revolutionary Party in India. He has already issued a statement signed by his own hand. He is busy with certain foreign powers.”

Mr. Conran-Smith added that the Government had no information as to how Mr. Bose was able to reach Berlin or Rome.

After the question-hour, the President, in accordance with the usual practice, congratulated members of the Council who has been recipients of honour in the last Honours Gazette.

Report of death of Mr. Subhas Bose - French Broadcast unconfirmed - The Hindu

As the West Bengal govt. declassifies the Netaji Files, we bring to you this report from the March 30, 1942 edition of The Hindu.
The reported death of Mr. Subhas Chandra Bose in the circumstances descrlbed as an aeroplane accident, while proceeding to Tokyo, should be regarded with suspicion.

The first message from Japan concerning the aeroplace accident made no mention of Mr. Bose, either Mr. Subhas Chandra Bose believed to be in Berlin or Mr. Rash Behari Bose believed tobe in Tokyo, with whom Mr. Subhas Chandra Bose often confused. The news was received via the radio. It is significant that the German official news agency and the German home broadcast in their reference to the accident also do not mention any Bose.

The first reference to Mr. Subhas Chnndra Dose being involved in the Occident was made by the French broadcast, which said thnt the news s received from Tokyo messages. It seems to be that on the basis of these messages the death of Mr. Subhas Chandra Bose was assumed.

"BRAVE SON OF INDIA" - CONGRESS LEADERS' TRIBUTES

Mahatma Gandhi has sent the folowing telegram to the mother of Subhas Bose: —

'The whole nation mourns with you the death of your and her brave son. shore your sorrow to the full. May God filve you courage to bear the unexpected loss.—Gandhi",

Maulana Abul Kalam Azad. Congress President, has Issued the following statement to the Associated Press:

"I was shocked to read this morning the news of an aerial crash, in which Subhas Chandra Bose and some other Indians were involved. The tragic end of Subhas, while he was still in the prime of life, will cause deep sorrow to all those who knew him. In spite of differences with him regards the means of attaining India's freedom, it must be recognised that he lived and died for the cause to which he had dedicated his ife."

The Japanese News Agency today announced the death of Subhas Chandra Bose.

The Agency said that Subhas Chandra Bose died in a Japanese hospital from injuries received in an air crash. The Japanese News Agency, said: Mr. Bose, Head of the Provisional Government of "Azari Hind," left Singapore CD August 16 by air for Tokyo for talks with the Japanese Government. He was seriously injured when his plane crashed at Taihoku airfield at 14.00 hours on August 18. He was given treatment in hospital in Japan, where he died at midnight.

"Lieut.-General Tsunaraasa Shid was instantly killed and Col. Habibur Rahman, Mr. Bose's adjutant, and four ether Japanese officers were injured in the crash," the announcement said.

Last reports of Bose's activities from Japanese sources stated that he left Rangoon on the last day of its evacuation by the Japanese and had transferred his "Government" to Bangkok — Reuter.

Subhas Bose's last days - The Hindu
As the West Bengal govt. declassifies the Netaji Files, we bring to you this report on his last days from the September 9, 1945 edition of The Hindu.
Mr. Subhas Chandra Bose was being brought to Tokyo as the first step in his transfer to Manchuria where he was expected to seek safety and protection from the Russians at the time of his reported death in a plane crash on August 18, according to Mr Amar Lahiri, a former Indian journalist resident in Tokyo.

Both his political history and his friendship with a number of Russians and the fact that Generalissimo Stalin is once reported to have invited him to visit the Soviet Union made Russia the most logical haven despite the fact of Russo-Japanese hostilities being then in full swing, Mr. Lahiri declared.

These factors had indeed during the previous year made the Japanese anxious to put Mr. Bose in touch with the Russians to serve as an unofficial Russo-Japanese goodwill emissary.

Mr. Bose attended a conference in September 1944, in which the Japanese were trying to rally wavering East Asia to their support, Mr. Bose is reported to have told close associates that "Japan is going to be defeated and we must look out for ourselves as best as we can."

At that time the Koiso Cabinet is alleged to have promised him "that in case the war goes wrong we will put you in touch with the Russian authorities and you can be safe in Russia."

The account does not conform with the official Japanese Information Board announcement issued by the Japanese News Agency on August 23, which stated that Mr. Bose died in a hospital in Japan on ihe midnight of August 19.

The only explanation for five days delay in making Mr. Bose's death public is reported to be the feeling of Japanese authorities that the "stunning news would have bad repercussions in India," and they spent the intervening days discussing with Mr. Bose's Ministers how best to make it known.

both gandhi and nehru had definitely hand or knowledge about Bose disappearance. and its pretty dirty for sure. if I remember correctly Modi in pre election promised to declassify every file on bose.. but after coming to power govt of india declined to declassify any info regarding bose.
this tells 2 things..
1st. If declassified Nehru and gandhi dynasty will take a massive hit.. the image of gandhi has father of nation might come under shadows.. same can be said about nehru. Gandhi family who is doing politics in the name of gandhi for last 69 years will be reduced to dust and might create political mess in india.
2nd. if declassified .. it may turn into international issue as well.. we know bose was very close to Germany and Japan.. and russia on opposite side.. and atm india cant stand against them.. and certainly india wont indulge verbal war with these countiries for the sake of development which is certainly more important..

but yes truth should come out.. without damaging international relationship..

but main files are with PMO and classfied.. even filing RTI didnt helped much.. which i am sure will never be declassified..

Kolkata: Adding to the Netaji death mystery, West Bengal Chief Minister Mamata Banerjee on Friday said that some letters in the declassified files indicate that Netaji Subhas Chandra Bose was alive even after 1945.


The Trinamool Congress chief's comments came after sixty-four secret files relating to Netaji that could help throw light on his mysterious disappearance--an enduring enigma for seven decades --were today released by her government.

The Bengal CM also that the documents also support the theory that Bose family was snooped upon.

"There are intercepts. I have seen the documents and it is clear from them that the family of Netaji was spied upon," Banerjee told the media here.

She termed the snooping incident as unfortunate and said after India's independence the great freedom fighter did not get due honour.

"There are certain letters where many have said that he was alive after 1945," the chief minister further said.

An August 22, 1945, Tokyo Radio announced the 'death' of Netaji Subhas Chandra Bose in an air crash in Formosa (now Taiwan) on August 18, 1945, en route to Japan.

Fulfilling a long-standing demand, Banerjee described as "historic" the declassification of the closely guarded files on one of the country's foremost nationalist leaders and said people should know the truth. The Centre has 130 files.

Hidden in police and government lockers for years, the 64 files containing 12,744 pages were declassified here in the presence of Bose's family members who have been demanding that information on the leader of the Azad Hind Fauj(Indian National Army-INA) be made public.

"Today is a historic day. Our government has made all Netaji files public. People have a right to know about the brave son of India," Banerjee, who visited the police museum, tweeted.

Later, she said, "We made a beginning. The people should know the truth. Let the central government also declassify the files (on Netaji). Let good sense prevail on all of us. You cannot suppress the truth. Let truth come out.

"In 70 years, the mystery has not been solved. We did not know what happened (to Netaji). It is unfortunate. How long you can keep it under secrecy. You read the files in details."

Welcoming the declassification of the 64 files, Chandra Bose, Netaji's grandnephew said, "It is a correct step. Now it is the duty of the central government to declassify 130 files it has with it."

64 files which has been declassified and the remaining 130 files which is PMO is having will be declassify with time.

But we should keep in mind that these 64 files have been declassified when PM Modi is in Center.

During the LBA with Bangladesh , we have saw that PM Modi and West Bengal CM Mamata Banerjee gone together. When its about issues related to the Nation's interest and security then we have always saw that our leaders work together.

64 files which has been declassified and the remaining 130 files which is PMO is having will be declassify with time.

But we should keep in mind that these 64 files have been declassified when PM Modi is in Center.

i think it was Modi govt which refused to declassify remaining files..

it will.. but not at the moment.
