When shape and color of the copy become so similar to the original that the consumer might get confused, thats when the laws come into place.
Also with markings. I remember a Volvo S4 case of the 90's. They had a plan to start marking their models S4, S7 etc.... Audi sued Volvo because it had already reserved the name S4. They renamed into S40 the station wagon into V40 because Ferrari objected to F40 which was Volvo's original plan.
It takes very little to get a lawsuit filed against you on the basis of copyright/int.property rights nowadays.

if he really had bad intentiions like the salambook guy he would have gone on the net first and painted his site like the ones he copied
