Why I have been careful to say he is going to jail, not that he will be convicted of murder.

Maximum sentence for homicide not amounting to murder is 10 Years, much less than Death or very very long imprisionment in case of murder.

Here main flaw was police failed to take Dying declaration of victim ....now the main witnesses are the other guards ,wife of accused Nisham and Residents there ....Ideal solution for that is recording statements under section 164 Cr.P.C

See, the court can only give a sentence if the people say they saw it happen. If they change their stance, then court would be forced to deal with it, unless they have clear CCTV footage with both the victim and the accused in clear view.

Yes CCTV footage will be Key ...thats why i said recording statement of witnesses under section 164 Cr.P.C is the solution it will minimize the chances of changing their stance at the trial (i think its same in Pakistan also) ....But every thing is upto prosecution now don't how they will handle this case
