Murder charge for Indian tycoon accused of ramming guard

Lokayukta files case against police in Kerala Hummer case - Khaleej Times Mobile

The family members of 47-year-old Chandrabose had viewed this as part of an attempt to save Nisham and demanded a probe by the Central Bureau of Investigation.

Trivandrum — Lokayukta, the anti-corruption agency of India, has registered a case against the Kerala police for their failure to record the statement of the security guard, who died in the attack by millionaire businessman Muhammed Nisham at Trichur in Kerala last month. (There goes the case )

Up Lokayukta, K P Balachandran, suo moto registered the case against P C Bijukumar, Circle Inspector of Peramangalam police station, following suspicion expressed by the family members of the deceased about the investigation into the death by the local police.

The family members of 47-year-old Chandrabose, who succumbed to the injuries he sustained in the brutal attack by the businessman at a hospital in Trichur on Monday, had viewed this as part of an attempt to save Nisham and demanded a probe by the Central Bureau of Investigation.

A member of the medical team that treated Chandrabose had also corroborated the family member’s allegation. He alleged that the police had refused to record the statement of the deceased when he regained consciousness. The doctor said Chandrabose was in full consciousness for two days and he could identify people during that time.

However, the police have refuted the charge. A spokesman of the Trichur district police said that it was due to lack of cooperation from the hospital authorities. :P He alleged that the head of the medical team had not given permission to the investigating team to record the statement.

R Nishanthini, the newly appointed police commissioner at Trichur, recorded the statement of the doctors on Wednesday. She will also be taking the statement of the relatives of the deceased, who had alleged fouls play behind the police failure to record the statement.

The district police have also extended their investigation to the businessman’s wife Amal, who was reportedly present when Nisham had beaten Chandrabose with an iron rod after ramming his Hummer into him after he failed to open the main gate of his posh apartment complex in time. Amal was in the hiding since the incident.

Meanwhile, the Trichur Principal Sessions Court on Wednesday dismissed the petition filed by the businessman for bail, saying he may try to influence the investigators. The judge pointed out that he had compromised several cases registered against him using his money power and influence.

Sources said a case of drunken brawl registered against Nisham by the Bangaluru police had never reached the court. Similarly a case related to alleged rape of Bangaluru-based model registered against him is now in the cold storage. The Bangaluru police have not even questioned him in connection with the case so far.

Nisham was let off by the prosecution in a case related to the misuse of the picture of a woman, who is his relative, :cheesy: on Facebook by not opposing his petition to quash the proceedings in the case when it came up in the high court.

Kerala ............ land of high HDI :P

Well @Bang Galore ,what do you have to say about this?

.
Sounds like pure evil.

It is these kind of obnoxious bastards who lead fan flames of communism.

Here is a list of his deeds in which Cops and the Judicial system has been willing partners in crime.

1. Nisham said he was helped by the Bengaluru police chief in a case of drunken brawl in the city. The case never reached the court but that cost Nisham Rs 1.5 lakh, he said during the interrogation in the case of assaulting the guard at the posh residential complex in Thrissur where he stayed.

2. He was also accused of misusing the picture of a woman, his close relative, on Facebook. When he filed petitions before the High Court of Kerala to quash proceedings in the case.

3. Another case filed by Abdul Razak under the Information Technology Act, the prosecution chose not to oppose the plea of the rich accused.

4. Nisham was accused of attacking Vellur native Shamsuddeen but he successfully got the high court to nix the case after the prosecution kept away.

5. Nisham also revealed the cost of compromising with another merchant who had a shop near his textile showroom in Thrissur. Though the merchant had filed five complaints of assault against Nisham, he withdrew them after a top cop in the district prevailed upon him to do so. Nisam said he had to spend Rs 1 lakh on each of the five complaints.

6. A case of raping a Bengaluru-based model has gotten nowhere. Nisham has not even been questioned a year after the incident.

7. A case of attempting to murder one of the owners of the Malabar Engineering College is before the court. The Viyyur police have registered a case after Nisam led a few goons with deadly weapons to assault the victim in his house.

8. A drunken brawl in Thalasseri is also before the court.

9. He made his 9-year-old son drive his Ferrari and uploaded the visuals on YouTube. A case registered by the Peramangalam police for letting a minor drive is in progress.

10. A case of locking up a woman police inspector inside his car and a hit-and-run case are also pending before the court.

11. Cops had helped him compromise a case related to a tussle with his neighbours in a Kochi apartment.

12. He received similar help in a case of barging into a house and beating up a man after an altercation in a gymnasium.

13. A cheque-bouncing case has been dismissed with the help of cops and Judiciary.

14. Drunken driving case against Nisham have also been dismissed with the help of cops and lawyers.

Now, he had offered crores of rupees to a police officer to avoid an arrest. He had publicly said he was ready to spend any amount of money for the case. The shoes with which he kicked Chandrabose to death cost him Rs 5 lakh, he said.

That's damning for the Kerala police but with this now being a case of death, the rules are a bit changed. Courts don't go easy in high profile cases. He won't get off easily.

LOL. Seriously ? ....... how long does public memory last ? :cheesy:

Inspector General of Police T.J. Jose declined to comment on claims that influential Congress Party leaders and Muslim politicians had offered a cash payment to the victim's family to settle the case.

Kerala ............ land of high HDI :P

All this high HDI of Kerala is due to supply of slave labour to middle east.

I would prefer India to emulate capitalist economic model of Gujarat, Karnataka,Andhra, and Tamil Nadu (Gujarat being best) rather than slave labour based model of High HDI Kerala.

Pretty long in these types of cases. After the Jessica Lal case, there is pretty much no leeway given by judges in these sorts of high profile cases. Time will tell but I'm reasonably confident that this guy will end up in jail.

That's the thing about being a slave. IT never goes away. You raise your children to be good slaves too. Have you read the White Tiger ?

Depends on the price of the Security Guard.

Used to be that way but now judges don't want to be a target of 24x7 media. No real chance of getting away. Could have got away if the chap hadn't died but very difficult now.

The case is still fresh and this is what happens,

The dead man had a son and daughter who are students. A mother who is a house wife. How long before "blood money" kicks in ?

..... forget the family, how many are going to testify against him ? how long before prosecution refuse to show up ? evidences disappear ?

Jessical lal was a Model and Delhi elite backed the case, this was a poor hindu watchman in Kerala. No one gives a $hit. and those who give a $hist will not in a few weeks.

No, It would depend on price of Police hierarchy of Kerala.

Muder cases are automatically VS state type.

You are assuming that Police hadn't already destroyed all prosecutable evidence. This person has been given enough leeway in past that this is a possibility.

Also I think that the doctor which refused to allow police to record that Guard's last statement was on this guy's payroll.
