Man fined, jailed over second marriage without first wife’s permission

It is the position of ahle sunnah. You can take a second wife without the permission of the first one, however it is considered unwise to do so.

Now why is it considered unwise to do so?

Because we no longer have a culture of multiple wives, therefore it is not a cultural norm and so if you take a second wife, it might cause distress to your first wife. Also if your second wife is unsure about your first wife it may well cause anxiety to her. If one wife is displeased with you and the other is anxious, or one is happy and the second is jealous, then you are no longer doing justice - which is a pre-requisite of polygamous marriages in Islam.

This is why we have this notion in our culture that you need the first wives permission, or you should only do so if she is unwell or infertile or something like that. Those of us who are married know how fragile relationships are and how they are based on trust and sharing and confidence. The moment another partner is in the picture, they're instantly a threat - it is unsustainable for the happiness of a marriage imho.

A citizen is a States responsibility.

The state has to decide in this world if no individual rights are being broken and its citizens are not being oppressed.
Law and legislation always start with IF and But and thus why they are necessary.
I am totally for this law not because it is not only Islamic but it is a just punishment for the moral corruption our society suffers.

When it comes to question of inheritance and equal opportunity for its citizen the State has to answer to God and other private matters are then to be left for Allah to decide on the judgement day.

The law states that a woman has to take the State as witness thus ensuring the state has authority to jump in if individual rights are being discarded or abused.

Like I said the triple talaq was a Law passed as a punishment to get rid of the social evil of divorce for the sake of Lust by the 2nd Caliph.

Though on first reflection i don't agree with the law, you have a valid point about the responsbility of the state upon it's citizens. Having said that, the state has to be careful that it does not make that which is halal; haram.

The law is made to counter social evils and betterment of a collective society. Laws reflect the collective conscience and the evils that exist in the society.

There should even be a law which taxes additional marriage as some sort of luxury tax.

Though on first reflection i don't agree with the law, you have a valid point about the responsbility of the state upon it's citizens. Having said that, the state has to be careful that it does not make that which is halal; haram.

The state has not made more than one marriage HARAM and neither it is allowed to do that.

The state only has countered a social evil by making an Islamic law.

Consider a situation where individual rights of a person is not a states responsibility? Where will this person go?
To the courts? where some random person may decide and say let Allah deal with it in Qayamah?

The affairs of the people with each other are to be dealt with within this World and the affairs of the people with Allah are to be dealt with in Qayamah.

The region is prone to multiple wife syndrome even before Islam came to these woods. Atleast Islam gave a practical solution.

The Surah itself starts with 'IF' and thus by definition it can be molded into a law if there is consensus on its interpretation.

The biggest right of a Muslim is its insistence on JUSTICE the one thing Islam promised and not an excuse to marry for Lust and Power.

I think the law is correct and it should be strictly implemented.

The equation is simple. Both Men and Women are equal citizens and have equal protection of their rights in Pakistan.

If you are believing a guys emaan to do fair with multiple wives then trust a womans emaan to let you do that legally through a written permission.

The same goes for domestic abuse.

Problem simply is that Muslims interpret Islamic legislation through the eyes of MEN and not as HUMANS.

Quran was sent for Humanity and not for MEN only.

For such matters a healthy debate is needed and that place can only be parliament. But the mighty protector of Islam and Ummah, the Pakistanis, they elect Idols to the parliament not Humans.

No permission is required you need to stop mixing things. If man himself thinks he can do justice he can do 2nd marriage without first wife permission. Those supporting this thing and calling themselves Muslims need to study Islam and if they know already than decide either to stand with ALLAH and his RASOOL SAW or not

Is the ratio of men to women 1:4+? You're skipping over dozens of posts clarifying the environment of when the
rule came down.

You're also forgetting additional marriages are allowed when it's the only best situation. Best solution to a problem of wanting an additional place to stick your di<k isn't to get married.

This was followed by Sahabas so no it wasn't specific to conditioned to the thing you are mentioning

There is no condition and Muslim man can he just has a duty to inform first wife but he doesn't has to take permission this law is against Quran and Sunnah and only leading to social evils rather than resolving things

Lots of self appointed muftis here are trying to prove that their religion is absolutely OK with deceiving. Anyway as per Pakistan's law husband needs written permission from wife. So their is no problem with court decision.

As per the Holy Qur'an, Musilms are bound to obey the Law of the land as long as it does not contradict law of the God.

This law does not contradict the law of the God as Allah almighty hasn't made it "unIslamic" or "illegal" for the husband to seek permission from his wife for second or third marriage.

Moreover, in Islam marriage is a civil contract and any conditions can be added to the contract at the time of marriage. As the husband while signing the nikahnama accepts the pre-condition that he won't marry another woman without the permission of the council/first wife, if he marries another woman without permission he not only violates the law of the land but also commits a sin

Finally, this law had been challenged in the Federal Shariat Court of Pakistan and the apex Shariat Court dismissed the petition stating that there was absolutely nothing unIslamic about this law .... What's all the fuss about ?

The fuss simply is the corrupt politicians are being caught and their tax stealing 2nd 3rd 4th wife iqamas

They are the roles models things halal for Sahabas doesn't become Haram for all Muslims. Don't try to act GOD.
