Okay, I will admit I do not know if the husband need the 1st's wife permission to marry for a second wife.

But Islam talks about fair rights for women.

I am against men taking second wife willy nilly and marrying women for their own lust despite having a wife at home. And women should be treated nicely and fairly..and they should be given all their rights as much as possible by the husband.

Hu... everyone is talking about consent or not consent, but i'm quite sure if your mother was/is the "first" wife of your father who happened to have others second,third and why not fourth wifes, your positions wouldn't have been same. Your relations with others children (your step bro and sis ?) could have been very complicated with jealousy and what not, and if all pakistanis had more than one wife, could you imagine the genetics diseases which could be generated ?

According to Quran and Hadith one don’t need permission in the first place so this ruling is against the teaching of Islam .

Islam is the only major religion that says you should marry only one wife and even if you intend to marry more, there are a long list of conditions that make it very hard and near impossible for many people.

Polygamy was an actual necessity back then as males were significantly less in number compared to women due to war, exposure and many other factors. Most second wives back then were widows who lost their husbands, all of Prophet Muhammmad (SAW) wives were widows except one.

Section 6. Polygamy.

6.1 No man, during the subsistence of an existing marriage, shall, except with the previous permission in writing of the arbitration council, contract another marriage, nor shall any such marriage contracted without such permission be registered under this ordinance.

6.2 an application for permission under sub section (1) shall be submitted to the chairman in the prescribed manner, together with the prescribed fee and shall state the reasons for the proposed marriage, and whether the consent of existing wife or wives has been obtained thereto.

6.3 on receipt of the application under subsection (2) the chairman shall ask the applicant and his existing wife or wives each to nominate a representative, and the arbitration council so constituted may, if satisfied that the proposed marriage s necessary and just, grant subject to such conditions, if any, as may be deemed fit as the permission applied for.

6.4 in deciding the application the arbitration council shall record its reasons for the decision and any party may, in the prescribed manner, within the prescribed period, and on payment of the prescribed fee, prefer an application for revision { to the collector] concerned and his decision shall be final and shall not be called in question to court.

6.5 any man who contracts another marriage without the permission of the arbitration council shall :-
6.5.a pay immediately the entire amount of the dower, whether prompt or deferred, due to existing wife or wives, which amount if not so paid shall be recoverable as arrears of land revenue.

6.5.b on conviction upon complaint be punishable with simple imprisonment which nay extend to one year, or with fine which nay extend to five thousand rupees, or with both.


Sigh. The Qur'an is silent on the issue of permission just as its silent on the issue of registration of nikah which is section 5 of MFO. Our religion is for all times bcz it evolves with time ( evolution doesn't mean changes in the fundamental structure but in growth in accordance with time). Where silence was taken as negative, why couldn't it be positive? This is how ijtehad was to be utilized. To discuss and evolve. Not stagnant. Just like the copy machine and the sound amplifier were kafirs evil and are now printing the thousands of Quran and the loud speaker is the mosques voice. Bcz of this we will always be a hundred years behind the world and its a sorrowful fate for a nation that was 100 years ahead of the west just 1000 years ago.

I don't discuss these matters bcz religion is a very sensitive issue. My own belief is enough for me and i believe this law is Islamic.

Anyhow this law is applicable all over Pakistan and its your right so use it.

I've two mothers and I know how hard and can life can be for the wives , husband and children .
Having two wives is injustice .

Janaab prophet saww was an infallible person , a great human ever born on this earth and it's not the case with every men , not every men can b just like prophet saww especially seeing today's examples . They marry second woman cause they want to enjoy their lust nd then start acting unjust to the first wife nd her children . This was GOOD to read. My former VC, Faizan Mustafa, a legal authority in his own right, used to point to sensible Pakistani legislation to remind us that we could easily have done the same without offending the Muslim community. Reading this made it clear what he meant.

You need more education.

Nature of Islam you dont go around hitching women. A man's permitted given the first wife(s) is infertile, sick, or can't attend to her duty.

No permission is required you need to stop mixing things. If man himself thinks he can do justice he can do 2nd marriage without first wife permission. Those supporting this thing and calling themselves Muslims need to study Islam and if they know already than decide either to stand with ALLAH and his RASOOL SAW or not

A citizen is a States responsibility.

The state has to decide in this world if no individual rights are being broken and its citizens are not being oppressed.
Law and legislation always start with IF and But and thus why they are necessary.
I am totally for this law not because it is not only Islamic but it is a just punishment for the moral corruption our society suffers.

When it comes to question of inheritance and equal opportunity for its citizen the State has to answer to God and other private matters are then to be left for Allah to decide on the judgement day.

The law states that a woman has to take the State as witness thus ensuring the state has authority to jump in if individual rights are being discarded or abused.

Like I said the triple talaq was a Law passed as a punishment to get rid of the social evil of divorce for the sake of Lust by the 2nd Caliph.
