ISLAMABAD: Supreme Court judges hearing Justice Qazi Faez Isa's case appeared to be at odds over the government's counsel presenting his argument as the bench resumed proceedings on Thursday.

The situation became tense when Justice Maqbool Baqar urged the government's counsel, Additional Attorney General Amir Rehman, to not repeat his arguments as they were running short of time.

However, Justice Munib Akhtar told the counsel that there is no race as he may take time.

The conflicting directive did not sit well with Justice Baqar, who then reminded Justice Akhtar that this was no way to interrupt a senior judge. "This is too much!" he remarked.

The situation got more intense as Justice Baqar and Justice Sajjad Ali Shah also got into an argument over the latter asking the former to allow the counsel to proceed.

Justice Baqar stated that if "someone wanted to drag the matter for [their own] motive, then it is a different reason". He added that a coercive attitude will not be allowed [in the courtroom].

"[The] whole world is watching this case!" he maintained.

Endorsing Justice Baqar's opinion, Justice Mazhar Alam Miankhel and Justice Syed Mansoor Ali Shah asked the counsel to keep in mind that one member of the bench, Justice Manzoor Ahmad Malik, was retiring.

"Don't repeat your formulations on [the] same point," Justice Miankhel asked Rehman.

Later, Justice Umar Ata Bandial announced that the bench was taking a short break. However, Justice Baqar left the courtroom in protest before rising of the bench.

عامر رحمٰن نے کہا کہ عدالت کا اختیار ہو تو فیصلے میں آرٹیکل کا ذکر ضروری نہیں ہوتا، اس موقع پر جسٹس قاضی فائز عیسیٰ نے مداخلت کی تو جسٹس منظور ملک نے ریمارکس دیتے ہوئے کہا کہ قاضی صاحب! عامر رحمٰن شریف آدمی ہیں، انہیں بولنے دیں، تحمل کا مظاہرہ کریں اور وکیل کو دلائل دینے دیں۔


جسٹس قاضی امین نے اپنے ریمارکس میں کہا کہ ہم سب کھلے دل اور ذہن کے ساتھ بیٹھے ہوئے ہیں، جس پر عامر رحمٰن نے کہا کہ درخواست گزار بڑا آدمی ہے، اس لیے مداخلت کی جارہی ہے اور بار بار مداخلت سے میرے لیے دلائل دینا مشکل ہورہا ہے، جسٹس مقبول باقر نے ریمارکس دیے کہ آپ بہترین دلائل دے رہے ہیں جاری رکھیں۔


اس موقع پر ایک مرتبہ پھر جسٹس فائز عیسیٰ نے مداخلت کرتے ہوئے کہا کہ میں بڑا آدمی نہیں ہوں، مجھے بار بار رگڑا لگایا جا رہا ہے، جس پر جسٹس مقبول باقر نے کہا کہ قاضی صاحب مہربانی کریں۔
