The Supreme Court has said the Italian Ambassador Daniele Mancini cannot leave the country for now, a consequence of Italy's refusal to return two marines to face trial in India.

The judges have also asked the Italian government to furnish an explanation for reneging on its assurance that the naval officers would be sent back.

The Ambassador, who had given the court a written guarantee that the marines would come back to Delhi by March 22, has to share his response by Monday.

Earlier this week, Italy informed India that despite its guarantees, the naval officers would not be sent back. The Supreme Court had allowed them four weeks at home to celebrate Easter and vote in the national election.

The Prime Minister yesterday warned that "there will be consequences" if Italy does not respect its commitment to the Supreme Court. Before it decides what those consequence might be, the government reportedly wants to wait till March 22, the deadline set by the Supreme Court for the return of the marines. Amid reports that the government may retaliate by expelling him, Mr Mancini asserted yesterday, "I will not leave this country till a competent authority makes me a persona non grata."

Italy says that its decision was taken after India ignored its written offer for diplomatic negotiations, and because New Delhi does not have jurisdiction over the case. (Read: Will search for an acceptable solution, Italian officials tell NDTV)

The marines were guarding an Italian tanker off the Kochi coast in February last year when they say they mistook two fishermen for pirates, and shot them.

Italy claims the shooting took place in international waters; India disagrees.

He can not leave means he has been put on alert list by Indian Immigration authorities, he wont be allowed to board the aircraft or vessel. He need not be arrested.

(Reuters) - India's top court has temporarily barred the Italian ambassador from leaving the country amid a dispute between the two countries over the killing of two Indian fishermen by Italian marines, a lawyer in the case said on Thursday.

India had summoned the Italian ambassador on Tuesday to protest at Rome's decision not to send two marines charged with killing the fishermen while on anti-piracy duty back to India to face trial.

"The Chief Justice issued a notice to the Italian ambassador stating not to leave the country and has sought a reply from the ambassador by March 18," said Viplav Sharma, defence counsel for the Italian marines.

Persona non grata the ambassador- after he submits his answer- and eventually he will have to go back- and thats all to it-

That would be to expel him, by declaring him persona non grata. But does the Indian government have such guts? One of the marine is friend of Sonia's friends. And this white woman rules India. MMS is a rubber stamp.

For damaging ties with an economically important country? Hardly a heroic display. Not his fault though, just the guy left holding the baby.


The SC getting involved is not good news. The Italians should have withdrawn their ambassador immediately. Cowardly way out but would be better than to face damaging remarks from the supreme court.
 
I am waiting for the result of this incident and I give my 1$ to nothing gonna happen. Italian marines will never go back to india again for getting a trial, they may go there for a trip serveral years later.

Nothing will happen. The current Indian government is neck deep in corruption, some of the big shots are involved in the recent Agusta Westland Scam. Italian government has all the names and details which they ll use to blackmail and leverage the corrupt Indian government and ensure that the marines are never sent to India.

All these statements by the Indian government is mere hogwash.

This is a two way affair mate, Augusta westland deal also involves some key persons in Italy :cheers:.

It is Supreme court that is dealing with the marine case and so the court has the authority here.

What is important with Italy here, as for as the trade figures are looked into.
Its just paltry 8 billions. In the same vein Dubai tops with ten billions and more. Then there are more countries......
This was a absurd logic.
 
Its really a bit worrying. Our SC has no option but to issue such directives considering---Italian action is nothing short of a betrayal.

They should have withdrawn their envoy immediately. Even a child could have predicted this.

The is nothing heroism in not keeping your pledge. Nobody will ever believe in Italy. This unwarranted action by Italy has brought it international dis reputation.

Actually there was nothing in the case. Both the marines would have been acquitted by the courts. Now it will take decades for India and Italy to have normal relationship
