ISLAMABAD, March 6: In what may be the first such case in Pakistan’s history, four civilian employees of the Inter-Services Intelligence (ISI) have approached the Islamabad High Court (IHC) with complaints about their own chief, ISI Director-General Lt-Gen Zaheerul Islam.

They claim that he, along with other senior government officers, should be charged with contempt of court, regarding an IHC ruling on regularisation of employees.

The four men, Grade-18 officers, claim to have been working for the past seven years as junior analysts in the ISI, on a contract basis.

They claim that their contractual appointments were limited to five years, after which they were to be made permanent employees.


Along with other federal government employees, the four officers came to the Islamabad High Court late last year, and on December 31, the IHC directed the government to “regularise the services of contract employees”.

A cabinet subcommittee supervised the process at various ministries and departments, but these ISI employees were not regularised.

The ISI employees have asked the IHC to initiate contempt of court proceedings against Lt-Gen Zaheerul Islam; Lt-Gen (retired) Asif Yasin Malik, Secretary of Defence; Tamiur Azmat Usman, Secretary of the Establishment; and Syed Khursheed Ahmed Shah, chairman of the cabinet subcommittee on regularisation of contractual employees.

They claim that the respondents did not comply with the IHC’s December 31 ruling.

An ISI official, however, told Dawn that contract appointments in the ISI are different from those in other departments.

“Regular appointments can only be made after candidates complete competitive exams and undergo psychological and intelligence tests,” he said.

The four petitioners, he claimed, “cannot get permanent positions in the ISI without going through these steps”.

The army-related litigation has increased manifold in the superior judiciary after the restoration of chief justice of Pakistan Iftikhar Mohammad Chaudhry in 2009.

The Supreme Court on a number of occasions summoned the army authorities and issued directions to the senior army officials.

The apex court in November last year deciding Air Marshal (retired) Asghar Khan’s petition filed in 1996 accusing the ISI of distributing Rs60 million among the politicians to manipulate the general elections of 1990 also ordered for ceasing political and election cell in the ISI Military Intelligence and in the presidency.

In the Lahore High Court (LHC) Rawalpindi in whose jurisdiction military’s General Headquarters falls, over 100 army-related petitions are pending for adjudications.

Most of them are service related matters.

Since the establishment of the IHC in January 2011 over two dozen petitions have been filed in which ISI has been one of the respondents.

These petitions were mainly filed by the heirs of missing persons who allegedly picked by the spy agencies.

In the past the courts used to avoid taking up such matters because of article 199 (3) of the constitution which bars the court from taking up cases related to the service of personnel of armed forces.

Intresesting case however I don't see the point of this petition, it does not matter for how long they had been working be it 2 years or 10 years, if you are not competent enough then there is no place for them at the top, they should have known this after working in the organization for 7 years.
Same kind of issue has already ruined the IB, where political appointments were made when this govt came.

That's how Civilians get admission in ISI at first place through Federal public commission exam and Ministry of Defence hired them through this process. Why even after 8 years of service they require competitive exams and undergo psychological and intelligence tests?

They get admitted to 17th Grade initially and doesn't promotion is tied to the performance?

Bcoz this is ISI , not the Police or FIA .

you don't perform , you don't get promoted . If you don't like it don't join it in the first place . it is not a place for kids to play James Bond .

ok answer this you know CSS is the toughest exam in the country,engineers and doctors take these tests. Once you are selected you go under training at CSA, you have to clear exams, though you become CSP member but you can't get posted until you clear the exam.
Once you are posted you go through number of courses in your service tenture, you cannot progress in your career if you don't take these courses.
These people got promoted to BPS -18 from BPS-17, isn't that enough, no one should be allowed to go up the ladder unless you are competent enough

forget about ISI, look at Private sector organizations, don't they have the same procedure all over the world. if a cleaner works for 18 years in a bank, do you expect him to be a branch manager one day?
 
Well this D Lt. Gen. Zaheer is politicians fav & he was picked hand picked by politicians to replace the best Gen. Pasha, so far up till now Lt. Gen. Zaheer haven't done anything like Gen. Pasha. Personally I don't like him, he is not the right person for the ISI.

ISI being the best Intel agency in the world, over here only the best should be the DG of the best, ISI.
 
Well i guess they proved why they were not made regular .
Besides IHC has no jurisdiction over affairs of ISI
Under which jurisdiction ISI comes in ?
 
DG ISI reports directly to the Prime Minister and the ISI is under the domain of the Military as it is the premier intelligence agency of the Armed Forces.

In theory, my dear Sir, only in theory.

What the ISI does is too important to be left to the whims of whatever idiot holds the office of Prime Minister, specially these days.
 
well ....you are telling me that don't want to pass the competitve test of ISI and want to be promoted on doing some repetitive work hmmmmm...not sure but be in every organization you need to prove yourself aur ISI apni employees main discriminate nae krte.....as morale is important
 
What has been the response of the court ? Has it thrown the case out ?? Are the courts now running Intelligence agencies as well?

I fear this over reach of the judiciary - the case should have been thrown out immediately and these 4 transferred to offices in B'stan, where their talent and drive to achieve could be allowed be blossom to their full potential.
