Brussels: European Union foreign policy chief Catherine Ashton on Tuesday defended Italy's envoy to India, prevented from leaving the country due to a row over two Italian marines who skipped bail while on trial for murder in New Delhi.

A statement from Ashton's office said she "notes with concern" an Indian Supreme Court decision the previous day requiring ambassador Daniele Mancini to seek permission of the court to leave the country.The 1961 Vienna Convention on diplomatic relations "is a cornerstone of the international legal order and should be respected at all times," the statement said.Limitations to Mancini's freedom of movement "would be contrary to the international obligations established under this convention," Ashton added, while urging the parties to find a mutually acceptable solution through dialogue.

India's top judge ruled that the envoy forfeited his diplomatic immunity over his role in securing the release of the pair who are accused of killing two Indian fishermen.

Rome said India was breaking diplomatic conventions by ordering the envoy to stay in India until the next hearing in the case on April 2.

Chief Justice Altamas Kabir said Mancini, who had negotiated the Italians' release last month so they could vote in the Italian general election, had waived his immunity by giving an undertaking to a court that the pair would return.

The marines, Massimiliano Latorre and Salvatore Girone, are accused of shooting dead two fishermen off India's southwest coast in February last year, when a fishing boat sailed close to the Italian oil tanker they were guarding.

They say they mistook the fishermen for pirates.

The pair had been given permission to fly to Italy to cast their votes on the understanding that they would return, but the Italian government announced last week it would renege on its commitment to send the men back.

dude whether India bars him or not he will stay for 1-2 years more in India. A normal term for a diplomat. l. It is only about the rights of a diplomat which will be settled after few procedures.
 
Good to see him confirming what we have been saying here all along.

- Italy believes the marines were arrested through trickery in the first place.
- The ambassador is just a messenger; the SC surety was given by the Italian Govt. not Mr. Mancini as a person.

Don't know if Italy believes that or not but as a Pakistani it is your holy duty to think what ever Indians did was trickery.. But anyways carry on with your display of common Pakistani mentality..

Their main problem is India can fight with west but thier country can't.

This thing is best not dragged out. India must give the Italian ambassador marching orders, ban Italian companies from government contracts (private can continue) and keep the diplomatic relations on a low keel for the foreseeable future.

India should not give the chance for the Italians to seek the high moral ground here.
 
The entire Western Europe is gonna do a gang banging. They tend to speak in one voice.

Britain - Really good relations with India .Also , they doesn't usually deeply get involved in EU matters
France - Excellent relations with India , didn't even say anything when we conducted a nuclear test.
Russia- I don't need to say
Germany- May whine to an extent, but has a growing relationship with India, so the whining won't last that long. Germany is the only country that really matters and would be India's biggest loss if it takes sides with Italy.
Portugal , Greece , Spain- Reputed members of PIGS economy club. They have so much **** to do back home that I highly doubt they will give a damn. Youth unemployment in these countries is around 50%. They don't have the time or the money to sacrifice for 2 Italian marines. If they even care a tiny bit about their economies, they won't get involved in the dispute.
Nordic Countries - (Sweden , Norway ,etc) - Yes , these countries always tend to poke around in these matters and could try to create trouble for us.
Netherlands,Belgium,Lichenstein , luxembourg - Too tiny to make a difference to us
Switzerland - Might halt the export of chocolates and cuckoo clocks to India. Also ,indian honeymoon couples will have to find some other country to have sex if they stop giving tourist visas.
Austria - Oh of course , it's the Vienna convention after all , I expect them to take the whining to a whole new level.

It's got nothing to do with me being Pakistani. It is the view of online comments within Italy. It is the view that Mr. Bhadrakumar (sp?) relayed.

You can continue denying it -- calling it a Pakistani claim -- but that won't change the Italian view.

Haven't read up on the details of how they were apprehended to form an opinion either way. At this point, compared to everything else that has happened since, it probably matters little.

No he is not, he is the representative of the Head of the State of a Sovereign Nation. This is why the Ambassador is immune from the local jurisdiction of the State he is assigned too. The Indian President accepted the credentials of the Ambassador when he presented them, thus the Indian Government accepts the inviolability of the Ambassador as your President accepted his credentials.

There are 2 sides to it arnt there? You beeing a pakistani has every bit to do in believeing the Italins.The only other thing that aids a mind believe in,ie facts.. are disputed. The irony here is ... the habbit of Pakistanis and Chinese calling us "White mans foot lickers".Now when we are staning upto them, who is licking whose foot is obvious!.So the conclusion that its your holy duty to think Indians are allways wrong,isnt a stretch of imagination.About the italian view couldn't care less. Its our view that we fight for! That boat was unarmed.. no wepons what so ever. The boat dint even try to board the ship.Only thing it might have done is turned in the wrong direction.You do not get excused of killing our fishermen just because you are paranoid!. The fact is they tried to run away from the scene! The Coast Guard had to haul them back.These Italians tried to con us and get away from the very begining. The facts of the case are in doubt. agreed. The supreme court was ready to listen to them. They were even ready to listen to the arguements of Jurisdiction.But they chose to lie again and run away.Cause they had nothing to prove their claims. They knew it would be imposible to win a legal case once the Supremecourt is into in.
They have undone the respect we had for them. The Supremecourt rightfully represants this view with its strong reactions.
It is the Italians who have muck on their face. we have nothing to be ashamed of. I agree with Banglore... we should respect vienna convention, and not give Europians a chance to point fingers at us.Jailing the Ambasador gives us nothing. only puts a spot on our case.we shoul hurt them where it stings .Should stop all trade and diplomatic activities immediately,until they apologize for the contemt of Indias supreme authority and return the marines back. But its the supreme court that decides now. Its their word that will decide the matter. Government has no say. To all Asians... The Europians are united in protecting Italy. They are ok with lies deciet and murder.Where do we stand? Its obvious.... quaralling....with each other, trying to pull the other one down.While the Europians have a laugh at us.Pity.
 
Just put him in jail for 2/3 hours and then let him go......so that Indian govt. gets a face saver.

I dont see the marines coming back to India.
