Pakistan can do squat to prevent this pipeline. Your territorial water ends at 12NM. You cannot prevent India or anyone else from laying down a pipeline even 13NM outside your coastline.

Again the clause (1) sub clause (c) of Article 87 is referring to the Part VI of the convention (which deals with the 'subjective freedom' of state or states for laying Submarine cables or pipelines on the continental shelf); in order for State or States to exercise the given 'subjective freedom' by UN under the convention to lay the undersea pipeline the following clause 79 of Part VI is applicable, which is stated below

Submarine cables and pipelines on the continental shelf
3. The delineation of the course for the laying of such pipelines on the continental shelf is subject to the consent of the coastal State.
4. Nothing in this Part affects the right of the coastal State to establish conditions for cables or pipelines entering its territory or territorial sea, or its jurisdiction over cables and pipelines constructed or used in connection with the exploration of its continental shelf or exploitation of its resources or the operations of artificial islands, installations and structures under its jurisdiction.

The clause 3 of article 79 of the UN convention on the law of sea has explicitly mention that consent of coastal state is necessary for delineation of such pipeline projects; while the clause clause 4 has clarified that no given freedom to States (other then COASTAL STATE) under this clause affect the right of coastal state over its jurisdiction in EEZ.

Now back to Article 58 clause 3 (mention as under) clearly instructs STATES to respect & to comply with the LAWS & REGULATIONS of COASTAL STATE in EEZ

In exercising their rights and performing their duties under this Convention in the exclusive economic zone, States shall have due regard to the rights and duties of the coastal State and shall comply with the laws and regulations adopted by the coastal State in accordance with the provisions of this Convention and other rules of international law in so far as they are not incompatible with this Part.

Now after quoting these number of clauses which have made it clear that India can't even 'initiate' the pipeline project in Pakistani EEZ all its own without the consent (read 'approval') of Pakistan; I want to ask you that how did you reach to conclusion that India have all the right to lay down an undersea pipeline in 'Pakistan's EEZ' but Pakistan have no right under the the international law even in Pakistan's EEZ & why you ignored the following wordings of Article 58 clause 1 (posted by you in your post)

The article is wrong, looks like they haven't read UN convention on laws of the sea properly. As per UNCLOS, Pakistan only has economic rights(fishing, oil exploration) to it EEZ, It can not stop the passage of a pipeline or cables outside its territorial waters..

Have you ever read Indian maritime zones act of 1976, one that it had submitted to UN in compliance with deposit obligation pursuant to UNCLOS? Almost all the states in their legislation has kept a room for maneuvering. UNCLOS states that all states shall have the right to fly and navigate in coastal state's EEZ but India laws provide that government mayl designate areas in the EEZ where the entry and passage of foreign ships will be regulated by the establishment of fairways sealanes, traffic separation scheme.The designated area in EZZ may have provisions pertaining customs and other fiscal matters.

This one is important, section 7.

Without prejudice to the provisions of sub-section (2) and subject to any measures that may be necessary for protecting the interests of India, the Central Government may not impede the laying or maintenance of submarine cables or pipelines on the continental shelf by foreign States. Provided that the consent of the Central Government shall be necessary for the delineation of the course for the laying of such cables or pipelines.

Question, if in some manner, morally justified or unjustified, a pipeline which is to be laid by a third state in Indian waters impinges the national interest of India - will the government of India give its consent? No consent means no project until UN or some legal body quashes Indian concerns. Indian government can levy some sort of charges if it deems fit.


In short it's all about diplomatic relations.

Pakistan legislation on its waters is almost same, btw.

You still don't get the term Exclusive economic zone. Pakistan has economic rights hence Pakistan can claim royalties for the passage of pipeline through their zone.

This Gentelemen is what we call a pipe dream not a pipeline. Sort of like the LCA, yep its coming, its coming, almost there, just another year, any minute now.

The Blue part is the extended component of our waters and there is no way pipeline could go to India without going through Pakistani waters.

Our Pakistani friends were jumping for joy after hearing that India cannot lay a pipeline without the permission of Pakistan!

Now as per Article 58 they can do squat to prevent India from doing so! The bubble has burst, and how!! :lol:
