Impeachment

I think Musharaf must have a few aces up his sleeve, that is why we are seeingthe assembly session called. Perhaps he thinks they will give him an open and clear chance of defending himself, which is highly unlikely. To be honest we have to see how things pan out.

My knowledge of Pakistani law is zilch and I have to discuss this matter with a retd high court judge, who happens to be a family member and a dear and respected friend. The situation was that the SC allowed him to stand in the election but asked for the results to be held in limbo till it had reached a verdict.The bench did not have CJ chaudhry as he felt his presence would be detrimental to the case. Aruling was made that the election is illegal. However, before the SC bench could issue its verdict , the judges were sent home(Nov. 2007). Knowing the calibre of people on the bench, they would have ruled with common sense and would have taken into consideration all these laws.

Yes, the Supreme Court allowed him to run for elections because he was eligible, as per constitution, to run for elections and hold dual office. The verdict came in musharraf's favor.

Constitution of Pakistan - Article 63 clause (1) paragraph (d), read with proviso to Article 41 clause (7) paragraph (b), allows the President to hold dual office. The Supreme court gave their verdict as per this article, which was passed by NA by 2/3 majority.

When this first verdict came in Musharraf's favor ... Qazi Hussein immediately filed another case against Musharraf the very next day. The ex-CJP decided that they second petition will be now be presided over by 7 judges. Later increased to 9 judges and then 11 judges. A joke was going on. Just becasue Musharraf won his first case... they (ex-CJP and Nawaz) wanted to make sure he doesn't win the other one. To hold the results was another drama, with no justification given.

First of all, the Ganja's sentence that was forgiven in 2000 by his President Rafiq Tarar, that allowed him & his family to run scot free away to Saudia .... should be withdrawn. Nawaz should be thrown back in jail and should serve his sentence verdict by Supreme Court in year 2000 (which also BANNED him to hold public office for 21 years)

One may not disagree that Zardari & Rehman Malik & Co are a few of the most corrupt persons in Pakistan's history but why they were facilitated through NRO (Natural Re-Corruption Ordinance)???

GEO reported one month back, that Shahbaz Sharif withdrew some 5000 cases in Punjab against themselves in ONE day.

Without NRO ???? Do you really believe that these corrupt feudals mafia businessmen need NRO to relieve themselves of cases?

And in my humble and patriotic opinion, Musharraf not only should be impeached but he should also be made to face a real trial so that we could make a history of putting our leaders on trial as well. And all the corrupts including the Zardari and co should be put into jail for a fair trial before an independent judiciary head by Iftikhar M. Choudhary. :pakistan:

But my dear countrymen in order to have a brighter future and to see a democratic Pakistan flourishing with everybody keeping itself within is own granted limits, we desperately need an independent judiciary.

Please first make your independent judiciary free of corruption. The Transparency International calls it the most CORRUPT institution of PAkistan, alongwith Police & Parliament.

The day that President Musharraf goes then the following plan will be in its final stages .... Balkanization of PAkistan (the map available on internet)

NWFP - annexed to Afghanistan with ANP in the lead role, in the interim the Americans favourite terrorist Baitullah Mehsud will continue with Al Qaida's chaos theory.

Balochistan - will continue to descend into warlordism with Aghan intelligence and RAW continuing to back the BLA/BRA.

AJK - To India.

Punjab & Sindh - will become/remain the personal fiefdoms of NS and Zardari, whether they remain part of the same country will be at their discretion. Let there be no doubt that Zardari is a successionist, how many times has he blackmailed the country with talk of taking Sindh for the Sindhis?

The day that President Musharraf will be the darkest day in Pakistan's history, as someone once said in Britain 'can the last person to leave please switch off the light'.

The USA indirectly wants the president out! With Musharraf out, ISI weakened and Army toppled .... their plans for Balkanization will be implemented faster. The crooks will run back to Dubai, Saudia, UK & USA.

Even today the USA stated that theyll not interfere in Pakistan's domestic affairs, and they also expect the Army not to interfere. They'll side the so-called government. Why did they interfere when they wanted Musharraf to doff his uniform? Why did they interfere when they wanted him to avoid emergency, calling it a mistake of musharraf?

Actually, Musharraf is going along with China and accelerating the combined plans for regional dominance, with technological developments & Gwadar .... becoming a nuisance for USA, India & Afghanistan. Efforts are going on to undermine & malign the ISI (Pakistan's frontline defence) with world media distorting stories and projecting the ISI as a shady, inhuman & malicious organization protecting Taliban (against US interests).

We should not forget that Musharraf was the one who implemented NRO. Why did he do so, what were the reasons, only he knows, also our pathetic Awaam is the one who choose their leaders, who every time are made fools in the name of Roti kapra, so if people of Pakistan does not deserve Pakistan, what can one person do? We have no sense at all of whats going on all around us other then our homes. This kind of attitude will serve no purpose other then leaving us into more chaos. So in then end God bless Pakistan.

Sounds like American are not happy with Mushi, after ISI reversal. So, now a blunt campaign started against Mushi. Who is big protector of Army interest in govt.
But according to Aitzaz Ahsan, this just another drama from PPP to run away from lawyers promise.

The darkest day in the history of pakistan would be when pakistan get deprived of musharraf. This guy has done some mistakes like lal masjib, waziristan but he never commited mistakes comitted by people like nawaz and zardari. These leaders take money of our country and have their mills and houses and accounts outside country. Atleast musharraf have the guts to come and say what he plans no matter people like it or no unlike these leaders who keeps on promosing and unfortunately have got illiterate nation, who comes under their spiritual speeches. They said once we come to power , all problems like inflation, electricity and others would be solved, and now they say damage done in past was soo much it will take time.

Pak Army to ask Musharraf to resign in a week: reports

LONDON: Pakistan Army is to ask the country's embattled President Pervez Musharraf to relinquish office in a week's time as its top brass will not want him to be impeached, a news report said on Saturday. ( Watch )

Quoting a senior official from the ruling government coalition partner the Pakistan's People's Party, The Daily Telegraph said that Army Chief Gen Ashfaq Kiyani has already "whispered in Musharraf's ear that it is time to leave".

"Over the next few days they will make it clear to him (Musharraf) that a protracted battle (against impeachment) is not in Pakistan's interests," the unnamed official claimed.

One of the main arbiters of power in Pakistan, the Army has already publicly declared that the military would take a "neutral" stand on the country's domestic politics.

"The Army is neutral but is expecting him to resign. It will then influence his honourable safe passage as the Army's senior leadership would not want him to be punished," a former military aide to the President told the British daily.

Meanwhile, President Pervez Musharraf summoned Pakistan's National Assembly on August 11 during which the ruling coalition is likely to bring forward an impeachment motion against him.

Musharraf signed a summary convening the Assembly on Monday, officials said without specifying the agenda.

With the Senate, the upper house, already in session, the summoning of the Assembly may set the stage for the government to bring the impeachment motion which the coalition decided on Thursday.

Half of the 442 members of both the houses are required to give a motion for impeachment to the Assembly Speaker and if allowed it would be taken up for discussion in a joint sitting of the two houses.

Musharraf, 64, who has dug in his heels and indicated he would battle it out against the ruling coalition's moves and would not step down, will also have the right of reply in the discussion.

The ruling coalition comprising PPP, PML-N and some others parties are short of the two-thirds majority needed to oust him but are confident of mustering the magic figure of 295 to impeach Musharraf.

The National Assembly has 342 members while the Senate has 100.

If the motion is passed by Parliament, Musharraf will have the ignominious distinction of being the first Pakistani President to be impeached.

Both Chaudhry Shujaat and Shaikh Rashid have ruled out dismissal of the assemblies, and Rashid has suggested that Musharraf may not have the numbers to survive impeachment.

ISLAMABAD: Pakistan Muslim League-Q President, Chaudhry Shujaat Hussain has held an important meeting with President Musharraf here. In the meeting, Shujaat suggested that the President should face impeachment democratically.

According to Geo News, in his meeting with Musharraf, PML-Q President said that country couldn’t afford confrontation any more. Shujaat also told Musharraf that if the President would face impeachment democratically, then the PML-Q would stand by him.

However, Chaudhry Shujaat made it clear that if the President tries to use 58-2(b), then he will have no support from PML-Q. Shujaat suggested Musharraf that he should step down before the start of the impeachment proceedings and the president should avail the opportunity to make an honorable exit.

Sheikh Rashid may have said that, but The News does not quote Shujaat or anyone else for that matter.

It might be true, but I think he'll go down swinging! IMO that would be a lot more honorable and true to his legacy...

Impeachment nomination being challenged in SC

Three options to file a cause for impeachment:

1) Mental or physical disability
2) Violation of the constitution
3) Serious misconduct

1 Nada
2 Protected by a referrendum, vote of confidence and two supreme court rulings
3 Nada

This I feel is the most likely thing Mush will do. He will refer it to the Supreme Court. Kahani khatam.

Numbers game.

295 needed. They have 298, not 303. There are 10 Q leaguers who are doubtful.

so that' makes it 308.

there are 5 PPPP's and 6 F leaguers who might come out in support for Mush, that brings it down to 297.

Now if Mush can just retain a few more of those doubtful Q leaguers that would be it.

And if JI and FATA support Mush, then it will be all over for the coalition. Remember its always been rumoured that Fazlur Rehman has been a secret ally of Mush dressed up as a foe.
