There's a ruling on such a case. USA denied access to Argentina (iirc) stating citizenship proof was not submitted and Argentina took case to ICJ. ICJ rejected Argentina's plra and said the citizenship documents must be provided for access.

So you Indoos still need to complete those formalities.

For India to provide you or assist you in his conviction, you have to abide by the Vienna convention and inform us “without delay”, which you didn’t. Second, in order for us to ascertain that he is an Indian National, consular access must be provided. Also not completed.

How exactly are we to provide you those documents without you following legal process?

ICJ has ruled in another case that a country can deny access without proof of citizenship.

India will have to provide it or take the case to ICJ again.

India has not provided any documentation of his identity

India will need to provide this documentation inorder to prove he is a citizen before being provided consular access

We will then review hia case as per Pakistani law

Then we will hang him!

In the ICJ hearings, Pakistan posed this question of proof of citizenship demanded and India didn't provide.

Why didn't India provide proof?

No issues with non binding access verdict. But India wanted release and return and all 15 judges didn't even bother responding to such ridiculous demand - so all 15 showed you middle finger, including your own judge!!!
