But first Indoos have to write an access request letter and attach the proof of citizenship. That could be a long while to go.

Imagine the humiliation when the second passport copy gets released in media.

They'll just carry on with media war because going back to ICJ without giving proof of citizenship to Pakistan is a big NO. There's precedent in another ICJ ruling already.

This post clears everything up:

On behalf of the Government of India,
“(1) The Government of India requests this Court to adjudge and declare that, Pakistan acted in egregious breach of Article 36 of the Vienna Convention on Consular Relations, 1963 (Vienna Convention) in:
(i) Failing to inform India, without delay, of the detention of Jadhav;
- 10 -
(ii) Failing to inform Jadhav of his rights under Article 36 of the Vienna Convention on Consular Relations, 1963;
(iii) Declining access to Jadhav by consular officers of India, contrary to their right to visit Jadhav, while under custody, detention or in prison, and to converse and correspond with him, or to arrange for his legal representation.
And that pursuant to the foregoing,
(2) Declare that:
(a) the sentence by Pakistan’s Military Court arrived at, in brazen defiance of the Vienna Convention rights under Article 36, particularly Article 36 paragraph 1 (b), and in defiance of elementary human rights of Jadhav, which are also to be given effect as mandated under Article 14 of the 1966 International Covenant on Civil and Political Rights (ICCPR), is violative of international law and the provisions of the Vienna Convention;
(b) India is entitled to restitutio in integrum;
(3) Annul the decision of the Military Court and restrain Pakistan from giving effect to the sentence or conviction in any manner; and
(4) Direct it to release the Indian National, Jadhav, forthwith, and to facilitate his safe passage to India;
(5) In the alternative, and if this Court were to find that Jadhav is not to be released, then
(i) annul the decision of the Military Court and restrain Pakistan from giving effect to the sentence awarded by the Military Court,
or in the further alternative,
(ii) direct it to take steps to annul the decision of the military court, as may be available to it under the laws in force in Pakistan,
and in either event,
(iii) direct a trial under the ordinary law before civilian courts, after excluding his confession that was recorded without affording consular access, and in strict conformity with the provisions of the ICCPR, with full consular access and with a right to India to arrange for his legal representation.

I thought ICJ already confirmed his citizenship as indian...considering his defence came from india!

It’s more like boredom at this point.
This was entertaining for while during the afternoon slowdown, I don’t have the patience anymore to type...

Besides, not like you or I are going to single handedly win KJs freedom or conviction arguing over this forum.
So practically speaking, this is entertaining (informative in some cases like the staff member who’s very succinct) but quite useless in real terms.

I’ll be back tomorrrow. I’ll drink a cold one to your victory, happy?

Another thing about Indian celebration.

If Pakistan wanted him dead they could have killed him when they arrested him. But no Pakistan wanted a bollywood drama.

First we had him on our tv screens and than India went to ICJ and the world had him on the screen. Imagine how it would have been buzzing in the city with all this media rush.

No body is calling him innocent and most definitely it will be referred to as Indian Spy case.

They are getting their balatkar done on International stage. Little do they realise.

World is talking about it and will talk about it and read about it for long long time.

Let me quote 'THE OFFICIAL SECRETS ACT, 1923', under which( along with other laws/Acts), he was sentenced:


Guess what, this means Mr. Kulbhushan Sudhir Jadhav is pretty much obliterated as long as he is judged under Pakistani Law and under the "THE CONSTITUTION OF THE ISLAMIC REPUBLIC OF PAKISTAN". And the review and reconsideration process will surely respect the laws of the land...in this case, Pakistan's laws. We have more than enough evidence to convict 'Hussain Mubarak Patel'...oh wait, he's an Indian Serving Naval Commander with the legal name Kulbhushan Sudhir Jhadhav bearing service number 41558Z.

Now, I'm just waiting for the next video of him to appear in public stating his views on all of this Indian fiasco. It would be interesting to watch if it really appears.

Ok Pakistan breached it...so the punishment is to have a review via the same courts of Pakistan? Yea...that makes sense...
