ICJ hearing on Kulbhushan Jadhav case : News, Updates & Discussions

I have a question more to do with Pakistanis observing the case. The below are facts and none are in dispute.

Does it trouble you that:

1. None of the charges against the accused have been made public, or even listed to India. Is it your position that the constitution of Pakistan, either based on Islamic laws or democratic laws, does not require an accused and the public at large to know charges against him?

2. Any curiosity why that the broad term "terror" charges specifically have been levied against the accused in public, YET an incident of terror has not ever been attributed to him? Does it seem odd that a military and government politicians who often levy specific terror acts to India, CIA etc. has in this case, not attributed a single incident of terror to the accused rather simply said in broad terms_ he was involved in terror acts?

3. It is a fact that spies all around the world are allowed consular access in democracies and by civilized, responsible nations. Even if in your estimation you think consular access in not required; what are the possible reasons Pakistan does not allow a single day access? What do you think would happen if he got a single visit being he is an international citizen?

4. Finally- under Pakistan's constitution, is an accused allowed to get proper representation of his/her choice in a court of law? Are you curious at the very least as to why the accused was not allowed to assign a representative of his choice, rather given one by the military court?

PakistanI lawyer presented strong case and seemed more confident and commanding than his Indian counter part. Nevertheless all this excerise seems more like a trap set up by Pakistan for India to involve in every outstanding bilateral issues moving forward since India, doesn't want to negotiate with Pakistan on any thing. KY case just provided Pakistan that opportunity. It's a well known fact that Yadav won't be executed by us while will be played as a negotiation chip for greater issues. He will be spending rest of his life in some miserable jail in Pakistan or at least good part of it.

Every outsatanding bilateral issue cannot be brought to multinational forums, there are checks in place which Pakistan has signed would be the biggest hindrance.

Just my opinion , that we look outside the prism of nationalism. The country which has the clout diplomatically will decide what to cook and what to eat. It's all a sham these multinational forums generally.
 
Harish salve was very optimistic and trying to not answer questions on Pakisan's arguments loopholes before the ruling but his light laughter was very percptive.

Gunter mulack is also joining live debate on KY issue on Republic TV.

he did a wonderful job i saw that on ARY but , as babur Awan say we could have sent our representative judge in the panel which would have veto power just in Case, now Indians have their judge on Panel .. no matter how good the lawyer present our case, if we do blunders like these than i have no doubt that, KY will be walking back home ..

Look what will Pakistan achieve by executing Indian spy openly ? Nothing since he and his network is already neutralized ..why not make better use of him ...if we wanted to kill him at first place, than we could had done it already. Sole purpose of bringing him on TV was to malign India and give international audience a proof of Indian involvement. India has already acknowledged him as their 'former' navy officer so their case is already very weak frankly speaking and if you analyze all this Indian request at icj and today's proceedings - Indian case seems more like a request to halt his execution only rather than giving him a clean chit. Yeah for this to understand, one have to think rationally without watching fake Indian media even just for a change.

1. GB accused are listed as enemy combatants caught during a war and have terror acts listed aginst them that can be accessed to anyone

2. Any country that claims them can get access to them

3. They are allowed private civilian legal representation

4. Pakistani citizen terrorist Khalid Sheik Mohammed, mastermind of 911 was given top legal private lawyers. Transcripts and court proceedings were largely open to the public to access. Pakistani citizen terrorist Faisal(Times Square Bomber) was also afforded the same.

Now the points are -
1. How many countries are buying your idea of the expose ? What are they going to do ?

This above answer will determine how successful you are in what you said .

2. IWT issue ? What happened when Pakistan went to world forums just check ?

The false propaganda on IWT won't hold any consumption beyond your borders and Pakistan has learned that already after making a lot of noise without actions on that.

3. What did India approach Icj , don't tell me this is the first time you caught a spy in 70 years ?

4. This Pakistani habit of crying Kashmir in world forums will be dented , once you shy away from following any UN body orders.

He also named I think more than 12 people who's list Pakistan had handed over to India for provision of information. India never replied.

India has been unable to provide an explanation for Mr. Jadhav’s passport which bears a Muslim name, claims Pakistan Foreign Office official

The Vienna Convention provisions on consular access were not intended for a “spy” involved in terror activities, Pakistan on Monday told the International Court of Justice (ICJ), which is hearing India’s plea on the death sentence given to its national Kulbhushan Jadhav.

India’s application on Mr. Jadhav, who was arrested in March last year and sentenced to death by a Pakistani military court on charges of espionage and subversive activities, was “unnecessary and misconceived” and must be dismissed, Pakistan told the U.N.’s highest judicial body.

India has been unable to provide an explanation for Mr. Jadhav’s passport which bears a Muslim name, Mohammad Faisal of the Pakistan Foreign Office said in his opening remarks in response to India’s submissions earlier in the day.

India was using the court as the “scene of political theatre” but “we will not respond in kind,” Mr. Faisal told the ICJ which held daylong proceedings to decide the fate of the former Indian Navy officer.

There has been deafening silence and no response from India on Pakistan’s accusations on Mr. Jadhav, Pakistan’s lawyer Khawar Qureshi said.

Expressing the fear that Mr. Jadhav, 46, might be executed before the hearing was over, India accused Pakistan of violating the Vienna convention and conducting a “farcical trial” without a “shred of evidence.”

Pakistan had denied India its 16 requests for consular access, India’s lead attorney Harish Salve said.

The urgent hearing comes after the ICJ last week stayed Mr. Jadhav’s execution. While India presented its argument over 90 minutes, Pakistan, which claims that Mr. Jadhav is an agent of India’s external intelligence agency Research and Analysis Wing (RAW), took less than an hour.

India wants the ICJ to annul Mr. Jadhav’s death sentence and for Pakistan to ensure that no action is taken that may prejudice the rights of India or of Mr. Jadhav.

Mr. Jadhav, the latest flashpoint in the tensions between Pakistan and India, was sentenced last month. On May 8, India moved the ICJ against the death penalty, alleging violation of the Vienna Convention on Consular Relations. On May 9, the highest court in the UN gave Mr. Jadhav a lease of life.

India, in its appeal to the ICJ, had asserted that Mr. Jadhav was kidnapped from Iran where he was involved in business activities after retiring from the Indian Navy. However, it denies that he has any connection with the government.

Pakistan claims to have arrested Mr. Jadhav from its restive Balochistan province.

Pakistan defence is simple.. ICJ has no.power / Juridiction on this case... why Pakistan send lawyer?

1) World even doesn't buy your idea of exposing Pakistan. Though these things are discussed and talked behind doors. No one will take India's or Pakistan name directly against each other but fact of the matter is, both nations do feel international pressure. Now going with your logic, Pakistan would had easily taken him out at first place had we knew that nothing will buy Pakistani side of the story.

2) India has not violated IWT as of now. They are required to use 11% of India river which they have not utilized yet hence World Bank most of the times have dismissed Pakistani concerns. The moment India goes beyond 11% than there will be all different ball game. Pakistan deliberately takes up everything to world bank just to keep Indian in check.

3) India has went to ICJ because of your stupid, troll and immense propagandist media pressure. Sushma was forced to call him as nation's son just because of your explosive media.

4.) It won't since we never shy away from UN body. See if that would had been the case, we could had simply said No to this ICJ case yet you saw our representative in the court today.
