Article 36
Communication and contact with nationals of the sending State
Para1.With a view to facilitating the exercise of consular functions relating to nationals of the sending
State:
(a) consular officers shall be free to communicate with nationals of the sending State and to have access to them. Nationals of the sending State shall have the same freedom with respect to communication with and access to consular officers of the sending State;
(b) if he so requests, the competent authorities of the receiving State shall, without delay, inform the consular post of the sending State if, within its consular district, a national of that State is arrested or committed to prison or to custody pending trial or is detained in any other manner. Any communication addressed to the consular post by the person arrested, in prison, custody or detention shall be forwarded by the said authorities without delay. The said authorities shall inform the person concerned without delay of his rights under this subparagraph;
(c) consular officers shall have the right to visit a national of the sending State who is in prison, custody or detention, to converse and correspond with him and to arrange for his legal representation. They shall also have the right to visit any national of the sending State who is in prison, custody or detention in their district in pursuance of a judgement. Nevertheless, consular officers shall refrain from taking action on behalf of a national who is in prison, custody or detention if he expressly opposes such action.

I have already read it. It is not part of decision that ICJ has given. In the conclusion ICJ has only asked Pakistan to not to execute KBY. No consular access or anything like that.

hahahahaha Areesh paa ji check kar Pakistan has moved ICJ to rehear KBY case within 6 weeks means almost one half and a month.

Means means his hanging will be delayed by Nawaz Government deliberately

Another half a million pound for Khawar Qureshi. :lol:


I think he is not that bad. He made all his points very clear. The only thing which is visible that is how ICJ is taking sides simple as that.

Anyway Pakistan's move to rehear KBJ case in ICJ within 6 weeks is another attempt on part of current Pakistani government to delay his death apparently it seems.

If case doesn't go as per our wishes, than we will reject ICJ involvement. Also if India decides to go to UNSC than China will veto it for us. This is certain. Peace in Balochistan is equally important for China as well now. India, beaware.

Yeah he is not that bad, Indian government hired him to fight a case on behalf of India back in 2005.

Pakistan approached ICJ with two points only.
1. No jurisdiction over this case as it deals with terrorism
2. The video of confession which Pakistan believed to be an evidence.

And both got rejected. That's all.

1) Pakistan doesn't accept the ICJ jurisdiction in matters related to national security. And no one including ICJ can do anything about it. As for the UNSC, it simply isn't going to get involved for reasons we all know. Pakistan FO had made it clear before the court announced its interim decision that Pakistan doesn't accept ICJ jurisdiction but it will provide solid evidence against Yadav in the international court. And we will provide that evidence now.

2) The ICJ didn't "reject" the video. Evidence was to be examined only once ICJ had decided to hear this case, that's why it was defferred to a later stage. And now as the ICJ has admitted hearing grounds, this video and other evidence will pe presented in the court.

As stated earlier, you guys are excited for no reason. Just wait and see. Rest assured things will not unfold as per your wishes and expectations.

ICJ never rejected the video. It was another lie by nonprofessional Indian media.

Well KBY won't be hanged till August 2017. That was guaranteed by Pak lawyer. We can't guarantee anything after that.

Actually Army cannot force him to step down in a situation like this. Pakistan is fighting at all fronts. NS can play another victim card if removed.

In this regard, the Court notes that the acts alleged by India are capable of falling within the scope of Article 36, paragraph 1, of the Vienna Convention, which, inter alia, guarantees the right of the sending State to communicate with and have access to its nationals in the custody of the receiving State (sub-paragraphs (a) and (c)), as well as the right of its nationals to be informed of their rights (sub-paragraph (b)). The Court considers that the alleged failure by Pakistan to provide the requisite consular notifications with regard to the arrest and detention of Mr. Jadhav, as well as the alleged failure to allow communication and provide access to him, appear to be capable of falling within the scope of the Vienna Convention ratione materiae.

Then why is your government moving the ICJ for rerun of the case? Because the verdict was not in favour of your Pakistan.
