Get to the bottom of birthday rape case.

The girls themselves need to be investigated as well for their past history (whether this is the first incident at a hotel or whether they are 'regulars' there).

While I don't condone accusing victims of rape which is a serious case in Bangladesh (unlike other places where this is taken for granted), it is true that loose hostel girls have found it easy to accuse wealthy people of rape publicly in order to collect blackmail hush-money (baat ban karney ka faisala).

Banani Rape: Victim hands cops 'piece of evidence'

She neither wore nor washed the dress since she was allegedly raped on March 28.

Thinking that the gown she was wearing that night could be evidence helping her get justice, she handed it over to Banani Police Station after filing a case on May 6, over a month after the incident.

The dress belongs to one of the two private university students who were allegedly raped at an upscale hotel in the capital's Banani.

“Wearing the gown would have been impossible because it could bring back the horrors of that night. This might now be important evidence in the case,” one of the girls told The Daily Star.

Meanwhile, a Dhaka court is scheduled to hear today a police appeal seeking permission for conducting forensic tests on the dress.
Forensic experts say it is difficult to get evidence of rape from the body of a victim a month after the crime but extracting evidence from a dress is easier.

“Semen or any tissue of a rapist remaining on a victim's clothes can easily be detected even after a month,” said Kamoda Prosad Saha, head of forensic medicine at Comilla Medical College.

A five-member medical board at Dhaka Medical College examined the girls for evidence of rape on Sunday.

Police were yet to arrest any of the five accused till last night.

Women Support and Investigation Division of Dhaka Metropolitan Police (DMP) Inspector Ismot Ara Ame, who is investigating the case, told The Daily Star that several teams of the law enforcers were trying to arrest the accused.

In another development, DMP Commissioner Asaduzzaman Miah, in a statement, said police found the victim's allegations to be true in primary investigation before the case was registered.

Invited to Shafat's birthday party on March 28, the two girls went to the Banani hotel around 9:00pm. After midnight, Shafat and Nayem raped the girls in two rooms, alleges the girl who filed the case.

Besides Shafat and Nayem, Shafat's driver Billal was accused of filming the rape and his unnamed bodyguard was accused of assisting them. Another young man Shadman Sakif was also accused of assisting.

SHAFAT'S EX-WIFE REVEALS HIS LIFESTYLE
Faria Mahbub Piyasha, a former TV presenter, who was recently divorced by prime suspect of the case Ahmed Shafat, said she often heard from her friends that her husband and Nayem, another accused of the case, were yaba addicts and frequented a Banani hotel to do drugs.

“My well-wishers kept warning me about his addiction after I married him,” she told this correspondent.

Once the case started being reported in the media, Shafat's father Dilder Ahemd Selim, one of the owners of Apan Jewellers, told journalists that Piyasha stage-managed the whole incident to blackmail his son.

Piyasha filed a general diary with Bhatara Police Station on Sunday expressing concern over her safety.

Shafat and Piyasha were married on January 1, 2015. She said Shafat's father did not take their marriage well.

Piyasha said she was present when Shadman Sakif, also an accused in the double rape case, introduced the girls to Shafat at a programme in a Gulshan hotel on March 7.

She received a legal notice for divorce from Shafat the next day.

Piyasha was mentioned in the case statement as a cousin of one of the victims. Talking to The Daily Star, the victim, however, said she contacted Piyasha for her help in filing the case.

NAYEM ASHRAF, A CHEAT ALL ALONG
Banani police said the real name of Nayem is Hasan Mohammad Halim, son of one Amjad Hossain, a resident of Gandail village in Sirajganj's Kazipur Upazila.

Our Pabna correspondent reports quoting locals and police that Nayem used to rob people by going under the pseudonym and claiming to be a son of Gandail Union Parishad Chairman Ashraful Alam.

Contacted, the union parishad chairman said Halim cheated many women and embarrassed him by the false claim that he was his son.

“He tricked a girl in Bogra into in a relationship a couple of years ago by showing her

Kazipur mayor's house and claiming that it belonged to him. After the truth came out, Halim was beaten up by locals of Kazipur. Halim went to Dhaka after that incident,” Ashraful said.

A police officer called Ashraful from the capital last year and told him that Nayem abducted the daughter of an industrialist.

His criminal activities started with leaking question paper when he was a SSC student at a local school, the chairman said, adding that he married a girl who divorced him after knowing that he was a cheat.

An official of Gulshan police said they had information that Halim ran an event management farm, Emakers Media and Entertainment, in the capital and used it as a means to hobnob with female students and introduce them to sons of rich people.

People who knew him said Halim also used the name Nayem Ashraf on social media and often uploaded photos with influential people, including MPs, police officials and celebrities to show off.

PROTEST OVER BANANI RAPE
Police's failure to nab the accused reveals a culture of impunity prevailing in the country, rights activists, writers, academics and bloggers said at a rally in the capital yesterday.

Police is not arresting them as they are sons of influential and well-off families, they told the rally in front of the National Museum and demanded their exemplary punishment.

The protestors threatened to march towards Banani Police Station from Shahbagh intersection if police fail to nab the culprits within 72 hours.

Ain o Salish Kendra Executive Director Sheepa Hafiza, rights activist Khushi Kabir, publisher Robin Ahsan, DU teacher Sutapa Bhattacharya, Hill Women's Federation President Nirupama Chakma and filmmaker Amitabh Reza Chowdhury, among others, spoke at the rally.

Meanwhile, students from different educational institutions announced that a rally will be held on Dhaka University campus today.

Police arrest Shafaat, Shadman from Sylhet home

Shafaat and three others were earlier spotted while trying to rent a room in a Sylhet resort
Police have arrested Shafaat Ahmed and Shadman Sakif, two suspects in a rape case in Dhaka, from a home in Sylhet.

Sylhet Metropolitan Police Commissioner Golam Kibria told the Dhaka Tribune that police arrested them from a two-storey building named Rashid Manjil in Sylhet city’s Pathntula area around 8:30pm Thursday.

They would be sent back to Dhaka, said the police officer.

According to the case filed with Banani police station on May 6, Shafaat, the son of Dildar Ahmed, one of the owners of Apan Jewellers, and his friend Nayeem Ashraf, the second accused, allegedly raped the two university students while Shafaat’s bodyguard held the girls at gunpoint at Raintree Hotel in Banani on March 28.

Shafaat’s driver Billal, 26, the fourth suspect, videotaped the incident.

Shadman had introduced the two girls to the rapists, and he was the one who convinced the two to visit Raintree Hotel that night, telling them they would be attending a birthday party.

Police first attempted to arrest the men on Tuesday, going to the house of Shafaat, and found that he and his passport were missing.

The same day, officials at the Regent Park Resort in Thakurbari Thillapara in Sylhet recognised Shafaat, accompanied by three others, as he unsuccessfully tried to rent a room there. They left before the officials could notify the police.

Police say they want to interrogate the two suspects further
Police say they have found evidence of Shafaat Ahmed and Shadman Sakif’s involvement in the rape of two female university students at a Banani hotel during primary investigation.

The two were arrested in Sylhet on Thursday and brought to Dhaka in the morning.

Police are moving the court seeking 10 days’ time to interrogate the two.

DMP Joint Commissioner (crime) Krishna Pada Roy told the media on Friday that the accused had insisted that their sexual encounter was consensual.

The victims gave statements before the investigators on Tuesday and issued judicial statements before a Dhaka court on Thursday.

Shafaat and Shadman were arrested in Sylhet on Thursday night in a joint drive by a police headquarter special team, DMP Detective Branch (DB), Victim Support Centre, Bannani police and Sylhet Metropolitan Police.

The Victim Support Centre is conducting the investigation.

The two victims, who were raped on March 28 at The Raintree Hotel, filed a case on May 6 with Banani police against Shafaat, his friends Nayeem Ashraf, Shadman, Shafaat’s driver Billal and his unnamed bodyguard.

Police recorded the case after a 48-hour delay.

Shafaat is the son of Apan Jewellers’ owner Dildar Ahmed. Nayeem is the managing director of eMakers Bangladesh and Shadman Sakif is one of the directors of Regnum Group.

Police say they have reason to believe Shafaat Ahmed may have sexually assaulted other women
Police believe Shafaat Ahmed, the prime accused in the rape of two university students in Dhaka’s Banani in March, may have committed sexual violence before.

Investigators told a Dhaka court on Friday that Shafaat, son of Apan Jewellers owner Dildar Ahmed, may have sexually assaulted other women in various upscale hotels in the capital.

The court granted a six-day remand for Shafaat and a five-day remand for Shadman Sakif, his friend who is accused of coaxing the victims to come to the Raintree Hotel in Banani, the scene of the crime.

Dhaka Metropolitan Police’s Women Support and Investigation Division Inspector Ismat Ara Emi pleaded for 10-day remand for each accused while she informed the court that initial investigation suggested that Shafaat had raped many other women before.

ADC Asma Siddiqua Mili of the Women Support and Investigation Division said the background and nature of the suspect give reasons to suspect that they may have committed crimes against women before.

The remand prayer described how the two victims were raped by the accused at the Raintree Hotel and Restaurant on March 28.

Dhaka Metropolitan Magistrate Md Raihanul Islam granted the remand pleas, after rejecting the bail petitions of the two accused. When the two accused were produced before the court on Friday afternoon, they were seen crying at the witness stand as their lawyers tried to console them, court sources said.

DMP senior officials said their primary interrogation of Shafaat and Shadman, and the victims’ statements pointed to the authenticity of the allegations.

Shafaat and Shadman had been arrested from Sylhet city’s Madina Market area on Thursday night in a joint drive of a Police Headquarters special team, DMP Detective Branch, DMP’s Women Support and Investigation Division, Banani police and Sylhet Metropolitan Police.

Officials who were on the drive said the accused tried their best till the last moment to evade arrest, even going as far as to offer the police officials Tk10 crore bribe to let them go.

Police sources said in primary interrogation, Shafaat and Shadman said they along with Shafaat’s bodyguard Azad and driver Billal fled from Dhaka on May 5, staying at several places in Gazipur, Narsingdi and Sylhet. They kept their mobile phones switched off.

On Monday, Shafaat phoned his maternal uncle for a place to hide after they were rejected from a resort in Sylhet. In the meantime, Billal and Azad left them and fled. Shafaat’s uncle managed his London-expatriate friend’s house at Madina Market in the Sylhet city for his nephew to hide, from where the two were arrested. Both men appeared to have had a haircut.

After the arrest the fathers of the two accused refused to make any comment.

Sahely Ferdous, assistant inspector general (Media) of Police Headquarters, told the Dhaka Tribune that the headquarters special team had located the duo using technological tools.

On May 6, the two young women, both university students, lodged a rape case with Banani police against Shafaat Ahmed, his friends Nayeem Ashraf and Shadman Sakif, Shafaat’s driver Billal and his unnamed bodyguard.

After experiencing repeated threats from the accused, the two young women lodged complaints with Banani police on May 4. Police accepted the rape case 48 hours after the incident.

DMP Joint Commissioner (Crime) Krishna Pada Roy at a briefing on Friday said they had found evidence of Shafaat and Shadman’s involvement in the rape of the two women at a Banani hotel during primary investigation.

The two were brought to Dhaka on Friday morning and kept at DMP’s DB Office for initial interrogation. Krishna said the accused had claimed to police that the sexual encounter on March 28 night was consensual.

The victims gave statements before the investigators on Tuesday and issued judicial statements before a Dhaka court on Thursday saying they were raped by the accused and the rapists, being influential men, had repeatedly threatened them of consequences if they went to the authorities.

The Women Support and Investigation Division’s Victim Support and Investigation Centre is now investigating the case. A four-member team, led by the DMP’s joint commissioner (Crime) is also helping the IO.

Krishna said a separate three-member probe body, led by DMP’s additional commissioner (Crime), was formed to look into the delay in accepting the case and the allegation of harassing the victims.

The victims said police were sure of the identities and whereabouts of all the accused but delayed arresting them because of their influential families.

Nayeem is the managing director of eMakers Bangladesh and Shadman Sakif is one of the directors of Regnum Group. Dhaka Tribune found that the bodyguard’s name is Abul Kalam Azad. Driver Billal, bodyguard Azad and Shadman were accused of assisting Shafaat and Nayem during the rape.

Police are trying to arrest the other accused, Joint Commissioner Krishna said.

“No one is influencing our work. We are trying to conclude the investigation with fairness and by collecting all kinds of evidence.

“Police are looking at this from all aspects – forensic, forensic IT and medical – alongside the regular investigation,” he said.

HC for ensuring trial in 180 days

The High Court directed the Supreme Court registrar general to form a cell to monitor whether trials of cases under the Women and Children Repression Prevention Act, 2000 are finished in 180 days.

The monitoring cell will report to the SC and the government for taking appropriate action against judges, public prosecutors and investigation officers who will fail to assign causes for not disposing of the cases on time, read the full text of the HC verdict released on Thursday.

The bench of Justice M Enayetur Rahim and Justice JBM Hassan delivered the short verdict on December 5 last year after hearing a suo moto rule on the issue.

The rule was issued earlier during the hearing of a bail petition filed by Milad Hossain, an accused in a murder case filed under the act.

According to Section 20 of the law, the Women and Children Repression Prevention Tribunal must finish the trials of cases filed under this law within 180 days of charge-framing.


If the trial of a case is not finished on time, the tribunal judge, public prosecutor and police officer concerned have to submit separate reports to the SC and government, mentioning causes for the delay, and then the authorities concerned should take necessary steps, states the Section 31(ka) of the law.

“Therefore, the Registrar General of the Supreme Court of Bangladesh is directed to constitute a Monitoring Cell headed by him or the Registrar of the High Court Division along with the Secretary or his representative not below the rank of Additional Secretary of the Ministry of Home Affairs and Law and Justice Division, Ministry of Law, Justice and Parliamentary Affairs," the HC judges said in the full verdict.

"The Monitoring Cell shall monitor this aspect and shall submit report from time to time to the concerned authorities of the responsible persons for taking appropriate action in accordance with section 31Ka (3) of the Act, 2000 with a copy thereof to the Monitoring Committee for the Subordinate Judiciary of the Supreme Court,” the verdict added.

The HC refused to grant bail to Millad Hossain as there was specific allegation against him and asked the trial court to finish his trial in one year after receiving its judgment.

The law secretary and SC registrar general on December 5 last year submitted two reports to the HC saying that none of the lower court judges, public prosecutors and police officials concerned complied with the provision of women and children repression prevention law that asked them to assign reasons for not disposing of cases under the act in 180 days.

The law secretary and SC registrar general submitted the reports after the HC asked them to explain in 30 days whether there was any exercise of the section of the law and whether the SC and law ministry had taken any steps in this regard.

Milad Hossain's lawyer Cumar Debul Dey told The Daily Star that the case against him was filed with Rangunia Police Station in Chittagong on February 19, 2015 on charge of killing his wife.

The case was sent to the Women and Children Repression Prevention Tribunal-2 of Chittagong for trial.

The tribunal framed charges in the case on March 21 last year but could not finish the trial on time, the lawyer said, adding that no witness of the case appeared before the court yet.

Rape is Rape, all kind of rape should be stopped,and rapists should be punished.

Its a positive step that people are raising their voices against it. If one rapist gets punished,many future rape will be prevented.

Who is stopping you to raise your voice? start raising your voice,do something about other rapes. And STOP criticizing when something good is happening. One punishment will stop many probable rapes.
Let's use our energy to bring positivity,to strengthen the fight against rapists,to stop this whole culture.
If you want to do something to catch the other criminals, this is high time to get support. and nobody ever stopped you to do so. So lets fight it, or just ignore as you have always been and go back to your petty life.

And its true that our social system is faulty, it doesn't always highlights all the problems.But let's face it, We are the system. Its also our fault. We need to participate and be more aware.And it is crucial to understand how to participate in mending the system rather than complaining about it at the wrong time.

This is a story about a teenage girl, who is among thousands of teenage girls in Bangladesh who can relate to her story.

Sometime last year, she was walking home after her classes in the evening. She was tired and in a hurry to go home, she took a shortcut which was not on her usual route. As she quickly walked along the narrow and secluded alley, a hand emerged growing dark and gripped her wrist.

Gasping, she turned and found her assailant to be a local she had seen around the neighbourhood. Her face became contorted in terror as apprehension dawned upon her.

She walked home bleeding and bruised in body, numb with trauma in her mind. Her father lashed out with inquiries about where she had been. But her mother understood, without anything being said, and fell upon her daughter in a tearful embrace.

The girl was instructed by her mother to never discuss the rape with anyone. “You’ll never get married. Nobody will talk to you” were the silencers disguised as warnings. The stigma of being raped is too overwhelming in Bangladesh, where society itself collectively ostracises the victim and their family.

Repressing the trauma, a semblance of normalcy was re-established into the girls’ life. After several years, when she got into college, the rapist appeared again with a statement: “I will rape you again whenever I find an opportunity.”

How do we talk about rape?
Thousands of women know of the dread that follows after rape, to say nothing of the harrowing ordeal itself. There are no adequate support services, no provision of protection for victims and witnesses, a bestowment of condescending patriarchal judgments, protracted court proceedings, ineffectual police investigation and a gaping hole in rape shield provisions.

A person who has been raped is subjected to a plethora of tests that compel her to relive the incident.

Considering all these limitations, it comes as little surprise that most rapes in Bangladesh go unreported.

Sheepa Hafiza, executive director of Ain o Shalish Kendra (ASK) said: “Our country is not ready to talk about rape. The fact that so many rapes go unreported only show that rapists go about with a sense of impunity and rape victims are scrutinised.

“There is an abysmal idea that a woman’s honour is explicitly tied to the sanctity of her body. There is a pressure on women to be chaste, a pressure to not get raped. If the accused is wealthy or powerful individual, victims can forget about justice.”

“If all the rape charges are followed up one by one, people will feel less reluctant to report sexual assaults,” Sheepa said.

Maya Apa, trying to make a difference
Fearful of the stigmatisation, the girl turned to Maya Apa – a virtual platform that provides a diverse range of support on healthcare and legal matters. Since 2011, its anonymous messaging service has continued to assist people with queries about sexual assault.

Shuvashis Monigram, growth manager at Maya.com.bd told the Dhaka Tribune that they deal with a number of unreported sexual assault cases and provide support with health, psycho-social and legal experts.

“Over the past one and half years, we have had more than 20 complaints regarding sexual harassment,” he said.

Bangladesh Legal Aid and Services Trust (BLAST) Executive Director Sara Hossain said countless rape cases go unreported because of social stigma.

She said: “Victims feel insecure, they know what they have to go through when they come forward with allegations. Their fear silences them.”

Criminals have strong connection with awami league but should be pursued. At the same time victims are not without faults. It may be well and good according to secular and progressive play book for girls to attend bachelor "birthday party", in hotel room, at the middle of the night. But obvious consequences form secular and progressive play are at question now. This problem is secular, progressive and elite class creation. Both victims and perpetrators belongs to that elite and secular class.

"Wise-men" who are against such "secular and progressive play" at the middle of the night, are labeled as "mullah" , "fundamentalist" etc. Perhaps, all these Sultana Kamal and Kushi kabir verities has some answer to give to society.

Customs Intelligence Investigation Directorate (CIID) has sealed off an Apan Jewellers outlet at Gulshan’s Suvastu Tower during a drive.

“Upon receiving information about illegal gold there, we conducted a raid at the outlet on Sunday. But it was found locked,” CIID Director General Dr Moinul Khan told the Dhaka Tribune.

“We have sealed off the outlet. The drive is underway,” he added.

CIID Joint Director Shafiur Rahman said: “We are conducting raidsat five outlets of Apan Jewellers in Dhaka’s Gulshan, Uttara, Mouchak and Dhanmondi areas.”

“Rapid Action Battalion and VAT collection authorities are with us.

“We are raiding the outlets for information regarding sources of capital for their gold and diamond businesses as well as payable VAT, duties and taxes,” he added.

Recently, CIID decided to start an inquiry about the finances of Apan Jewellers’ owner Dildar Ahmed and his son Shafaat Ahmed following the disclosure of allegations against Shafaat and four of his associates of raping two female university students after a birthday party at Banani’s The Raintree Hotel on March 28.

During the alleged rape, the girls were beaten whenever they protested. Shafaat is claimed to have said things like “I have been accused in 20 murder cases and I am untouchable.” The boasts followed with things such as “I am the biggest smuggler in Bangladesh.”

The victims lodged a case with Banani police station on May 6 while the case is now under investigation by Dhaka Metropolitan Police’s Women Support and Investigation Centre.

In the meantime, police nabbed accused Shafaat and Shadman Shakif from Syhlet and placed them on remand. The other three accused are still on the run.

Customs Intelligence Investigation Directorate (CIID) has decided to file three separate cases against The Raintree Dhaka hotel, where two university students were reportedly raped in late March.

“The cases will be lodged against the hotel authorities over money laundering, smuggling and tax evasion,” CIID Joint Director Shafiur Rahman told reporters on Sunday afternoon after a raid at the hotel.

During the raid, CIID officials recovered ten bottles of liquor from a room of the hotel, where Department of Narcotics Control (DNC) found nothing illegal during its two separate raids on Saturday and Wednesday.

Narcotics department raided the hotel following allegations that Raintree ran an alcohol bar without legal permission.

However, Raintree hotel Manager Franck Forget denied the allegation, saying: “We only have a coffee bar.”
