The Madhya Pradesh High Court on Tuesday (03rd November) denied to grant the benefit of Anticipatory Bail to a man accused of posting the vulgar photograph of the Rashtriya Swayamsevak Sangh (RSS) Chief, Dr. Mohan Bhagwat. The Bench of Justice B. K. Shrivastava was hearing the application filed under Section 438 of Cr.P.C. on behalf of one Kausal Singh Masram, who was under the apprehension of his arrest in connection with Crime No. 410/2020 registered at Police Station Umariya for the offences punishable under Sections 292 of I.P.C. and 67 of the I.T. Act.

The applicant was booked for allegedly posting a vulgar photograph of Dr. Mohan Bhagwat and he also tagged 28 persons in the said post.

It was submitted by the counsel for the applicant that the applicant himself lodged the complaint with the police regarding misuse of his I.D.

However, the Court noted that the complaint was lodged during the pendency of his pre-arrest bail application and after two months from the registration of crime.

To this, the Court said, "It cannot be believed that the applicant was not having any knowledge because it is pointed out by the State as well as learned counsel for the objector that 35 persons like the post and 9 persons commented upon the post."

Therefore, the Court said that it could be presumed that the applicant was having the knowledge that his post had been seen by several persons.

Looking to the aforesaid act of the accused, the Court opined that he was not entitled to get the anticipatory bail.

Accordingly, the application was dismissed.

Freedom of speech in India has restrictions imposed in the interest of public order, security of State, decency or morality.

What I fail to understand is why are Indians advocating freedom speech in other countries when they themselves are not practising freedom of speech in their own country.

Trying to draw some parallels? Should have waited till some RSS goon beheaded or shot the accused. Anyways I wouldn't be surprised if some goon do the same, but I strongly feel he wont be called the hero in India (bar some fb lunatics you may want to post the screenshots of).

On topic: vulgarity is punishable, of a living person, islamic, hinduism or any other religious figure in India.

We dont advocate absolute freedom of speech anywhere.

If those cartoons of Prophet Mohammad are vulgar and mocking, they should be dealt within the law and punished for hurting sentiments.

What we oppose is extrajudicial barbaric killings. In France, in Pakistan or in India.

Indians advocate rule of law. How hard is it for anyone to understand? Indians tend to abide by local laws even in Islamic arab world.

India has free speech with reasonable restrictions.

India and Indians support free speech in other nations that is adhering to THEIR Laws. For e.g. Free Speech in France.

It is called RESPECTING THE LAW.

And its very legitimate demand.

However we should consider below aspects -
1. Not every culture consider vulgarity, mocking of disproportionate levels as equally offensive. What could be offensive for you may not be offensive for them.
2. Different countries will put laws as per their sensibilities and logic. Cow killing may sound very satanic in hinduism for some, but why should Pakistanis / Americans avoid it just to please India hindus? They will accommodate as much as they can and find logical.

Just dont go berserk in other countries. Protest rightfully.

For the uninitiated:

"Freedom of expression has limits" MEANS "If that limit is crossed, take legal recourse".

It does NOT mean that "If that limit is crossed, that person should be beheaded".
