'Fake rape': Pak woman gets 40 lashes - Pakistan - World - NEWS - The Times of India

LAHORE: A Pakistani court has awarded 40 lashes and two years’ rigorous imprisonment to a 32-year-old woman under the controversial ‘Hudood’ law for “falsely” accusing two men of raping her.

The charge levelled by Abida Bibi, the wife of a labourer from Layyah, located 175km from here, against the two men was proved to be false in a court.

A sessions judge said in a judgement issued on Thursday that Abida had levelled a false allegation of ‘zina’ or forcible fornication against the two men. She was therefore guilty under the provision of the Hudood Ordinance related to ‘qazf’ or false accusation of fornication, he said.

Abida had alleged that four men had entered her house in 2008 when her husband was away. She said two of them raped her.

What you have to see is, is this punishment given for lack of evidence against the rapists or for actual proof of lying?

I am sure the trial would have been fair, news does not say anything about court being forcefully giving that verdict. She "falsely" accused the guys, which could have put them to death

if she falsely accused these two mens then she deserves the punishment i would say 2 years imprisonment is little harsh so reduce that to 6 months and increase 40 lashes to 80 lashes

If she was innocent and nothing just approved due to the lack of evidences then she should also be released also with others and the police should still try to collect the appropriate evidences if possible.

The Lashes awarded under Shariah are not as severe as you may think, for example the upper arm must remain by ones side when lashing, and only the lower arm yields the lashes.

Try doing it yourself and you will see how little power you will be able to muster.

It is a matter of opinion that lashing a criminal is "barbaric", whilst imprisonment of a criminal for several months or perhaps even years for the same crime is "justice".

Why put somebody in prison, provide them shelter and basic amenities, which all costs money, when you can lash them and get it over and done with in a day? Not all countries can afford such luxuries for their criminals.

Regarding this case - no comment.

Edit: Just realised that she has been awarded two years in prison ASWELL! hmm, I think I will comment - seems a little harsh, nevertheless, the lashes should not be compared to the lashes you see on Holywood!

What behaviour and laws you are talking about.. They are irrelevant if they are not supportive to help the victims and punish the culprits.
Change- is the need of the hour and law of nature and without that no-one can survive long..

With regards to the case, if she did indeed lie then she should have been charged with filing a false police complaint - that is what most modern penal codes stipulates.

As I have outlined in my post, the lashes awarded under shariah or not like the ones you see in Holywood, or in your case Bolywood.

The upper arm must remain by ones side and motionless; only the lower arm can yeald the lashes. Try doing it yourself and see how much force you can muster.

I would choose lashes. Get it over and done with rather than waste your life in jail.

If you falsely accuse somebody of rape, it is serious, as you are degrading the honour and standing of that individual.
