An interesting exchange took place between Chief Justice Asif Saeed Khosa and Barrister Farogh Naseem during today's hearing of General Qamar Javed Bajwa extension case.

The CJP asked General Bajwa’s lawyer, Farogh Naseem, if the army chief will retire tomorrow (on Thursday), adding that according to the AG’ a general never retires’.

“In your opinion, can a former army chief also be appointed as COAS?” the SC CJP said.

“As per the attorney general and the definition of article 243, even he [the AG] can appoint the army chief” Justice Mansoor Ali Shah remarked. If the federal government doesn’t appoint an army chief, how can it grant him an extension, Justice Shah opined.

“If the duration/tenure is over, does that mean that the army chief can be considered retired?” To which the attorney general replied that there was no age limit to a general’s retirement.

“That means that any retired military officer can be appointed army chief,” observed Justice Shah. “Where does it say that a COAS has to be from the army?”

The attorney general stated that General Bajwa will retire tomorrow night.

“Then this case must be decided on an urgent basis,” said the CJP.

Field marshal is a very senior military rank, ordinarily senior to the general officer ranks. Usually it is the highest rank in an army, and when it is, few persons are appointed to it. It is considered as a five-star rank in modern-day armed forces in many countries.

ISLAMABAD: The government on Wednesday prepared a new draft for extending the tenure of Chief of Army Staff (COAS) General Qamar Javed Bajwa.

Prime Minister Imran Khan held an emergency with the army chief in the presence of senior members of the federal cabinet to discuss the recent situation which escalated following Supreme Court’s (SC) suspension of government’s notification pertaining to General Bajwa’s tenure extension.

The government’s legal team briefed the premier and the cabinet about the objections raised by the apex court in the case during Wednesday’s hearing.

Reportedly, the high-level meeting held consultations over the amendments made in the rules of the Army Act.

The meeting was also attended by senior leaders of the Pakistan Tehreek-e-Insaf (PTI).

Earlier in the day, an SC bench comprising Chief Justice of Pakistan (CJP) Asif Saeed Khosa, Justice Mian Mazhar Alam Khan Miankhel and Justice Syed Mansoor Ali Shah heard the case, whereas the army chief was represented by former law minister Farogh Naseem.

During the day-long hearing which was adjourned twice, the chief justice said that the prime minister had requested a reappointment whereas the president had issued a notification for extension in the army chief’s tenure, questioning the lack of seriousness in the case. The hearing was then adjourned till Thursday.

In an unprecedented move, the SC on Tuesday suspended the notification of a three-year extension in the tenure of the army chief.

The army chief — whose tenure was slated to end on Nov 29 — was given an extension by the prime minister in August. “General Qamar Javed Bajwa is appointed Chief of Army Staff for another term of three years from the date of completion of current tenure,” a notification issued from the Prime Minister Office (PMO) said at the time.
