I think it is well established that there were armed conflicts between Jews and Arabs during the British Mandate.
If you are not aware, then you need basic history lessons.
Europe did not decide what to do with the land.
It was a UN majority vote in the General Assembly, where all the countries are represented.
This gave the Jews a legal position to declare an independent state within the territory suggested by the UN.
Few states has a better legal position, and your comment that UN is irrelevant is
your weakest argument.
Most states are created by mafia-like organisations which have defined their borders
after fights with other mafia-like organisations.
Over time many of those organisations have been overthrown by revolutions or constitutional reforms.
The reason there are refugees, is that they fled their homes, and the reason has been debated.
Arab armies told them to get out of the way, to allow the Armies attack w/o risk of friendly casualties.

There has not been too many of them in Israel after the war of 1948 ended.
Reason they are still refugees, is the policy of surrounding Arab countries to not assimilate them.
An equal number of jew refugees went from Arab countries to Israel, and they are no longer refugees.
Legally, if you move out of occupied territories, you have the right to move back.
If you move out before the territory is occupied there is no such right.
That may be a loophole in International Law.
